Is It Illegal To Download Torrents?

A lot of people think downloading torrents is illegal. It isn't. A torrent is just a file type which can contain many things, including creative commons music, film and open-source software. What *is* illegal, is downloading something which is copyright protected -- which includes most movies, software and forms of music.
That said, Copyright Laws for film/music piracy are a bit confusing, which is probably why so many people do it. I myself was rather ignorant of the specific laws until a few days ago when I saw some legislation, and I realized they are actually quite severe in some cases. Severe enough that, I can't see the point in risking prison if some legal entity wants to make an example of you.
Many people think it's not illegal to download, but rather only to upload. What many do not realize, is that sharing (seeding) is a form of uploading. Most people who download torrents will seed them for a time to improve their download speeds. These people presume this is not uploading, so many people are actually uploading without realizing it. The good news is, there is plenty of free stuff out there you can legally download. It might not be everything on your Christmas list, but hey, it's free. Here's a list of a few places you can download from, without worrying that you're breaking some kind of law.

This is a web forum type site that lists lots of free movie torrents. It also lists quite a bit of open source software and royalty-free music downloads. You're bound to find something interesting if you take a look. There are many classic films available now that their copyright has run out, and you can download these without worrying you're breaking some kind of law.

This is another one for movies. Yes, lots of them are B&W and perhaps some you would not be interested in watching if you're younger than, say, 70. But they are free, so no complaining!

Again, similar to those above, but this one is being fancied up at the moment, so it's currently down. It will be back up end of Feb 2008, so check it then and see what goodies you can find.

This is a website with loads of creative commons music files for download. It's provided by the artists, and no one is violating anyone's rights or any laws by downloading the music you find there.

Linux tracker is a great site for people who run the Linux OS on their computers. Lots of software goodies available through this site currently celebrating it's 3rd anniversary.

Neat. It will be very interesting, though, to see the changes to torrent/fileshare over the coming years.
Very interesting. What if you are tricked into downloading something that is copyrighted? What if the item was labeled "creative commons" and was really the latest album from Madonna?
What I've noticed lately is that corporations are the most likely to benefit froom copyright laws. Many companies have no problems stealing copyrighted materials from others. I am thinking of Virgin Airlines stealing that photo from Flickr.

Publicdomaintorrents sounds good. Does this mean I can watch any movie they offer for free? On royalty free sites, are there other charges? Sorry, but I don't know anything about these things.

Nice to see someone telling the truth about torrents. Although to be safer, i ony use torrent sites that are private which you need an invite to join :)
Torrent are great resources but one point to remember - Always scan your downloads with your antivirus & spyware tool to ensure they are risk free before opening / use them.
I would second Gary on this. I did try some torrent downloads quite a while back, when they just became popular, and they were so contaminated with intrusive ads and malware I just gave up on them right away...

i just got a letter in the mail from penteladata.i was using a torrent and they said that i will be fined if i dont delete it.also that i will lose my internet.so i had to cll them and tell them that i took all of it out of my computer.

That is an interesting site. It may depend on if the material is copyrighted. I would think an experience attorney may be best to help. Free legal forums are also good resources like http://www.isitlegalto.com. Any time you are interested in asking that age old question "is it illegal to" haha
Actually, it's not illegal to download a torrent. ANY torrent. There is no law against DOWNLOADING anything. It's UPLOADING that's illegal. You can legally download a full DVD-Ripped movie, and it's not against the law at all. It's sharing it that violates copyright and US law. Unfortunately, torrent programs upload by default and users cannot prevent that - except for BITTHIEF! It downloads torrents without uploading...check it out. Totally legal; you're breaking NO law whatsoever by downloading copyrighted things. Check the US Code, Sections 17 and 18 if you don't believe it.
