How to withdraw your provident fund or PF in India?

It has been 15 days since I left my organization. How I can withdraw my provident fund?

I recently withdrew my provident fund from the Wazirpur Office in New Delhi, India.

Here are some simple steps on how to withdraw your provident fund, which I have learned through my own experience.

· You can withdraw your provident fund after 60 days of your leaving the organization.

· In most cases, employer's HR Department gets the form filled up by the employee who has left the service and gets it dully attested and stamped and signed by the employee and the Managing Director or whoever is designated to sign the PF form. Then, HR people send a person to submit the application. In this case, there is very less work done by the employee and he/she is to just wait for the PF to come in his/her account.

· But in other cases, employees have to fill the application form on their own. Employees purchase a form from outside and get it signed and stamped from the employer and then submit for withdrawal.

· The most important things, which you have to be absolutely sure about, are reviewing your name, father's name, bank account number, bank name with full address of the bank, and some details written by your employer's HR Department on the form.

· Always crosscheck all the details before submitting the form because even a single detail, which is not matched, can lead to rejection of your application. One of my colleagues got rejected because there was no address of bank in the specified column and then it takes another 45 days long process to submit the application.

· Please always remember to take a photocopy of your PF application form with you. It will really help you out in case of a rejection.

· According to EPFO guidelines, it takes around 30 days to receive your money in your account but it is not true, even my money came after 45 days. Some candidates receive their money even after 60 days.

· There is a long queue at the PF office and it takes around 4 to 5 hours in the queue before the person on the counter will submit your application and give you the receipt.

· You can check the status of your claim online after 10 days of submitting your application. Just log on to google, write "epf" in the search column, click the first link epfo and you will be taken to the EPFO home page, then check for a button by the name of "KNOW YOUR CLAIM STATUS" click on the button and you will be taken to another page. On that web page, select your city for example "Delhi", press tab, select PF branch office where your PF is submitted for example "Delhi (North) Wazirpur, then enter your establishment code for example 12345, then insert extension code if any, and then employee number. Hit the button, GET CLAIM STATUS and you will directed to a page - Form 19 is Under Process. Your Claim is received on 14/01/2009 and is being processed. Kindly Try after 30 days from Submission. Form 10C is Under Process. Your Claim was received on 14/01/2009 and is being processed. Kindly Try after 30 days from Submission.

· In some cases, if it is not updated on the PF server, then it will show, "Your Claim Not Received By This Office".

So these were some simple steps for withdrawing your PF. In my case, I found "Your Claim Not Received By This Office" even after I received my money in my account. I do not know why but it was really serious for me when I was checking it online on a weekly basis before I got all the money in my account.

Besides these steps, there are some cases where an employee gets in a dispute with previous employer like leaving the service without notice and in this case, some employers do not sign up the PF form. For help in these type of cases, please visit this very good forum of right to information india website

Yes Kmadhav some of my friends and colleagues from previous organizations have waited for around 3 months to get their PF in their account after leaving the organization and there was one person I remember who got his PF in 5 months so waiting for 5 odd months is really debilitating and stressful. If you will go through this website http://www.rtiindia.org and http://www.citehr.com, you will get a lot of information on people who have been waiting for many many months.

Hi Pratibha,

Number one is that you have not told me that your PF account number in which your money is deposited is the same for both employers, previous Mumbai and latest Bangalore employer and if yes you do not need to attest the form from your previous employer but if they both are separate and you have two PF accounts, then for the previous account, you can send your Mumbai employer the PF application form to get stampted and signed and also remember to ask them to fill in details in the form of the money they submitted in your PF account as it is very important. When they will send you back the application fully attested with all details, you can submit the application in your PF branch office for withdrawal.

For the new employer, if you are not working over there anymore, I have explained the steps in my article above.

If there is any dispute and the previous or new employer are not agreeing to sign it up, you can visit this very good forum for further help and instructions: http://www.rtiindia.org/

For me, it took exactly 45 days after submitting my PF claim form. For some of my colleauges from the previous organization it even took 50 days and some got cleared within 30 days... It all depends on them...

You will not be taxed on anything if you are talking about your provident fund rather you will get rebate for submitting PF. PF is calculated on the basis of 8% interest per year that means if you have 10000 INR in your account after one year comletion it will be 10800 INR.

Hi

I had a querry wrt my PF.I had downloaded the two forms required, sent it across to my HR but after a month came to know that it cnt be sent for processing since the PF dept in mum(Head Office-Pantaloon Retail India ltd) accepts only original forms & not downloaded..dont knw hw correct this is.

