Getting Away From a Levy

The IRS can take ownership of your assets, like bank accounts, wages, and property through an IRS levy. They'll take assets needed to settle your tax liability. You will know that you're in trouble if you have gotten notice of an IRS levy.

You can only get the IRS to leave you alone by paying your taxes in full, including accrued penalties and interest that's increasing every day. The sooner you settle, the less likelihood that it will get out of hand.

If you can't settle your tax bill, there are options to get the IRS to release a levy:

  • The statute of limitations expires before the levy is served
  • The IRS is convinced that cancellation of the levy will help them get the tax
  • You have negotiated for an installment
  • Financial hardship will be caused by the levy
  • Part of the assets will be released if the assets seized exceeds the taxes owed
  • Filing for bankruptcy
  • Offer to compromise

Seizure of your assets can be stopped in some ways. They have to be done prior to an IRS levy. You have to make sure that you aren't breaking the law while trying one of these:

  • Transfer assets: sell or give away assets under certain circumstances
  • Prove that the levy is uneconomical: obtaining, storing, and selling the asset will cost the IRS more than what it's worth
  • Asset is vital for you to work: if you need the asset to perform your job or to get to work
  • Keep the existence and locations of assets a secret: for assets located outside the state, country, etc.
  • Store portable assets off home or business premises: cars, boats, recreational vehicles
  • Move bank accounts: a matter of self-protection
  • Rent, do not own your property: cannot seize what you don't own
  • Put money in retirement accounts: discouraged from seizing these
  • Use a safety deposit box: hard time finding these

You have to be proactive in dealing with your IRS problems. It won't ruin your life if you will not let it. Avoid IRS levies, when possible.
