6th Pay Commssion Recommendations for Women Employees and Govt. decisions
75With an objective to ensure more participation of women in the public sector employment and keeping in view the facilities extended to women employees in other countries, the 6th Central Pay Commission has made the following recommendations:
1. Flexibilty in working hours:
- Considering the problem faced by working ladies and their obligation to meet the requirements at the home front, office timing need to be staggered working hours, the Central Pay Commission has recommended women employees to be provided the choice of working either early or late.
- 11 AM to 4 PM will be core hours during which all women employees will necessarily need to be present in the office. The time may be adjusted in case the office follows different work hours.
Govt. decision: not accepted
2. Leave for rearing minor children:
- All women employees having minor children may, therefore, be allowed total leave of upto two years for taking care of upto 2 children whether for rearing the children or looking after any of their needs like examination, sickness, etc.
- Child care leave has been recommendeds to be allowed for the third year as leave not due.
- However, commission ahs opined that no child care leave be given for caring a child who ihas attained the age of eighteen years or more.
4. Maternity leaves:
- The Commission recommends that maternity leave be increased from 135 days at present to 180 days.
- The period of leave which can be availed of in continuation of maternity leave be increased to 2 years instead of one year at present.
Government decision: (September 11, 2008)
- The existing ceiling of 135 days Maternity leaves shall be enhanced to 180 days.
- Leave of the kind dueand admissible (including commuted leave for a period not exceeding 60 days and leave not due) that can be granted in continuation with maternity leave shall be increased to 2 years.
- Child care leave: Upto two years during entire service period for child care like rearing of child, or to meet other needs like sickness, examination etc. of maximum two children (less than 18 years of age) with leave salary in one or more spells. Also allowed for third year as leave not due and may be combined with leave of the kind due and admissible.
- effective from September 1, 2008.
Wmen employees in whose case period of 135 days leave has not expired on said date will be entitled for 180 days Maternity Leaves.
3. Setting up of these day-care-centers:
- The setting up of these day-care-centers/crèches in offices or major residential areas be made mandatory in offices where the employees have pre-school or primary school going children. This will enable male employees also to keep their children in such crèches.
- These crèches could also be run on contributory basis so that appropriate standard of facilities is maintained.

5, Accomodation:
- Government should address residential accomodation issue in all seriousness and either build or lease working women's hostels so that the initial years of service are smooth.

6. Protection of women against domestic violence:
- The provisions of Domestic Violence Act be incorporated in the CCS (Conduct) Rules and violations should call for disciplinary action.
7. Grant of transfer TA:
- For Transfer TA, fifty percent of the transfer grant on transfer be allowed to the spouse transferred later in case the transfer takes place within six months but after 60 days of the transfer of the spouse transferred earlier.
- No such transfer grant shall be admissible in case where both the transfers are ordered within 60 days.
- The existing provisions shall continue in case of transfers after a period of six months or more.
- Other rules precluding transfer grant in case of request transfer or transfer other than on public interest shall continue to apply unchanged in their case.
Current Status:Accepted. As per the Govt. OM dated 23-9-2008, in case of both husband and wife employed, where the transfer takes place within six months, but after 60 days of the of the transfer of the spouse, 50% of the transfer grant on transfer shall be allowed to the spouse transferred later. If both the transfers are within 60 days then no grant will be admissible to the spouse transferred later.