Also where in delhi can i submiot my PF form & wd i be required to get sumthing signed from my previous employer.

soni2006 profile image

soni2006  says:

Sakshi if your PF office is located in Mumbai, you cannot withdraw PF from a Delhi office. I really cannot believe that mumbai head office is refusing the downloaded form. How that can be? Then why they have uploaded the online forms and why they started this system. Sakshi regarding this, you can file an RTI application but that you can do later. It also might be possible that your employer is telling a lie. Seriously sometimes these HR people do like this. I am been through all these hassles that's why I am saying this.

But I am really confused as to your last statment, "Also where in delhi can i submiot my PF form & wd i be required to get sumthing signed from my previous employer."

Please tell me first what is your PF number, give me the whole number and I will assist you.

One more thing, you can submit your PF application with or without geting it signed from your employer. The procedure after signing I have listed in my hub above, read it properly and for without signs of employer, you can get your signature attested by a bank manager or a public notary and can submit the application to your PF Office.

or visit this link: http://www.rtiindia.org/forum/19466-how-withdraw-p

If ex-employer not ready to cooperate, you can get your signature attested by: 1.Manager of a bank. 2.By any gazetted officer. 3.Member of the Central Board of Trustees./ committee/ Regional Committee (Employees' Provident Fund Organization). 4.Magistrate/ Post/ Sub Post Master/ President of Village Panchayat/ Notary Public. You might be having saving bank a/c (if with nationalized bank). you can get your signature attested by the manager of the same.

Hii thanx for replying..wat i wanted to knw was the PF forms are routed by the HR to MUmbai since the Head officde is there so I had a queery as to whether is it possible to submit the form in delhi since i am in dubai & wd only b visiting delhi & not mumbai anytime soon.

Also should i mail my HeadHR North zone on the same--as to whether downloaded forms are accpetable or not.

Also is there any change in the PF form interms of color???

Hi,

I left my company two months back and i submitted my pf withdrawl form after sixty days from time of leaving.

Now HR people are saying that il be getting my PF next year

July as they will submit annual statements by next year only.

I left job by May-20-2009 and wht they say is il be gettin my pf amount only by july 2010. Is this a thing that actually happen as 1 year is a huge gap is what i feel

soni2006 profile image

soni2006  says:

No they are misguiding you Ranjith. Do not fall prey to them. Just go ahead and ask them if they have submitted their annual statements last year or not. If not, then they will be in serious problem. It is not like that that you have to wait for July 2010 when they will submit their next year's annual statements. Also, they can also use their monthly statements if they do not have annual statements.

Do one thing: Ask them that why they are not submitting their monthly PF returns??? It is illegal I think.

If they do not solve your problem and are refusing to sign and stamp your form contact, your areas PF commissioner via http://www.epfindia.com site.

Philip  says:

Hello Soni,

I left my previous organisation almost 8 months ago. However I have been misled constantly by the Finance Manager about my queries on the PF. Now he refuses to give me the Form 3A which is required by my present employer to get the PF amount transferred to the new PF account. I have two queries:

1.) Is the previous employer not legally obliged to provide the Form 3A ? If he is required to do so what is the supporting law or act ?

2.) Since my previous employer is uncooperative I do not expect him to sign or fill up any forms. So I have decided to withdraw the money in my previous PF account. Please advise on what forms I need to fill up and whose attestation I would need instead of my previous employer ? Also should I personally submit the forms at the PF Office and are any other documents required to be submitted alongwith it ?

3.) Is the employee not legally empowered to file a withdrawal 60 days from resigning ? In my case I resigned as of 31 December 2008. After 60 days when I called the PF office I was told the PF account no. given to me by my former employer does not exist. When I called the person responsible at the company he said the company would file returns only by April 25 and I will only be able to withdraw money after that. So this is almost 4 months after my resignation. Is this legal ?

Appreciate your help.

Thanks,

soni2006 profile image

soni2006  says:

It is totally illegal Philip.

You are eligible for withdrawal of your PF after 60 days of leaving the organization.

Regarding your two questions:

1.) Is the previous employer not legally obliged to provide the Form 3A ? If he is required to do so what is the supporting law or act?

my answer: Yes your previous employer is legally obliged to provide you all the details and forms of your PF account. I do not know what is the law for that but why to go for such a long thing when you have a short route, just go ahead and write a letter to the RPFC in this regards and send them a filled out form no. 19 and 10c without your previous employer's signature and please download form 19 and 10C from EPFO website and you can fill the details. You can also get them attested by any notary public or a gazetted officer. Submit both these forms to your regional employees provident fund organization or EPFO. Them you will get the PF settlement from them. Employer's signatures are not mandatory in all cases.

