Does the King Need A Birth Certificate?
I mentioned in a previous posting that Attorney Leo Donofrio was going about breaking down the secrecy concerning Obama's birth certificate. He believes that the birth certificate is a red herring. Now, a few weeks ago, Mr. Donofrio reviewed the Hawaiian states regarding "information" laws and was surprised that Hawaii has a very open and transparent code of laws that is in favor of releasing information to the Public.
Since Dr. Fukino made a Press Release on July 27, 2009,:"“I, Dr. Chiyome Fukino, Director of the Hawai‛i State Department of Health, have seen the original vital records maintained on file by the Hawai‘i State Department of Health verifying Barack Hussein Obama was born in Hawai‘i and is a natural-born American citizen. I have nothing further to add to this statement or my original statement issued in October 2008 over eight months ago.”
Justin Riggs, a fellow blogger, wrote to Janice Okubo asking how Dr. Fukino made that statement. She responded: "Aloha Justin,
The statement was reviewed and approved by our Attorney General Mark Bennett. I am unable to provide further comment."
At that point, Mr. Donofrio did a little research to discover that any informal or formal "opinion" letters regarding the law must be, according to Hawaiian Statute 28-3 :"The attorney general shall file a copy of each opinion with the lieutenant governor, the public archives, the supreme court library, and the legislative reference bureau within three days of the date it is issued. Opinions on file with the lieutenant governor, the public archives, and the supreme court library shall be available for public inspection."
According to Okubo, the AG made an opinion regarding the law, re: the definition of "natural born citizen," so he cannot invoke Attorney-Client privilege.
But that is just what the Deputy Attorney General has just done, trying to make a "secret law." Again, Hawaii has very specific laws regarding this and Donofiro's appeal will go to the Hawaiian Judiciary and the OIP in an expedited fashion. This is just a little bit strange, since AG Bennett tried this stunt last September in Akaku vs. Bennett. trying not to disclose an opinion letter and was instructed by the Judiciary to disclose it, especially "when the existence of the letter and its conclusion has also been made public."
About a month ago, Doug Hadman and Judi McLeod wrote that a source in the media explained that the major networks had been threatened and been told not to talk about the "eligibility issue." Possibly this is what is also happening in Hawaii.
