Don't Ask Me: Watch The Tea Party Goers

There are those of us who have read part or all of the proposed House Bill 3200, the so-called Affordable Health Care Choices Act of 2009.

Read it, and I promise you will come to the same conclusion as millions of Americans who are studying this bill.

One such was Michael Connelly of the Freedom Torch blog, a retired constitutional attorney from Texas. Here’s what he said:

“The law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and probably forced participation in abortions by members of the medical profession.”

I’ve found the president and his advisers often use coded messages and that is why they seem to be saying one thing one day and the entirely opposite the next.

For example: On June 15, 2009 President Obama spoke in Chicago before the American Medical Association during their annual meeting. Here’s what he promised:

I know that there are millions of Americans who are content with their health care coverage -- they like their plan and, most importantly, they value their relationship with their doctor. They trust you. And that means that no matter how we reform health care, we will keep this promise to the American people: If you like your doctor, you will be able to keep your doctor, period. (Applause.) If you like your health care plan, you'll be able to keep your health care plan, period. (Applause.) No one will take it away, no matter what. My view is that health care reform should be guided by a simple principle: Fix what's broken and build on what works. And that's what we intend to do.

If Obama’s massive $1.6 trillion overhaul of Health Care sounds like he’s fixing “what’s broken and (building) on what works,” then you don’t read him correctly, or is it that this president has a nasty lying habit?

  2. If you like your health care plan, you will be able to keep it
  3. We will …”fix what is broken and build on what works

None of these statements is true.

I didn’t spend 40 years in the insurance business not to know what must be done to solve the high cost of health care in America. If you want to lower costs so that you can also lower customer premiums – in health care, all taxpayers are customers – you must do two things. Institute a form of tort reform, and fraud and over-use prevention; and raise premiums or reduce coverage.

Obama has started by ignoring tort reform. He wouldn’t dare rankle the plaintiff bar, one of his biggest campaign donor groups. Democrats are seldom for tort reform. They’re in bed with plaintiff attorneys.

That leaves fraud and overuse and reductions in coverage. When you have a doctor-patient relationship as we do today, it sometimes allows a pesky, complaining patient to game the system with repeat visits and unnecessary surgeries. To avoid fraud, a competent insurer would increase co-pays or deductibles to discourage over-use.

When we brought forth No-Fault Auto Insurance in America thirty years ago, we made sure we had tort reform. It wouldn’t work without it, and health care overhaul won’t work without it, either.

For example, we insisted that there be caps on general damages (compensatory damages as opposed to medical bills which are called special damages) for doctors, nurses, hospitals, and other medical practitioners. In many cases that was something like $300,000. That meant that if a doctor did remove the wrong lung or the wrong leg, patients could not sue for several millions of dollars in general damages. Of course they would have all their medical bills paid for and out of pocket for household help, etc.

That has good and bad aspects, of course. But it was one of the ways we got doctors to lower their bills for automobile personal injuries. Carriers called the coverage Personal Injury Protection. In addition, we placed limits on how much doctors could charge for various treatments and modalities. They had to live by the state-mandated fee schedule, just as they do in workers compensation.

It offered doctors protection against costly lawsuits on one hand, and prohibitively high liability rates on the other hand. Before auto no-fault tort reform, in the 1980s there were good doctors retiring early because they couldn’t afford $200,000 to $300,000 insurance policy premiums when their practice brought in less than that.

Today, doctors who treat patients covered by health insurance are in the same bind. They will be forced to continue to charge high fees or leave their practices unless America institutes a fair plan of tort reform, something Obama isn’t even addressing.

Lastly, raising premiums and reducing coverage is just what the government bill is about. If not true, then why does the bill call for rationing of health care for seniors and the disabled?

Obama told the AMA in June (above) patients would be able to keep their doctor, which isn’t true. It can’t be true because unless costs shrink, eventually we will have a single-payer system in America because the government plan will initially under-price all private carriers. When carriers can’t compete, they withdraw from the market. Government will mandate a special list of doctors people will be restricted to use.

The single-payer system (they call it government option to confuse everyone) has been on and off Obama’s table. It’s one of the major obstacles to getting Republican support, that and rationing care for seniors and mandated abortion.

Remember the code? When Obama says something, he often means just the opposite. He must tell some truths or all people would stop believing him, as millions of Americans have done. This is one of the reasons his approval ratings in polls have dropped so dramatically. Americans have lost confidence in what he says.

Sometimes Obama gets lazy and says he doesn’t care if single-payer is in the bill. That’s a diversion and a bald-faced Lie! He cares! It’s at the heart of his program to garner greater executive power and to be able to tell everyone we’re bringing down the cost. But in his speech on September 10, 2009 before the joint session of Congress he said the government option stays. This time he told the truth. There were too many reporters present, too many Republicans there to call him down for lying about it.

Michael Connelly said:

Well, I have done it! I have read the entire text of proposed House Bill 3200: The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise, constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional. What I found was far worse than what I had heard or expected.

Connelly goes on to enumerate four of the ten amendments to the Constitution that the Obama bill breaks, plus damaging the balance of power imperative by giving the executive branch untold powers it doesn’t currently have. Where will Obama get those powers? He will take them away from you and from me!

The Bill will also eventually force private insurance companies out of business and put everyone into a government-run system. Federal bureaucrats would make all decisions about personal health care. Most of these decision makers will not be health-care professionals, but likely will be hacks like the ones ACORN employs. As you know, ACORN has been cited in 14 lawsuits in various states for voter registration fraud.

Just yesterday (Friday), a fourth ACORN employee was exposed for attempting to cheat the IRS of tax revenues by giving an undercover person advice on how the bring in 13 illegal alien girls to join a proposed prostitution scheme. ACORN employees were filmed and recorded while committing many unlawful acts such as conspiracy to defraud the government, conspiracy to aid and abet those who would be involved in trafficking in prostitution by minors, and more.

These people were fired, and at the same time The U.S. Census Bureau severed all ties with ACORN.

If you recall, Barak Obama was ACORN’s attorney while living in Chicago area. Some say he taught them all they know about election fraud and other illegal criminal activity such as harassment of people at businesses and at the homes of business owners who disagreed with ACORN’s tactics or refused to do business with them.

These things are scary, but they are only the tip of the iceberg.

When you study the bill, you find that this isn’t about health care at all. It’s about aggregating more power to the executive branch.

This legislation really has no intention of providing affordable health care choices. Instead, as Connelly says, “It is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred, or even been contemplated.”

Major portions of the Constitution of the United States will effectively have been destroyed if this bill is enacted. The first thing to go will be the masterfully crafted balance of power between the Executive, Legislative, and Judicial branches of the U.S. Government.

Each of us must pull together to save our Constitution. One man, or one million men, cannot do it alone. In numbers and unity there is strength. The recent Tea Parties across this great nation on 9/12 proves we care about our nation. We will prevail, but it won’t be easy.
