What is ‘slander’?
Slander is a spoken defamation.
What is ‘libel’?
Libel is a written defamation. Generally, radio and television broadcasts that are defamatory are considered to be libel, rather than slander.
Can I sue someone who says or writes something defamatory about me?
In order to prove defamation, you have to be able to prove that what was said or written about you was false. If the information is true, or if you consented to publication of the material, you will not have a case. However, you may bring an defamatory action if the comments are so reprehensible and false that they effect your reputation in the community or cast aspersions on you.
What about insults and epithets? Are they defamatory?
Generally, no. Usually they are seen as outbursts of emotion, with no real substance, except to show intense dislike.
Don't I have a right to express my opinion?
Yes, so long as your statement of opinion is just an opinion, not containing specific facts that can be proved untrue.
Are there defenses to defamation?
Establishing the truth is the single most effective defense that can be offered. If the remark is truthful and it "hurts", is embarrassing, or subjects you to ridicule, there is little you can do. Unfortunately, unless the remark is false, you have no recourse.
What are the defenses to a libel claim?
There are three main defenses to a libel claim (other than asserting that it never happened or that you were never involved):
The first is claiming, and proving, that the statement was privileged (and thus not public). Only certain professions (doctors, lawyers, psychologists), or individuals (chiefly your spouse) can maintain that privilege; and if any non-privileged third party was part of the communication, the privilege is broken. If the defamation improperly accused you of a crime or reflected on your profession, the Court or jury can assess the damages. For other types of defamation you must prove some actual damage to be able to recover.

Maryland High Court Joins Growing Consensus Protecting Anonymous Speech Online

On Friday, the Court of Appeals of Maryland quashed a subpoena seeking the identity of five anonymous commenters and provided guidance to lower courts regarding what showing an aggrieved plaintiff must make before a court will order a website operator to reveal the identity of an anonymous commenter. In Independent Newspapers, Inc. v. Brodie, the Maryland high court concluded that
"a test requiring notice and opportunity to be heard, coupled with a showing of a prima facie case and the application of a balancing test -- such as the standard set forth in Dendrite, 775 A.2d at 760-61 -- most appropriately balances a speaker's consitutional right to anonymous Internet speech with a plaintiff's right to seek judicial redress from defamatory remarks."
With this ruling, Maryland joins the growing consensus among federal and state courts in other jurisdictions that would-be plaintiffs must make at least a substantial legal and factual showing that his/her claim has merit before a court will unmask an anonymous or pseudonymous Internet speaker......

Hubbers - Hubbers - This was my experience with Resolve. I started using Resolve Herpes after I found Resolve's advertisement on the net. I called up and spoke with Dave. He referred me to Ashtree's hub and told me that a number of people there had bought the product and were very pleased with it. He even had a link to Ashtree's hub on Resolve's website. He went on tell me that there was going to be an infomercial on CNN and that the product will be also available in pharmacies very soon. He said that Resolve Herpes was not a suppressant but it was the real thing - A CURE!
He also told me that he ran the business with Marnie, his girlfriend. He said that he had herpes and was able to cure himself with this product. All of this sounded wonderful so I purchased Resolve Herpes soon afterwards. I was excited because Resolve Herpes was going to cure me.
Before I took Resolve - I had no outbreaks, no roaming viruses but I did have crazy itches. I started a journal because I wanted to chart my progress on a day by day basis. Resolve tasted really nasty but I continued to take it. By the end of step one, my monthly cycle began and I noticed some really radical changes. I was bleeding way too heavily and things were happening that should not be. I desperately called up Dave and hinted to him that I was having a lot of gyncelogical problems. He put me on to Marnie, his girlfriend. She told me that she could not give medical advice but the cleansing process is very thorough. She suggested that I stay of Resolve for a few days. I said okay and stopped Resolve. The heavy bleeding stopped shortly after. I continued to take Resolve but noticed that I had very little virus being kicked out as their ad said I should. I compared my symptoms to other users and something was not right. I called up Dave and left several messages but got no response.
Finally, I decided to use Resolve again and experienced the virus attacking. It was throbbing and moving in my body like crazy. My monthly cycle began and this time it was awful. The bleeding was extremely heavy and I was weak! I was also having heart palpitations and could not walk fast. I had to stop and allow my heart to slow down. I had to go the Manhattan and took the train. I nearly passed out because I was losing so much blood. Someone saw me swaying and offered me a seat. Almost unheard off in a New York train. They wait until you are falling or near dead before they give up their seats.
Finally, I was able to move slowly and someone helped me up the subway stairs. I went to my doctor and she asked me what I was taking. I told her and she made me stop immediately. She also made me do complete blood work done. The results were not encouraging. My blood count was really low and my liver enzymes was not great. She insisted that I should not continue Resolve Herpes.
I have not since. After Resolve, I noticed that I had roaming viruses all over my body. I still do not get outbreaks but the viruses was everywhere. I also started to get canker sores.
I have since been building up my immune system by taking mulltiple supplements and I am noticing a reduction in roaming viruses.

