Isn't This Called "Double Jeopardy, Jackie Musto Carroll?!"

I am so appalled at how many more people are being found to be corrupt in Luzerne County. It makes me wonder if maybe the FBI should also be looking into the District Attorney's office. I thought offices like this were supposed to look out for victims, not persecute them further. How dare the District Attorney of Luzerne County try to get all of our juveniles who have already suffered enough under the erroneous rule of ex-Judge Mark Ciavarella to be re-tried by Judge Arthur Grimm. Hasn't she ever heard of "Double Jeopardy?" According the the Constitution of the United States of America, double jeopardy is prohibited by the Fifth Amendment. So either, she doesn't know her Constitution or she is just willing to ignore it. Or.......could it be something else? Like......maybe she is protecting someone? Believe me, nothing surprises me in this case about the Corrupt Judges of Luzerne County anymore. According to "word.netweb.princeton.edu/perl/webwn, the actual definition of Double Jeopardy is "the prosecution of a defendant for a criminal offense for which he/she has already been tried; prohibited in the fifth amendment to the United States Constitution."  First, you have children who's rights have been taken away by being denied the right of representation and now the DA wants to further deny their rights by implementing Double Jeopardy. Talk about slapping more people in the face! Believe it or not, that is breaking the law, Ms. Musto-Carroll.

I guess you are wondering why I am so interested in what is going on in Luzerne County, right? I am the mother of one of Mark Ciavarella's victims....you know....the supposed "kids-for-cash scheme that he keeps denying. My daughter was a rape victim, with emotional problems before she was locked up in Pa. Child Care and then sentenced to Vision Quest. Her rights were violated in so many ways. First, she was locked up instead of having received some kind of counseling for her rape. Yes, several weeks after the rape, she did go to school drunk and she was forced into quitting that school and going to another. That is how we found out about the rape and why she was sent to Pa. Child Care to await sentencing before Mark Ciavarella. When we found out about her first hearing, my husband and I decided to sneak into the judge's office and try to speak to him to let him know what had happened to her. Would you like to know what the judge told us after we informed him about her rape? His exact words were, "It doesn't matter, she has to be punished for what SHE did. And do not bring it up in my court room!" Nice thing to say to the parents of a rape victim, isn't it? I think that if I had been raped and was emotionally traumatized, I would have gotten drunk too! At that hearing, he remanded her back to Pa. Child Care to await psychological testing. We were assured that when the testing was done, we would be notified of when the next hearing would be, so we could be there. Meanwhile, while we were waiting to hear from them, the dorms at Pa. Child Care were switched around. My daughter's room was switched with a girl who had Hepititas B. New toothbrushes were supposed to be put into each room and somehow they weren't. My daughter used what she though was a new toothbrush and later found out it wasn't. For weeks we tried to get her tested and kept butting our heads up against a brick wall. Finally, after a few weeks, they tested her. She was told to get tested every couple of months, just to be on the safe side. So far so good. Now, about the next hearing.....Guess what? We never found out about the next hearing until it was already over with and the probation officer for Vision Quest called us to let us know that my daughter was on her way to Vision Quest, some 3-4 hours away. I forgot to mention that my husband and I, both have back injuries, so this distance was a great hardship on us physically. I thought I was gonna have a heart attack. I started screaming and crying. Myhusband was in the cellar at the time and literally flew up the steps to find out what was going on. He started yelling and screaming. My child had to appear in court all by herself, because the court had failed to notify us of the hearing at all!! We got in the car and went down to Penn Place in Wilkes-Barre, Pa to confront the probation officer. Needless to say, we were not and still aren't popular down there. We were told that she could have another hearing, but it would in all likelihood have the same results. In the end, after almost 3 yrs of "Failing to Adjust", becoming suicidal, and learning a lot of ignorant manners from being locked up she is now out. It took newspaper stories, Senators, and a lot of hard fighting to get her out. She has very low self esteem now, her education is so lacking since the educational system in those places are very substandard, and she cannot concentrate at all. I will never forget or forgive what that judge allowed to happen to her. There are so many other things, that I just cannot tell right now without her permission, that I wish I could tell. I am very resentful. He didn't just destroy her life with his greed, he destroyed ours too. My family almost fell apart. We lost so much, that we will never ever be able to recover. I would just like to see him suffer just as much as we did. And now, the DA wants her retried.......I think she is nuts. My family has suffered enough. I admit, I helped vote her into office, but believe me, next time, I will vote for anyone but her, if she continues with this witch hunt against these already overly punished juveniles!!!!!
