Texas Workman's Compensation is administered by an agency called The Texas Department of Insurance, Division of Workers’ Compensation, or TDI for short.

The agency adjusts annually the compensation benefits and changes are effective October of every year.

The State of Texas’ Workers’ Compensation is elective without any waivers.

The mandatory coverage is covered under Title 25 of the State statutes, regarding “carriers” and their particular type of fund.

There are no workers' compensation exemptions for employers with smaller amounts of employees.

The state allows employers to have workers’ compensation insurance through private carriers or self-insurance but does not allow insurance through groups of employers.

Texas workman's compensation insurance covers ranch or farm workers that are migrant workers or are seasonal workers as well as workers employed by and employer with a specific minimum gross annual payroll except for ranch or farm workers that are employees of independent contractors. The employer covers domestic employees voluntarily.

The benefits for Temporary Total Disability are calculated at 70% of the worker’s wages over $8.50 an hour and 75% for workers under that amount. The weekly minimum benefit paid is $112 with the maximum amount of $750.

The maximum duration for payments is 104 weeks or unless worker reaches medical improvement. The 104-week duration may be extended if the worker requires spinal surgery.

The Permanent Total Disability has the same payment calculations with the duration of the benefit payout to be for the duration of the life listed in the statute constituting PTD or 401 weeks maximum.

The benefits for Permanent Partial Disability are that same benefit payment amounts with the maximum amount of $525 for 401 weeks and the total payment amount of $210,525.

The negative effects on the employer from any Texas Worker’s Compensation claim include increased premiums based on the number of claims of the prior year.

The fact any employee can be hurt with performing their daily duties at work creates a risk for employers having higher worker’s compensation premiums. The unforeseen increases make it difficult for many businesses to have a budget or forecast for possible improvements to their businesses.

Employers are responsible for the actions of the employees during work hours. If an employee is being careless and has an accident, the employer feels the results of the employee’s carelessness financially by increased worker’s compensation premiums the following year.

To resolve the issues of employee work related accidents involving Texas Workman's Compensation claims, employers can take preventive actions. One of the actions to be used for prevention is to provide safety equipment to all employees for the various job duties that could cause personal harm at work. The equipment includes protective eye wear, back braces, and gloves.

Place all hazardous materials and chemicals in safe zones that are marked with hazardous plaques. Require employees to wear steel-toed shoes or boots for protection of the feet.

Have Safety Policies and Procedures to educate all employees on the company’s safety requirements and policies. The education will help reduce the work related injuries and accidents as well as workers' compensation fraud which leads to increased Texas Worker’s Compensation claims and premiums.