Read my blog for my experience. I'm 57 days post resolve...I haven't had any outbreaks since may while I was on it...as long as I keep up on my vitamins I feel great...I do have tingling in the back of my legs where I used to feel pain. I also have HPV and in 4 months the white spots on my cervix have disappeared. Although I don't have a normal pap yet, I'm on my way....I don't know about the herpes...I only had 1 outbreak before I started resolve and a very minor one while I was on it. Karen - Herpes and HPV. That's more than enough! If you are cured by Resolve then great. You will be the first person I have heard that have been cured by Resolve. I have heard people go 7 and 8 months post Resolve and then get outbreaks. But hey, if it works for you - then great! Keep on your supplements. They must be working in a very positive way.
Do some research on isopropyl aclohol and herpes and you will see that it kills the Herpes virus on the skin in about 30 seconds. That is remarkable! So if I feel any creepy crawlies on my skin - I use it and it is far superior to anything else I have used.

RESOLVE IS A SCAM!!!! STAY AWAY FROM RESOLVE! It is dangerous! It contains chlrorine-a known carcinogen. We were used as guinea pigs!
Learn from those of us who have tried it. NOBODY has been cured and NOBODY has received a refund as they claim they will give you if you're not cured. INSTEAD they INSIST on sending you more product, more product, more product...forever. Promising that you will be cured. One person has taken resolve for over a year on this scheme and still has herpes. Others are STILL taking round after round (again almost a year), in desperate hopes- believing Dave, that they will be cured.
To date no one has been cured by using resolve that we know of.
I personally took 1.5 rounds of resolve. I had virtually no obs before using resolve. The rare obs I had consisted of something so small you couldn't see it- virtually painless & never lasting more that two or 3 days. Resolve changed all that! Resolve has physically messed me up. When the jury was in on whether or not resolve worked - which is unanimous -> resolve does NOT work, they said that ONLY Americans--let me clarify, first they said only Americans but later they said that it was ONLY the FEW PEOPLE on the hub that weren't getting cured by resolve. PURE BS! NOBODY from Canada, Asia, Austrailia or the UK was getting cured by resolve either!
If you order resolve you are at their mercy. It took FIVE WEEKS for me to receive resolve. We suspected that to avoid authorities & a trail, they ship the product from US then to New Zealand, then back to US again. That's why it takes forever. When my symptoms got worse after resolve, they sent me round 2. IT TOOK 2.5 weeks to come. Meanwhile, my body was going crazy with H symptoms I'd never experienced before. I had to call my doctor & get a script for valtrex! I took valtrex to counter the effects of resolve.
The shananigans that resolve puts you through is outrageous! Nothing but games & lies. They do not care about the harm they are causing others in their greed for profit. Hello everyone,
My experience on Resolve...well I only had H about 11 weeks when I began the treatment. "Dave" (who is this guy, what are his credentials, and why are we listening to him anyway??) said people who are recently infected should be cured faster. I totally bought into it..
I felt jittery and nervous and cracked out the entire time I was on the treatment. Severe shakes, stomach cramps, headaches, acne, diarrhea, nausea, etc. It was horrible.
I still have H. Dave is a CON ARTIST who has made probably a cool million off of his bogus product. He preys on the desparation of those of us affected by H. No one has been cured by Resolve. Love was the first to test negative, only to have a positive result a couple months later. Fighter has tested negative, but needs to re-test in order to confirm that it's gone. She tested negative back in May, but hasn't gone back for a second test.
I think Resolve some how is able to throw off your blood test results in those who were asymptomatic or had low antibody numbers to begin with. The few tests that do come back negative are only negative temporarily which is enough to set many desperate people into a buying frenzy. Hey, it worked on me.
My advice is to do whatever you feel like doing. We are all in the same boat but trying different things. Despite a lot of negative feedback I still had to try Resolve and see if it could work for me. So if you feel like trying it just to rule it out, then do so. But my whole hearted advice is to save your money, do your research, and do not line the pockets of Dave or Resolve.

