Today I read an article by The Washington Post on how the supreme court ruled that convicts do not have the right to use DNA testing to prove their innocent, once they are convicted
When I read the article I was floored. How can a convict be keep from defending himself and appealing his case. Several cases have been over turned because of the DNA testing.
There appears to many places the state laws limit this testing too.
I guess I just do not understand. If I was wrongly accused and found guilty of crime which I did not do. And after the trial, new evidence appeared, and through DNA testing, it would prove my innocent, I would be pissed to the max.
I agree that convicts should lose rights, but a right to defense is not one of them. I am no legal expert, but this sound wrong to me.

That can't be! DNA testing has made incredible strides in proving both guilt and innocence. If courts can use it to convict, they have to allow it to "unconvict." I didn't read the article, but if this is true, it's friggin' outrageous and 180 degrees opposite what our American justice system is supposed to be about.
It is sad to say but there alot of guilty people on death row that would jump at an appeal or a stay. Becuase of this any case that involves dna would be open up for argument. The court system will be crowded with appeals with and teh convict is guilty anyway, just buying some time and fresh air.
This seems like a great opportunity for the DA's to make sure that they have the prime conviction rate. Overturn's and appeals decrease their salaries and job future's. Typical politics.
I didn't know that, that's crazy.
It's about money....the state has to pay them if they are found innocent.

The other thing in the story is that even when the convict offered to by for it themselves. Money is money, but rights are rights. Think of all of the money to keep them in jail. I like the sound of this.

Maybe, after a convict is said to be guilty, the crime scene will have gone cold and no reliable DNA evidence would be found.
I have also been told that crime shows have greatly exaggerated the reliability of DNA tests.
