I see 40 as well. There are 8 itty bitty squares, 18 regular size squares, 9 double size squares, 4 triple size squares, and one large square. 8+18+9+4+1 = 40.

Quickly looking, I see 32 squares. I do not see 36 or 37. Maybe I'm missing something.

Yup you are right, I drew it on paper and counted, there are 40 squares.