To all hurting - Just wanted to give my opinion. The Resolve herpes is for real. I am an immunology specialist in the medical field. Been in it for 21 years. I personally know and work with bio-science people and spoke to a microbiology teacher who is a expert in this field. it is no rocket science as to why the product works. Remember that modern medicine offers band aids to conditions, not really curing anything. Remember that one good reason is that there is no residual $$ in a cure business. I have been working for those companies for over 20 years. Its about return on investments. This product to my knowledge works because Ray Lala has figured out how to get these minerals inside the cell (through an activator) and once it implodes the cell with oxygen and the virus once exposed to the minerals dies and then the dead virus has to be eliminated by the body. That's why it takes time. Be real, antibiotics take time to work and you must use the full dose to not develop resistance. I did the herpes program and I can tell you that I am a completely different person today. i used to spend every day wondering if this is the day I have an outbreak, no more! While I am newly finished the detox and may have transient symptoms, there is no fear of a breakout. Those type of symptoms are gone, Remember the virus probably has been in your body for years and does take time to clear; months. However, after the detox the virus is dead and still being removed from the blood. I can now eat the foods that i could not. I drink coke again! Listen if you are in doubt and want to suck it up and live with the virus go right ahead. I'm sure I've spent over 10k in the last 7 years to help my self with herbal medicine. It helped but virus was always still there. But after spending the dollars and completing the mineral detox, all the bad stuff that affected my daily life is no there. Well I was feeling really sick yesterday so I didnt take the second dose. And it still emits smoke when i mix the shit. Very weird.
At this point in my life, my feeling is "a chance is better than no chance". I will try MMS after this resolve fake mms crap.
TrueCures didnt work for me, as he didnt work for you. DO you remember what that lady's name was that visited Truecures and stayed at that hotel in Utah for 7 days or so. She wrote a blog about it and her experience. Last I remember was that she said she was OB free for a bit but I dunno what happened after?
Anyway, I am as desperate to find a cure as anyone else and this is why I am trying resolve and hopefully I can finish it this week. And hopefully it wont burn a hole in my stomach!
RC2009 - True Cures can help your body for a brief period but he simply cannot cure the virus. If he did then all 14 of us that saw him in NY and even more in Florida will be cured. We are not!
True Cures always post fake testimonials so be very careful of him and his testimonials. Your best bet after Resolve is to try some supplements to build your immune system. Try Lysine, Lecithin, milk thistle, hypericum, Hydrogen perioxide etc. I am having tremendous results from those and more. I too am throwing everything at this virus but I will NEVER EVER use Resolve again. Resolve did more harm than good to me. You need to build up your immune system as soon as you can.

Positive, what I heard is that the immune system does not have any effect on this virus because the virus hides in the spinal ganglia (nerves). So enhancing your immune system would just fight off the attack but not the source of the problem?
My personal opinion is that the only way we can find a cure is for somehow to aggravate the virus so that it leaves the cell the same way it entered it. And while it is leaving, have the immune system or something else zap it during this process. I think this is what Resolve expects to happen. They use the minerals to displace the virus and bring in the fake MMS to clean it up.
I bet the drug companies have/know this shit and maybe when Obama puts in this public healthcare, new drugs will be available. Hopefully.
rc2009 - I am definitely not an expert on the virus but what you heard about the virus hiding is correct. The virus comes out during an outbreak. However, if your immune system is optimized then it will ward off outbreaks much better. Medical science says there is no cure for the herpes virus. I don't believe that but what do I know? I maintain however, if your immune system is optimized then you should have less outbreaks and maybe the virus will eventually become dormant. I don't know about you but dormant also sounds pretty good to me.

