Many people find that there is a right way and a wrong way of how to file bankruptcy. The reason an individual files for bankruptcy can play a huge role in whether or not their filing is a success.
There are many reasons an individual may file for bankruptcy including credit card bills, medical expenses, spiraling debt, unemployment or martial problems. Many people think that filing for bankruptcy is an easy way to solve these burdens but current laws are very tough and it is not possible to file a case for bankruptcy without having a solid cause and also good back up documentation to support it. There are other alternatives to filing for bankruptcy and this should only be considered as a last resort.
The most important thing to do initially is analyze the circumstances. If an individual is unemployed and living on benefits without any assets, then there is nothing to be gained by filing for bankruptcy.
Before taking the plunge and filing for bankruptcy, one should make sure that all other avenues have been carefully examined and the assistance of a good bankruptcy lawyer has been sought. Many lawyers will not charge a fee for this initial consultation and will be able to recommend the best course of action in relation to the individual circumstances.
There are tests which have to be done in order to satisfy rules for filing for bankruptcy. There needs to be concrete reasons for an application for bankruptcy and there are also factors which could result in an individual being disqualified from filing, such as abuse of certain credit privileges.
A big drawback of filing for bankruptcy is that it may show on a person’s credit record for seven to ten years after the date of discharge. This can make it almost impossible for the individual to obtain any credit. Many people feel that they have no other option but to file for bankruptcy and that being unable to avail of any credit facilities for seven to ten years is a small price to pay for peace of mind. It is important to seek help from a professional to make sure that the decision is in the best possible interests of the individual concerned and that it would not leave them in a worse situation in the long term.
