Pharmacist shoots, kills, holdup man goes to jail

Lets see, i think i got this right, read it on two different sources. A man working as a druggist in a pharmacy in texas, working with two female co-workers is confronted by two ski mask wearing thugs, one with a gun. He pulls out his own gun, shoots one in the head, and chases the other out of the store. He then goes back inside, gets another gun and puts five more bullets into the would be crooks stomach. so far so good. Nice shooting Tex. Saved the day and kept him and his co-workers alive. Not so fast. The druggist was then arrested for murder. Seems his sin was the secong go round of shots. I'd say he was justified in ensuring the threat no longer existed. the sheriffs dept, the local NAACP and the holdup mans momma all say it is murder. The poor guy is now out on $100,000 bail that someone had to put up for him. The momma says "He didn't have to shoot my boy like that".. How about he shouldn't have been comitting an armed robbery? Did she ever teach him that? No word on the other suspect that got away, but I'm sure the video camera's caught a good look at him and despite the mask he will be found. This is going to be an interesting case. What if a good defense lawyer can prove the first shot to the head was fatal? And he was more than justified in firing that first shot. Does he then get let loose? Or does he then get charged with desecrating a dead body for the follow on shots. Anyone who has ever been involved in a shooting situation will tell you once it starts the adreneline is flowing like a fire hose, and your only immediate concern is to make the threat go away. But i'm sure the NAACP and the momma will not let it go so easily. You just know there is a lawsuit in there somewhere, and the lawyers are probably lining up as we speak. We had a discussion on one of the other hubs about an armed citizenry, and how statistically they stop crime. This man needs to be let go, and society can be happy one less miscreant is roaming the streets. But life in the good old USA doesn't go that way anymore. They will turn this criminal into a victim and let the protests begin.

thinking- my prediction is that the DA will end up dropping all charges. Why? Just like you said. The adrenaline flows and he had to make sure he was REALLY out of danger. The pharmacist had been shot in the hand. He had no way of knowing he was out of danger, no way of knowing that the perp on the ground didn't have a concealed weapon. He was fully justified.
Also, the DA is totally out of line with murder 1. Murder 1 is premeditated. My guess is he's just trying to make a political point.
And one last thing - the judge let the pharmacist out on bail but refused to let him be armed, thereby opening him up for retaliation without any means of self defense. Even the DA argued that he should be allowed the use of a gun under the circumstances, but the judge was a real hard-a$$ bitch.
So much for justice and compassion from the bench.
thanks madame X, good info. when the govt decides to come after you, they don't stop. I hope this guy gets off quick, before the court costs bankrupt him.
Differing opinions is what make this stuff so great. I can see your point, but i can also understand the mans fear. I would think one more in the head would have sufficed, but under the circumstances( It's why cops often fire multiple clips in a fire fight) I'd say his fear just took over. thanks for reading.

I like you, Thinking, but I can't really agree with you on this one. Nothing wrong with him firing the first shot and hey, maybe even a second if the guy kept moving! 5 more shots after having a chance to change guns sounds, to me, like overkill. He should be tried but I don't think it should be 1st degree murder.