You know how radiation therapy for cancer kills off every cell. I wonder if they apply radiation therapy on the spinal ganglia, it would kill the cells but maybe also the infected cells.
You know they are using scientifically modified herpes virus to kill cancer cells in test labs? I bet they can create a modified herpes virus to kill itself. But then who would buy valtrex?
First lets see how long this stays on miss negitves site and buy her own woord Did Not finish Resolve nor drink 1/2 gallon of water per day. Second let me say thank you to the Resolve team for their tremendous support throughout this whole ordeal! I will tell you that even though I felt much better with signs and symptoms 90 days post detox, I still tested positive in March or this year and was disappointed, but after talking to the resolve team and uncovering that the thousands of dollars I wasted on herbal suppressants to burry the virus probably made it more difficult to eradicate. The resolve team immediately shipped the (20 day booster detox) and immune booster. I followed their recommendations to the letter. More viruses came out of my body! I had more clearing symptoms. Resolve told me to get the PCR HSV 1 & 2 and the western Blot Elisa HSV 1& 2 blood tests at 4 to 6 weeks post booster. I think I waited 7 or 8 weeks to be sure. Well I went to my Dr. and she wrote out the script on the orders. As a matter of fact she had to add those tests, as they were not standard protocol on the order form. I went to the lab company and drew the blood. It took a while but I called TODAY and the nurse that answered the phone said that they had gotten the results earlier and the Dr signed off so she could tell me the results. I think they are full of it. And they don't seem to realize that caffeine and citric acid are not minerals!!!
They claim in their FAQ that the formula does not eliminate the virus from the body but rather boosts the immune system forcing the virus out in to the open where the immune system can destroy it. This makes no sense whatsoever being that the virus hides within the nerves where the immune system cannot detect it. And the virus comes out during immune suppression, not immune boosting. This is why people with the virus tend to get the outbreaks when they are stressed since this suppresses the immune system.
As for their claim about the antibody test, this is misleading as well. There are no tests commonly available that can confirm the presence of any virus. If the HSV virus is suppressed by keeping it hidden within the nerves through immune stimulation, antibody levels can drop anyway due to lack of antigenic stimulation. This DOES NOT mean the virus is out of the person's system.
Even if this could work $299 for ingredients that likely don't cost them more than a few dollars is ridiculous. That is preying on people's misfortunes and desperation.

Rc2009 - The person you asked about who had the blog detailing her TC experience.....Well, unfortunately she wasn't cured. Her name is Celissa. She was having what she thought was sciatic pain throughout her "cure" after seeing TC.....but it turned out it really was the virus. It has been a whirlwind few months for me here.
I hear a lot of talk here about different products for herpes. I applaud all you brave people as I have still been too ashamed to talk about it on my health blog.
I am getting over that a bit especially since I have not had an outbreak of any kind in the last six months.
But in all honesty, there are so many health-related concerns that take up a lot of your time and mine too.
I think its important for people living with herpes to remember that only the body can kill any virus, germ, fungus, bacteria or mold that invades it. And in order to do that, your body must be operating at a healthful level.
Some people (with their drugs, lotions and potions) say that you need their product in order to do that. I say that you need a healthy body to get rid of herpes.
My oxygen therapy helped me get my body into a healthful state whereas the herpes virus can not survive. I have no reason to believe that it won't do the exact same thing for you.
So stop jumping on every lotion, potion and snake-oil out there because it is too frustrating and just adds more stress to your body, which gives you more outbreaks. It's time to stop the vicious cycle.
You have my testimony - the ideal situation would be if just one person here will join me on my Oxygen Therapy Program. In a few weeks he or she can also tell you what I just have.

