If The IRS Makes An Error, What Then?
52There is a horror tale that each tax advisor can tell about mistakes made by the IRS on someone's tax record. As a matter of fact, virtually thousands of dollars are included in most IRS errors. The total amounts are quite significant when added up. In the year 1986, it was shown that the IRS basically assessed almost 11.6 million penalties against American taxpayers. This was approximately $2.5 billion. Nearly $890 million of these penalties were dismissed eventually. That's thirty-six percent of the total amount the IRS billed to taxpayers. David R. Burton, United States Chamber of Commerce in Washington's manager of tax policy calculated these figures.
The serving of notices to taxpayers regarding underpaid taxes or late filing to taxpayers is another mistake made by the IRS about 15-20% of the time. This shows that millions of people end up combatting with the IRS for erroneous causes. So what do you do if you receive a notice from the IRS and are aware that it is a mistake?
According to Jo Carole Klepack, a New York tax manager, "The first rule in replying to an IRS notice is not to assume that they are correct." Taxpayers can call the telephone number included on all IRS notices, whether the error is right or incorrect. However, "we found that accomplished very little because when you call, you speak with a clerk who isn't familiar with the case", says Israeloff, Trattner, & Company's Robert Israeloff.
Writing a letter is the best option as most IRS problems are resolved through the mail. Only send copies of your legal documents. So you can verify that the IRS received the package, use a proper courier service or certified mail. Because IRS notices are issued by computers, you will probably get more notices before your problem is resolved.
Paying the IRS a visit to address an agent face to face is best when the error includes a substantial amount of money. This is a much better option than waiting for your letter to be read. It's also ideal to seek tax advice from a professional.
Many people think that visiting an IRS office will initiate them to assess their tax records more. This is incorrect. You'll be bringing the error to their attention, and you may be able to stop the proceedings faster. Any enforcement effort can be frozen immediately.
Though it is a rare situation, some people may also benefit from mistakes made by the IRS. A higher refund than what's entitled might be received. However, it's recommended not cash in these checks as these may lead to more severe IRS problems. Indeed, when handling problems with the IRS, it is recommended to be patient.
