N.Y. man sues White Castle over too-small booths

   NANUET. N.Y. -- Martin Kessman says he loves White Castle burgers and has been eating them for 50-plus years, but the 290-pound stockbroker doesn't like that he can't fit into the booths at his local restaurant.
   
   So he's suing.
   He filed a federal lawsuit last month against the fast-food chain claiming the small seating violates his rights under the Americans with Disabilities Act.
   He also accused White Castle of reneging on its promise to upgrade its seating with more space between the table and back of the bench to accommodate heftier customers.

   the company spokesperson stated that the customers can request chairs if they don't want to sit in a booth..sounds like a frivolous suit?..

   Are you serious? I'm sorry, I have absolutely nothing against larger framed people in fact I know and love several people who are overweight but this is totally ridiculous!! That would be like me suing every clothing company in America for making clothes smaller than my size! This man should either lose the weight or stay home! It's his fault that he's too big, not White Castle's!

      Is there a real difference here between this and the airline passenger that takes their own seat plus a good deal of the ones on each side?
      
      Either way someone else (White Castle or other passengers) are expected to pay the price for their over eating.

      He can't carry burger, fries and drink while eating.  Nor can he fit into his car to sit down and use the cup holder.

    Well, if he has been eating burgers for fifty years, of course he can't fit into the booths.  Maybe a salad every now and again might have prevented his problem.

    It occurs to me that if WC made their booths to fit this guy no one else could reach the table.  We'd dribble our fries and burgers all over the floor!
    
    Of course, the obvious solution is to custom fit one booth in every joint for him.  Makes good sense!
