I can't answer the ? in those terms. The constitution has been diluted and misinterpreted by the SCOTUS for the last 100 yrs. So, it is more like the constitution as diluted has abandoned the citizenry, and restricting the freedoms created by the founders.
It has turned the basics of our democratic republic into a mockery of the supposed government by the people, for the people, and of the people. The people being the majority, and not the cults, and super minorities.
Where is the constitution with the party elites trying to circumvent the votes of the people? It is not trapping the people, it has abandoned the people. The parties are now blatantly and visibly claiming that they know better than the people who to elect as the president of the US. The people and not the parties were the focus in the creation of the US.
The government was created to protect the people, but that dream started its death roll in the 1960s, That is when the parties started to move without the attachment of the people. The parties shepherded their loyal party voters, and pandered to the independents. It continues today.
My point is that the constitution is no longer in the equation, as both parties have replaced the constitution, or actually just abuse it.