Hey PE: Just for clarity that was a different Canada than me! I have never met TC. Back in February I was shocked by the number of people who dropped their Resolve and MMS protocols to see him when he first appeared on Ashtree's blog. I don't believe in faith healers, but am open enough recognise that each must find their own way. So I watched as so many with so much hope had their dreams of a cure dissolve while that nutcase lambasted them with insults. Unbelievable! But who am I to say.
However I draw the line when that creep starts publishing other people's names on the net against their wishes, as a form of blackmail. What I'd do for 5 minutes alone in a room with the worm! Hell... I wouldn't need that long!

Hubbers - As you may recall, I am taking a protocol that consists of everything under the sun. Well, here is the update -
1. 95% of all itching gone
2. I do have nerve damage (according to my doctor)
3. I still do not get outbreaks (never did)
I have not taken the 2nd round of Ribavirin. There does not seem to be enough viral activity to warrant taking Ribavirin again. To use Ribavrin effectively, you need to wait until the virus is awakened and I don't have that kind of activity. I posted my protocol somewhere on this hub so please check it out.

Justme - In my opinion, Resolve will do everything it can to stay in business because they make so much money from the Resolve product. The product costs almost nothing but they sell it for hundreds. Also, they advertise heavily on the net and advertising costs thousands of dollars a years. Yes, there are numerous complaints from customers who have taken their product and are still not cured. However, Resolve tries to intimidate and quickly nullify any such complaints by threatening lawsuits etc. Their attorneys are based in New Orleans and New Orleans have some different operating laws than other states.
As far as class action suits - anything is possible. But this will be a long run. The questions for Resolve concumers contemplating a class action suit really comes down to the following: -
1. Do you want the expense?
2. Are you in for the long run?
And of course, this fight I will not lead. If someone else wants to do it - I support it

I brought up the idea of a class action suit against resolve a LONG time ago. I think we would win hands down. The problem is finding an attorney. I don't know any, but usually attorneys love class action suits because there's big money in them.

I am taking MMS every hour or so 5 drops but not while i sleep. also taking medavir, which does nothing but was expensive so i am using it..and taking biogetica ..had an OB last week lasted 3 days and another a few days ago lasted 9 hours and this AM another red mark..see what happens...

Hi Kim: Well if nothing else TC has brought us the gift of laughter! I do keep posting on his web page since he posted your info. Every day, or almost everyday, I ask him if he has yet to prove a cure. As a result he constantly attachs PE and me. Must drive him nuts that he doesn't know who I am, so he has no means to blackmail me.
I did read recently that the human body has literally 1000's of abcteria and fungus on it at any one time, and like all things some for good, others not so. I should try to dig that up. Perhaps TC could tell us which fungus his arm tugging cures!
Honest Ernest - Resolve has not cured me or any of my friends and we have the scientific tests to prove it! Where are the hundreds they have cured? Have they magically disappeared or been vanquished to different universe?
Then again, maybe Resolve works in a parallel universe!

I have only 1 question. Where are the people who have been cured by Resolve? This is the internet and NO ONE on whole planet Earth is claiming that Resolve works. How is that possible?
Here is a quest for you. Please go to another planet in the Milky Way system and try to bring back some aliens that can chirp that your product cured them of "The vertigo of Space Travel" or something equally important.

Wow, thank you all so much. i just read this from beginning to end and i was contemplating buying the resolve product. You saved me money and physical pain from what i see. I want to add that the emotional aspect has been difficult and i wonder how much of that adds to the outbreaks. Since i have had a change of heart, meaning a new level of love and respect for myself, i find that my outbreaks have lessoned. I also have been taking lysine for a couple of years now. I have also recently added drinking a lot of water and i feel that keeps my system healthier, i guess that affects the immune, etc. So less emotional stress and better immune= less outbreaks? Can you all list what has worked for you? I'mmtaking notes. I read MMS and biogetica, will research that. What is Ribavirin? Has anyone looked into the energy of sprouted food and an author named Paul Pitchford? He believes you can heal ANY disease by eating the right food and staying away from the wrong ones.
