What's Inside the Pelosi Health Care Bill?
Dear Friend:
Yesterday, Speaker Pelosi introduced her health care bill (H.R. 3962) and I introduced a Republican alternative (H.R. 3970). I believe we should pass some key reforms and reject others because they will harm our health care and our economy. Here are the reforms that I am backing:
1.The Medical Rights Act: Prevent the government from interfering with the decisions that you and your doctor have made about you and your family’s care.
2.Eliminating waste, fraud and abuse: Save billions in improper fraudulent payments.
3.Reducing Expensive Defensive Medicine: Lawsuit reform and fully electronic medical records to avoid duplicate tests and procedures.
4.Lowering Insurance Costs: Give Americans the right to buy insurance from any state in the union; provide tax breaks to individuals buying their own insurance; and innovation programs to eliminate pre-existing conditions.
These reforms were all included in the bill I just introduced, H.R. 3970, the Medical Rights and Reform Act.
Speaker Pelosi introduced her own bill, H.R. 3962, a 1,990-page bill that raises taxes, cuts Medicare and creates a new government health care entitlement that will increase the deficit. Our initial reading of the bill provides some key details. I wanted you to have these details as soon as they were available:
H.R. 3962, the Pelosi Health Care Bill:
Page 94—Section 202(c) prohibits the sale of private individual health insurance policies, beginning in 2013, forcing individuals to purchase coverage through the federal government;
Page 211—Section 321 establishes a new government-run health plan that, according to non-partisan actuaries, would cause as many as 114 million Americans to lose their existing coverage;
Page 225—Section 330 permits—but does not require—Members of Congress to enroll in government-run health care;
Page 255—Section 345 does not include a requirement to verify applicants’ identity, thus encouraging identity fraud for undocumented immigrants and others wishing to receive taxpayer-subsidized health benefits;
Page 297—Section 501 imposes a 2.5 percent tax on all individuals who do not purchase “bureaucrat-approved” health insurance—the tax would apply on individuals with incomes under $250,000, thus breaking a central promise of then-Senator Obama’s presidential campaign;
Page 313—Section 512 imposes an 8 percent “tax on jobs” for firms that cannot afford to purchase “bureaucrat-approved” health coverage; according to an analysis by Harvard Professor Kate Baicker, such a tax would place millions “at substantial risk of unemployment”— with minority workers losing their jobs at twice the rate of their white counterparts;
Page 336—Section 551 imposes additional job-killing taxes, in the form of a half-trillion dollar “surcharge,” more than half of which will hit small businesses; according to a model developed by President Obama’s senior economic advisor, such taxes could cost up to 5.5 million jobs;
Page 520—Section 1161 cuts more than $150 billion from Medicare Advantage plans, potentially jeopardizing millions of seniors’ existing coverage;
Page 733—Section 1401 establishes a new Center for Comparative Effectiveness Research; the bill includes no provisions preventing the government-run health plan from using such research to deny access to life-saving treatments on cost grounds, similar to Britain’s National Health Service, which denies patient treatments costing more than £35,000;
Page 1174— Section 1802(b) includes provisions entitled “TAXES ON CERTAIN INSURANCE POLICIES” to fund comparative effectiveness research, breaking Speaker Pelosi’s promise that “We will not be taxing [health] benefits in any bill that passes the House,” and the President’s promise not to raise taxes on families with incomes under $250,000.
Well, this says it all. I don't think I can improve on it.

Madame X:---I went to my congressman's website the other day and looked briefly at a copy of H. R. 3962 and, subsequently, gave up around page 56. Naturally, the bill is saturated with legalese. It's hopeless! The Democrat's seem to have a financial death wish for the country. Everything that one hears about future legislation ( not only Pelosi's bill ) is that all of it requires huge tax increases. We all know, too, that past legislation over the years has, virtually without exception, had their costs estimated far too low at the beginning. Do these people in the federal government hate this country so much that they would enjoy crippling its economy? It's not an absurd question any longer. Unemployment is stuck and won't improve for years. State and local governments are either broke or are headed in that direction. Yet, anything that one hears about any forthcoming legislation of any type is that it will require major tax increases. Even George Soros, Obama's darling, won't be able to afford the coming stifling taxation. Soros, however, won't have to worry as long as the politicians protect him and his ilk. You and I will have to worry!

