Although the process of foreclosure is different in every state, there are some basic steps that all states have in common. Before you can stop the precess of foreclosure you need to learn everything you can about the process. What you don't know can hurt you. The more you understand the better you will be armed to deal with your challenge.

Your payment probably due on the first has been missed. Most banks will give you a grace period of about 15 days so no fees are assessed.

If you haven't paid by the 15th or 16th of the month there will be a late fee assessed. The amount will depend on how large your original mortgage is. You can expect phone calls to begin from the mortgage lender.

If you haven't paid your mortgage 30 days past the due date, you are in default. The phone calls from the lender begin to increase. When you reach day number 45 or 60, you will get a demand letter. It will state that you have 30 days to cure your arrears.

Although the phone calls will increase from the lender they still have laws that they must abide.They can only call you during certain hours and they can not threaten you. Expect a default notice by Certified Mail. It will inform you of late fees and collection costs that are your responsibility.

No later than 90 days the courthouse is notified by a local attorney. The attorney will also have a notice run in the the local newspaper.

Although this process sounds very final there are still things you can do to stop the foreclosure process along the way. There are ways to stop the foreclosure process without it costing you excessive legal fees. Don't try to wish it away.
