Do I need to call Lancome to request the use of a video on You Tube that was produced and backed by Lancome? I am unsure of what to do about You Tube videos. I used one that belonged to an individual in my city during a storm, and I thought that was ok. Thanks

As far as I am aware, if they have not diabled teh embed function option then you have full rights to embed the video on other sites.  This does not mean you have the right to download the video and then republish it under your own name.

Assuming it is from an authorised channel, and embed is enabled, you can use it.

Hi - Thanks for your help. It sounds like a gray area, but leans toward use of You Tube. Don't you wish everything was clear, but that's life. I try to follow rules. I will use this video.

I am absolutely certain that Lancome created the video and put it out there so that people WOULD embed the heck out of it all over the place. smile

I do not know about the Lancome video, who put it there and what their intentions were. Personally, I would not hesitate to use it if it appears to be a legitimate upload.

It is a complex and controversial issue, however, as a forum search would show and as this hub discusses in more detail.

I don't believe it is that complex or controversial a subjecct, as their Terms of Service specifically say:  "You also hereby grant each user of the Service a non-exclusive license to access your Content through the Service, and to use, reproduce, distribute, display and perform such Content as permitted through the functionality of the Service and under these Terms of Service."

Irohner, the author of the hub to which I was referring does mention that argument towards the conclusion. Nonetheless, there is heated debate over the issue among copyright experts.

Well, if the topic is strictly about YouTube sharing, I would say that's a waste of a hub and a waste of debate. Anyone who accepts YouTube's Terms of Service agrees to let users embed their videos. Full stop.

Except not everyone who uses YouTube owns what they are uploading.