I began reading the bill last night. While its a laborous read, I was able to get through a few hundred pages. Based on what I read so far, I can predict the following....
First the point of this plan is to "phase out" private insurance. Its a point blank lie, when they tell you that you can keep what you have. Once more and more people are on the government plan the following rhetoric will spew from the mouth's of congress: We didn't expect for it to grow so fast. We only expected to increase competition. Apparently Americans have spoken and they like the governments plan better! Now, unfortunately that will mean a tax hike! Does BOHICA mean anything to anyone?LOL Great hub, keep writing.
Terrific informative hub. Bottom line.. this bill is a nightmare and it will mean the end of quality and available health care in this country. It's only a matter of time. This bill has nothing to do with the welfare of the citizens, it has everything to do with passing something so that Obama and the Dems can place their mark on society.
You are right when you say some in the fed govt hate this country - they hate the freedom real Americans stand for and so they are trying to tax us into poverty so that we MUST rely upon the govt for our well-being. And when we give up and do that, we will have communism. This is their grand plan and I find myself getting disgusted with those who refuse to look at it for what it is. Just look at some of the forum posts! Ok, it's one thing to want change from the past admin - Bush wasn't any sort of paragon and did he own damage to our freedoms - but Obama is the end of America as we know it and the feds are charging gleefully along with delusions of grandeur.
No - this bill has nothing to do with healthcare and everything to do with destroying us from within.
But there is hope! There are some who are fighting this monstrosity and the best we can do is give them our support.
So --- that's my little speech for now :)

I think health reform is too big for these idiots to get their arms around. $900 billion in ten years for 5 years of coverage. That is 1.8 trillion when placed on a 5 year bases, or $360 billion per year on a year to year bases. What are they doing?

Thanks Madame X..... the politicians have done it again, another great event in partisan politics. They keep telling me its for my own good, so why does my butt hurt so much?
James - none of us can really sit down these days :) Did you know that the republicans tried to enter 11 amendments to this bill that required all govt employees to be covered under the same bill and 11 times it was rejected by Pelosi and her gang? Then, Obama was speaking to a group and said "why won't you get behind this and work together for everyone. This isn't for me, I've already got my healthcare - this is for you." Such a caring and concerned guy. Thanks for your enjoyable input :)

Since you already have ample input rightfully snarling over the Democratic Debacle, I'll point my comment toward the Republican version as highlighted above:
1. Okay. Sounds good.
2. Okay. Sounds good.
3. Lawsuit reform is particularly needed. I spent 12 years as a commercial insurance underwriter with experience in judging doctors, nurses, dentists, and hospitals for their suitability as clients of my company. In 1970, a General Surgeon could be fully insured for one year for professional liability at a premium of $5,000, give or take. Now that same surgeon may not even be able to afford to practice at all--more of them "go bare" than you'd ever guess. Malpractice is one thing, and it does happen, but limitations on lawsuits MUST be implemented.
4. This portion is so good it's astounding that politicians could produce it without somebody self-combusting. Buy from any state? Wow! Tax breaks for buying your own? WOW!
Okay, back to snarling...in particular about PUS. Oh, the acronym? That stands for PERVERTED Uncle Sammy, the dirty minded uncle that thinks forcing me to buy health insurance is a really, really exciting idea...
Ghost - I always love hearing from those who have had first-hand experience on the inside, so I really appreciate your comments on tort reform. And yes, I completely agree that we desperately need it. Reid said that it would "only save $54 billion" so why bother adding that since it's "only a drop in the bucket"! Is he mad? No, he's bought and paid for by trial attorneys. And yeah, #4 is the really big one - there is a reason why the slimebags in DC don't want this. Can you guess? It's too easy! It would solve too many problems too fast and help everybody.
This isn't about healthcare. Anyone who doesn't get that now is not paying attention, and some aren't paying attention on purpose so they can continue to tow the party line. . . . sigh. . .
