Hurricane Ike Claims Settlements

You've received your insurance settlement, or you have received nothing at all, because your claim was denied. That's the end of it, right? Wrong. Most states allow you to reopen your property insurance claim within a defined period of time. And, an insurance claim can be reopened for any type of property damage or property loss.

You generally have up to 1 or 2 years to reopen your claim. However this depends often upon both the State law and your particular Property Insurance Policy contract language. Of course, State law controls; but oftentimes the State law may be (as an example) something like Texas, which basically says:

“The Statute of Limitations for Property Claims is up to 4 years, but can not be less than 2 years.”

Then, most Insurance Companies use that to their advantage (other than “NFIP” [flood] and put a clause or paragraph in their contracts which states that the limit is 2 years, not 4.

But you've received a settlement check; “AND THAT’S THAT”. Right? WRONG. It is not true that receiving a settlement necessarily ends the case. Even if you've received a settlement check and have cashed it.
