If you have an idea, how do you go about patenting it to eventually sell it?
You see all those ideas on As Seen On TV - well someone had to come up with it. So, if you have a great idea that would make a great product, how do you go about creating that product while protecting your idea!
I would not waste my time with patents. I got some advice when I created a harness that kept children from falling out of a shopping cart. The patent lawyer said it was not worth the money or time to patent it as someone could take the product and make a very small change to it and not have to worry about a patent infringement.
I would say if you have an idea, get it to market very fast and sell, sell, sell. If someone copies it, just make sure you have a unique selling proposition to out sell them.
You should always patent your idea and creation. If you patent something, you can then license that patent to someone, and not have to worry about sell, sell, sell. You should always protect your rights.
First you write the idea down, record it, video tape yourself talking about it so you don't forget what you thought about, then you just file a application with the patent office. It may take some time to get a patent, and it may get denied, but you just need to be the first to submit a valid application, for something that hasn't been already patented yet. You will be approved or denied. Just make sure you submit all original artwork and make copies for yourself, or vice versa it just needs to be dated to show when YOU created it, so another person doesn't come along and said they submitted the patent idea two days before you.
