A poem of mine was copied. . .

    I found this poem of mine copied onto a blog site.  It is a well read blog.  I was not credited nor was there a link back to the original.  I emailed the blog host asking that it be removed and gave a link to my original and the publish date.  I just checked the site again and the poem is still there in it's entirety but I have been given credit for it with a link back to the original.

    Should I demand it be removed because it is my work or should I let it go because there is a back-link to the original?

      Why is it on his blog?  What purpose is it serving?  Is it a literary blog?  Is he making money with ads or something?
      Please post the link and tell what the poem is.  I'm curious.

        It is a radio station blog.  I don't think they have adsense on it and my poem is about breast cancer and the blog post is also about breast cancer. 

        I also found the same poem on a pogo forum copied word for word, (except one single word was changed), and entered into a contest.

          I'd contact the contest administrators at the very least and let them know you are the owner.

      I'm not sure how that goes, because a backlink can be very valuable depending on the site's PR, or it could be damaging because he has made your entire work duplicate.

      If it was me, if his blog was a PR3 or above, I would leave it - your original still ranks higher so he is only hurting himself.

      Anything less than that probably isn't worth it, to you.

      Not forgetting that someone could steal it from him tomorrow, and take umbrage if you file a DMCA against the new content thief who doesn't even know he has stolen from you.

      Perhaps it is worth writing to the blog owner again and suggesting that a happy compromise would be for him to only show your first paragraph with a link back to HP.

          A DMCA is the Digital Millennium Copyright Act and as our work has already been copyrighted, a simple form filled in and sent off to Google will see them take action.

        It is one of two poems that was copied.  I tend to put similar poems together on one page because they are generally very short.  But one of the two was copied.  Not sure what the PR is for that site but I would say it is at least a 3. I checked and the main site is a PR 4 but the blog itself shows as NA.

          It's a poem, sorry to think so little of poetry but it's hardly going to bring your site down, is it?

          He took one of two, half a hub if you like, and you are probably now going to get a lot more exposure to your work because of it.

          I would leave it, but take rigorous action against anyone else who tries to steal it, like that person you mentioned further up.

          You wrote it, published it here first and hold the copyright.

            Thank you Izzy.  I was thinking of leaving it on that blog but wanted more information.  The other site where it was entered into a contest is a pogo site, (forums).  I had to join pogo just to be able to try and get some help with it.  I also noticed my poem won a prize for the person who entered it and that bites big time.

              Aahh...I wouldn't let that rest. You are the author, it was your experience and you wrote it.

              And you hold copyright. I would take that further and get the prize taken off the thieving B. You don't go after the prize as you didn't enter it, but no-one else has the right to it, for your work.

                She said she wrote that poem about her mom.  This is what makes me so angry.  Here is what she wrote about the poem word for word.

                ***WHEN SHE FIRST SPOTED THE CANCER I TOLD HER I SAYS MOM PLEASE DO WHAT THE DOCTORS NEED YOU TO DO . SHE WENT THREW SEVERAL TREATMENTS AT THE MAIN CITY HOSPITAL FINALLY AT THE END THE KEMO THERAPHY MADE HER TO SICK.                   And the judges never noticed the difference in the language?

                  I was hub hopping today, and I came across quite a few hubs with misspelt titles but perfect hubs.

                  Well your suspicions are aroused right away, aren't they?

                  But I am thinking the automatic filter would have kicked in if they were duplicate.

                  Nope, duplicated from the likes of ezinearticles and other obvious ones, not .pdf files like you might expect.

                  You would think any reasonable site would know to look out for that trick.

                  Can you DMCA them if they have your poem on display? Get a lawyer? Something?

                  If you want I will write a hub about it, and name and shame all those involved, except that's a little pointless when Google is busy burying my work.

                  I will do it though and post links everywhere if you want smile

                    I am sure I can get pogo to remove the poem and ban the user who entered it and possibly the person who held the contest.  I am actually trying to be as nice as possible about it. 

                    Now I am unable to read the forum thread I started about plagiarism.

      That poem is beautiful and I can tell, very personal too. I am sorry if I came across as flippant in my last comment.

      I would leave it, you are named as the author and have a nice backlinks (you are right that part of their site is a PRn/a just now, but if the main site is PR4 that could change).

      Beautiful poems deserve to be read. What better way to remember your mother?

    Wouldn't a back link be worthless if they copy your content? I think the negative weight from your copied content is more than the positive weight from the backlink. I'd send a DMCA.

    One of the Moderators at Pogo sent me the following message.

    If you'd like to send me the name of the thread that contains the poem, I can look into it, however, I don't believe there is a legal issue in this setting. The contests here are not sponsored by Pogo, it's by individual members and there really isn't much that can be done other than to ask the poster to either credit or delete it.

    How stupid do they think I am?  Pogo hosts the forum and are responsible for all content that is posted.

    This happened to me not too long ago. Personally, I made sure it was removed, because permission was not granted and I want to protect my copyright. I actually contacted his hosting provider (it was made private, but I tracked the server down through domain tools). I explained to them that I'd tried to contact the blog owner and the item still was not removed and asked for their help. They e-mailed the website owner and it was down within five minutes. They then e-mailed me back and let me know. That seemed to do the trick.

    Sometimes, I think people don't understand copyright issues, so I try to be very nice about it and just explain that they would need permission an since I have it published elsewhere I can't grant them that so please remove. Most will apologize, say they didn't know and remove it, which is all I really want.

    Whatever you decide, hope it goes well. At least you are credited now.

    They are responsible to remove it from their site when notified.  If they do not wish to you could notify their webmaster/webhost who is likely to be more aware of his/her obligations.

    Wow SirDent yikes you are really getting targetted which is hard to tell if flattering or what hmm I know. There's another forum somewhere going on that posted a link to a tool to locate the domain details of a site. I would try use that if not getting anywhere with first contact sad Hope you have a safe, Happy New Year smile

      They are only copying some of my poems.  I found one that had been copied on facebook probably a dozen times or so.  Others are copied to blogs.
