Basically a medical malpractice case requires that you prove three things.

1. Prove that a medical doctor/nurse made a mistake.
2. Prove that the mistake made you worse (More on this later)
3. Prove that you have actual injury from the mistake.

So the first requirement is that a mistake be made that should not have been made.  It is important to understand that there are risks associated with medical procedures.  Nobody is perfect.  So the mistake has to be one that a reasonable doctor should not have made.

The second requirement is that the mistake made you worse that you otherwise would have been.  So if you had a broken bone and the doctor missed finding it (a mistake) and you need surgery to fix it then you likely do not have a case if you needed surgery all along.  The mistake has to make you worse.

The third requirement is that you have some actual injury from the mistake.  You can't prove a case by saying "I could have been hurt" or "I could have died"
