Who Can Join A Class Action?

I spoke with Cathy MacIvor of the Miami law firm of Maltzman Foreman, PA. Class Counsel following her filing of this class action law suit.

I asked Cathy which pet food companies this class action was filed against. Cathy shared with her press release with me which sites as defendants: (These are the people and companies she has filed the Class Action Law Suit Against)

The reason for the Class Action Lawsuit against these companies:

  • Pet Food Companies and Retailers Made False and Misleading Statements regarding the Contents of Pet Food to American Public
  • "Premium" Pet Food Marketed and Sold as "Complete and Balanced" Contains Euthanized Dogs and Cats, Restaurant Grease, Hair, Hooves, and Diseased Animals, among other inedible garbage

The Defendants deceptive advertising specifically marketed premium healthy food to the American public knowing that they want to buy the best food that they can for their loved one and knowing that the food is at best garbage and at worst a toxic cornucopia of chemicals, additives, diseased meat and pentobarbital from euthanized animals. How does that reconcile with the Defendants claims of that the American public's pets deserve food that is as good as their owners?"

Susan your efforts do not go unnoticed. Great job. I emailed this page and the other class action suit to as many people as I know to try to get everybody involved. We all need to stand together and fight these pet food companies. I hope that everybody that reads these two hubpages of yours do what I did and circulate them to allow people to get involved. If I need a receipt for any pet food purchased to join in I am out of luck, if not I will join the fight. With or without receipts I still think that eveybody needs to band together and do whatever we can to change the pet food industry for the better health and lives of our pets.

You do NOT need receipts. I have already asked about that. Thank you so much, Sherry! I'm joining this class action, myself. Actually, this and the other page you mentioned are the SAME suit. The other page was Cathy MacIvor's press release (goes out tomorrow). She was kind enough to share it with me so I could pass it along to my pet loving readers!

Thanks Susan, I think not needing receipts will make it easier for more of us to join in. I do realize that both of the hubpages are related but I thought a need to e mail both the press release itself and the opportunity to join the class action suit. Besides receiving both of the same suit makes it easier for people to pay attention to them.

I already submitted an email complaint and information to the lawfirm Maltzman and Foreman so that I can become part of the class action lawsuit against the pet food companies.

TO SUSAN PETERS, THANKS FOR THE INFO BUT I TRIED TO PRINT THE "HOW TO JOIN THE PET FOOD CLASS ACTION LAWSUIT 63" AND ONLY GOT THE FIRST PAGE. THE OTHER 4 WERE BLANK! ALSO, "THE CLASS ACTION LAWSUIT FILED AGAINST PET FOOD COMPANIES 77" ARTICLE ALSO PRINTED ONLY THE FIRST PAGE OF 4! WHAT INFORMATION DO YOU NEED TO GET ME ON THE LIST? I WILL SUBMIT IT TO YOU VIA EMAIL OR WHATEVER. My best friends cat was diagnosed with kidney failure a month before recall was stated. The vet checked her cats blood because he had a growth on the back of his leg to be removed to make sure it wasn't cancer. Routine blood work which trhank god she caught. She fed her Tucker the Iams cat food. When she went to file with the class action , she was told that her entry was denied - WHY IS THIS?

The vet put her cat on a hard cat food that is supposed to help try andd reverse the failure, months go by - only time will tell if his remedy is working.

God bless all who have lost there best friend.

Your friend needs to visit with Cathy MacIvor about this. I can't see any reason her claim would be denied. This is what the Class Action is based on. Please have your friend contact Cathy MacIvor, your friend and Cathy can review your friend's claims together.

I really wish people would state the exact brand and selection of foods which any animal was taking that seemed to cause symptoms or death, and the exact brands of food that they are reccommended by the vets instead of saying, "a hard brand" or a IAMS brand. Because our shared info of brands is going to help everyone to have our own discussion and might lean us better in the way of solutions for ourselves. For example, my cat may be on a brand, and show symptoms, yet its not on recall list, if there are 10 others who post symptoms, and simply state, a "soft brand" or Hard brand" what if it is the same brand as my cat is showing symptoms on, or others cats are on, we then cannot add and say our cats ate that too, and therefore warn others in that way using names. Please do not be afraid to state brands and flavors you use. We will not conclude anything. But it is VERY helpful to add to the inner knowlege base of us who are seeking conversation by real situations. It seems people are afraid they cannot name names, but we can state the truth, if our pets ate a brand, state the brand. I think this will help with actual knowlege, otherwise its all sort of anonymous brands and gives me no help. As I have fed my cat lots of different brands, with lots of different symptoms. We lost our beloved cat Timmy two weeks ago two months short of his 9th birthday. He was an indoor cat who had never been sick a day in his life - and he was the joy of our family. On the evening of May 16, he started vomiting. He also emitted a strange smell that was totally unfamiliar. I rushed him to his lifelong vet who diagnosed renal failure and referred him to an animal hospital in West Los Angeles with more sophisticated diagnostic equipment. There it was ascertained that he was in complete renal failure and unable to urinate. Over the next 24 hours, despite a number of emergency interventions, he was still unable to urinate and began developing twitches, unsteadiness and was in great pain. Finally, less than 48 hours after his first symptoms, his condition was deemed hopeless and he was put down. We are devastated by the loss of this lovely, sweet little animal. While we had been feeding him Friskies canned food (prime filets) as well as Temptations (Mars, Inc.) treats all his life, we had recently added some other foods as we had been uneasy about the pet food situation. The other foods we fed him included Goodlife Recipe (meals and treats, Mars, Inc) and Feline Greenies (S&M NuTek). He had been eating the latter foods for about two months before his death. We had an autopsy performed and it showed extensive crystalization in his kidneys consistent with (according to his vet) the kind of poisoning cats are experiencing from tainted cat food.Kathy

Bless your heart! I am so sorry. You have told me the same story as so many other people. As you know just because a pet food hasn't made the recall list doesn't mean that it won't be recalled or that it hasn't caused pet deaths. I added even more products to the recall list today.

Oh, don't forget that June 17 - June 23 is the National Pet Food Boycott. Too many pets have died due to these pet foods and we are standing up to the pet food producers. Feed a jar of baby food if you don't have time to cook. That should hold you over until the boycott has passed.

I don't know what's happened to this but I'd like to add my very late two cents: I've purchased Fancy Feast for many many years and much of the "meat" is rubbery and my cats can't chew it. You can't even pull it apart it's so substandard. It's trash!

I have had two cats so far with inflammatory bowel disease which I attribute to manufactured food. Cats are carnivores not vegetarians!! It's a nice thought to believe cats and dogs can survive by the owners "I don't eat meat" but they cannot! My cats are on raw diets, they look beautiful! I monitor their nutritional status frequently.

Pet food made of entrails, diseased animals, and murdered cats and dogs slowly but surely destroys their digestive systems.

Just think- we feed them slow poison and put poison on them monthly in the form of deadly neurotoxins marketed to kill fleas! Can you say cat lymphoma???

Diamond dog food caused my golden retrievers to have diahrea and vomiting - I was told to switch to Healthwise and after the first two bags am faced with the same results with both dogs. When I stopped the dog food the problem was solved when I started it again the problem began again....I thought it was a digestion issue with Diamond, and got the same results with Healthwise (I was told that Healthwise was better for the digestive system). I have always paid for my dog food with my credit card, so I have proof...and I have always bought my dog food from the same store.