My answer: Please follow my answer for question no.1 for question no.2

3.) Is the employee not legally empowered to file a withdrawal 60 days from resigning ? In my case I resigned as of 31 December 2008. After 60 days when I called the PF office I was told the PF account no. given to me by my former employer does not exist. When I called the person responsible at the company he said the company would file returns only by April 25 and I will only be able to withdraw money after that. So this is almost 4 months after my resignation. Is this legal ?

my answer: IF the company is not providing PF number, then first find out from the company that have they paid all their dues till date. If they say yes, then place your final request to the HR department, even then if do not get a reply, then go to the PF office for directly raising a complaint with the PRO and explain the status on your PF claim and the person will definitely help you.

Best of luck.

Thanks for the information.

My new company is providing the PF facility now I have new PF account number.

Please tell the detailed procedure for:

1) the transfer of old PF to new PF account.

2) the withdrawl of old PF account.

Also do tell me which would be the easier transfer or withdrawl?

Transfer is most easiest thing to do as it only involves giving your old PF account number to the new company and they will submit all your PF deductions to that old account but Anuj in your case, withdrawal of your previous PF account's money is the option left for you because as you have said you have already applied for a new account and both the old and new accounts cannot be merged if you are thinking to do that.

For withdrawal of your old PF account, just read this article and the following comments as all the information is already written over here...

Hello, I'm working in India (foreigner) for an American based company. We have just been told that we have to pay into PF as a condition of employment. I have checked with other foreign companies (American based) and their not involved in this process.

1. Do these companies risk fines for no compliance?

2. Is this correct, do I have to pay into this to work in India?

3. At ternmination of employment are there any additional difficulties withdrawing the money not being based in India?

4. Is there history of people not getting their money when paperwork is submitted correctly.

Yes it is possible to withdraw PF from a company where you resigned before six months and can submit the form for that but you will only get the PF amount submitted and not the pension amount.

@Mann Singh, see bro, it is not written anywhere in the books that if your employer has stopped submitting your PF for some months, you cannot withdraw your previous balance because it is your money. The thing is that your employer must have submitted his and your part of money in your PF account, leave alone the two months so my advice is to fill up the form, get it attested by some bank manager or designated officers I have listed above, and submit the PF form in the same PF office where your PF account belongs to and your employer has submitted the funds. Regarding submitting PF forms, attesting them without employer's signature, read this article in detail and you will find answers to each and every question you have in your mind. Go ahead and withdraw your PF. Best of luck.

@Sam, as I have told to Mann Singh, the same things apply to you plus one thing is for sure that you have to submit your PF form in the same office where you are holding your PF account. Up until now for withdrawing PF in India, there is no provision for submitting PF forms in any other office other than the office in which your employer and you have the accounts, so you have to submit your form in Hyderabad. Best of luck to you too.

You have very less time left as you have to go to Australia so it would be better to request your employers or contact PF commissioner ASAP to avoid delay.

But one more favor if you can let me know how to withdraw this PF amount as my ex-employer says that i cant withdraw the PF if i am not completing 6 months of the tenure. Around 5 or 6 years back, I worked in one company for 5 months and withdrew my PF and there were no issues but I got just a small amount of money.

Why don't you opt for a transfer of your PF amount as the money if you have in your account would be really less and it is better to accumulate more and get interest on all the amount and then withdraw.

No dear not at all, there is no requirement of a blank check plus do not give it to anyone. How it can be possible? Please check with the PF commissioner or PF department in your immediately regarding this demand by your previous company. I am sure that there is no requirement of a blank check.

Yes you will getting the interest and you can withdraw your PF when you come to India but I do not know for how many years, your money will be entitled for interest. Please check with the PF department.

Sometimes it takes more than 45 days to get your PF amount in your account. If it is more than 45 days as in your case, kindly contact your PF branch office.

I did not recieve any pay slips in both the cases and as such i dont know my PF a/c no for both. I have the appointment letters of both the company's in which the salary breakuo mentioning the PF contribition is mentioned. Kindly Advice

Deepak, you need to contact your company, HBL Global & Solutions Integrated Marketing Services, for getting your PF number as there is no other system to tell you your PF number like that. If you have written record of your PF deductions as mentioned in your payslips, your previous company has no right to deny you of your PF account number. Contact your company ASAP. Get the PF number, get your PF form filled and attested by your previous employer and submit the form at your regional PF office for PF withdrawal.

Hi Amaresh Saha, kindly check with your regional PF office or the PF commissioner regarding your money. The PF government service has changed its rules and has got better in serving answers to PF related complaints.
