Having to file for bankruptcy is a serious business, why would anyone consider embarking on this course of action without a reputable bankruptcy lawyer; specialist attorneys in this field can make the process much less painful than it already is! Owing to the recent changes in the law, filing for bankruptcy preparation does take a little longer but an attorney can complete the process much more quickly and efficiently. This part of the process can be frustrating for many debtors with financial worries, but once your attorney has finished this initial section of the application, you can move forward without further hindrance.

Fortunately, the United States bankruptcy protection code provides certain exemptions for people who are filing for bankruptcy when it comes to the disposal of property. It is unlikely that your home or vehicle will be at risk. Work clothes, tools and other essential items like furniture are also exempt, as a bankrupt still needs a place to live and a way to travel to work.

Of course, some States have made additions to the federal law and this is where your bankruptcy lawyer will be of more assistance if you want to retain the possessions to which you are entitled. The fact is that the vast majority of individuals filing for bankruptcy are not wealthy. They do not own large value items or have money hidden away. It is important that what they do have is protected from their creditors as much as possible.

You may have heard that bankruptcy stays in your credit history file for ten years and whilst that is true, it's not the whole story. This is not the problem that it may at first appear as most of the scoring for your credit is taken from the more recent credit transactions. What this means is that within a relatively short space of time after you become bankrupt you will start receiving credit applications but at this stage you must be very careful.

Your bankruptcy lawyer will tell you to be wary of these offers at this time as many companies specialize in approaching these types of cases and offer loans at extortionate interest rates or conditions. Such credit could put you back in the position you were before. Your attorney will be able to advise you on reputable companies but whatever your credit agreements are, you will do your credit rating a great deal of good if you ensure that you always pay more than the minimum required.

Whilst you continue to maintain and rebuild your credit record you may find that in less than four years your good credit record will have been re-established. That said, your bankruptcy will still be on your record but will probably not be used to prevent the purchase of a new home or an unsecured loan.

The credit industry would love for you to believe that only waster's become bankrupt. This attitude just makes ordinary people reluctant to file for insolvency when they need to and creates an unsympathetic attitude toward those who do. After the recent changes, the government may decide to make it even harder to qualify for bankruptcy if this type of approach by credit companies continues. Don't be fooled though, because your bankruptcy lawyer will tell you that most people that file for bankruptcy protection have just been unlucky and never had any intention of this happening.
