Call 1-877-773-8196 That's the number on the settlement card you received in the mail. It's an automated line where you can leave your name and address and they will mail you a packet of materials including the claim form. You should receive it in 7 to 10 days.

Dave 6 years ago

This lawnmowerclass.com is a hoax. I've tried to access it at various times (day and evening) for several weeks. I've NEVER successfully loaded the main page.

Either pure BS, or the most poorly constructed web page in history.

Lori 6 years ago

Danny Ray 6 years ago

I agree eith the others, why can't we file a claim? Are they in hopes we will forget, I don't think so!

Mary 6 years ago

Like others I was unable to file online or DL a claim form (due to programming errors on the website). I called the 877 number almost 4 wks. ago and rec'd. nothing. Rust Consulting is listed on the security certificate for the website, so yesterday I emailed them explaining the problem. They replied that some people have had problems with the website, but most have not. They were very helpful and sent me a claim form in a pdf. file.

I am still trying to get the claim form - hopefully when I call the 800 number, they will mail it. Why publish this if the form is NOT attached or included? What a waste of time.

a.d. 6 years ago

I CALLED (877)773-8196. GAVE MY PHONE #. CLAIM FORM IS BEING SENT. I ALSO CALLED SEARS, WHERE I BOUGHT MY MOWER IN 2002. THEY WERE ABLE TO LOOK ME UP AND GAVE ME EVERY PIECE OF INFO THAT I NEEDED FOR MY CLAIM FORM, INCLUDING THE EXACT DATE, (MONTH, DAY & YEAR), THAT I BOUGHT IT; MAKE; MODEL #; HORSEPOWER; WHO MADE IT AND ETC.. YOU SHOULD CHECK WITH WHO YOU BOUGHT IT FROM. THEY VERY WELL MAY HAVE YOUR INFORMATION AS WELL. OH, BY THE WAY, SEARS KNEW ALL ABOUT THE CLASS ACTION AS WELL. EVEN WHY IT WAS DONE. PERHAPS THEY CAN HELP YOU AS WELL.

HOPE YOU ALL CAN GET ALL THE HELP THAT YOU NEED. NO, I'M NOT WORKING FOR ANYONE. I, TOO, AM FILING A CLAIM AS WELL. DID YOU RECEIVE A POSTCARD IN THE MAIL AS I DID? JUST CURIOUS. A.D.

Maureen 6 years ago

I've been trying for weeks to access the claim form on line with no success. I then called the 877 number to request a form in the mail and they never sent it. That was 2 months ago!! Is this suit for real? I think they're delaying so that no one will be able to meet the deadline. Who are the lawyers we can contact to get our $35?

bob 6 years ago

forms are easily to get online..I have gone to the web site numerous times and always had access to download a form or just register online. I printed a few forms I could give you, but I do not want to publish my email address on this site, sorry! keep trying..as getting this form online for me is sooooo easy!

To those having issues downloading the .PDF claim form, make sure to use Internet Explorer. Other browsers have trouble displaying the page correctly due to poor web development.

The link to the claim form is on the homepage in the solid blue area where it says TO FILE ONLINE OR DOWNLOAD, CLICK HERE.

Settlement Update - Thursday, August 05, 2010

The Court conducted the Final Approval Hearing on June 22, 2010. The Court took the Settlements and the request for attorneys’ fees and expenses under advisement and will issue a ruling in the near future. Please keep in mind that no distributions (cash payments or warranty certificates) can be made to Class Members until the Court issues its rulings and any appeals are resolved. Please be patient.

John 6 years ago

Can't find Claim form to print and submit. If you had the form on line it would have been much easier and inexpensive for all of us.

Bill 6 years ago

Looks like you can keep my money. There are no numbers on mower and Sears is no help. I think the settlement is B S.

Settlement Update - Thursday, August 19, 2010

On August 16, 2010, Judge Adelman granted Plaintiffs’ motion for final approval of the settlements with all defendants. Please keep in mind that appeals may be filed and no distributions (cash payments or warranty certificates) can be made until any and all appeals are resolved.

bob 6 years ago

On August 16, 2010 Judge Adelman issued an opinion and order that finally approved the Settlement as well as separate orders that finally approved the settlements of all defendants. Judge Adelman's opinion and order found all settlements to be in good faith and dismissed the claims of all class members with prejudice. On August 23, 2010 several class members filed a Notice of Appeal of Judge Adelman's final approval orders to the United States Court of Appeals for the Seventh Circuit. Under the terms of the Settlement, the balance of settlement funds will not be due, and the one-year warranty extension program will not begin, until after all appeals from Judge Adelman's order finally approving the Settlement are resolved.

Leroy Laskowski 6 years ago

I submitted claims on two mowers on 4/23/10 but have not received any response. I would tend to believe that someone would at least be assigning claim numbers and would have made me aware of the ones assigned to my claims.

Unless the whole thing is bogus.

don 6 years ago

Where is the claim form? There so much other advertisment and lawyers trying every angle to pull you their direction with some "side" deal, typical lawyer behavior. Shame on you!

bob 6 years ago

Read the fine print about the award. It states UP TO, it did not say she or anyone else definitely would receive $75 as owner of a rider lawnmower. By the time the lawyers divide their take there may be nothing left. Why are people so greedy?

Well, did anyone else looking for a gift from Heaven bother to read the FINAL APPROVAL AND DECISION ORDER dated August 16, 2010?

Page 5 states that after all costs the actual payout for walk behinds may be $10-$15 dollars and $23-$28 for riding lawn mowers.

As of June 10, 2010 there were 1,058,693 filings (claims)

There is a $65 million cash fund for payout

Attorneys will receive $576,391.19 for costs and $34,666,667 plus interest for fees

Each class representative will receive a $1,000.00 service award and there are 132 class representatives.

Copy or click on this link to open the document http://bit.ly/8ZNIgJ

....Regarding actual payout–yes, as with any class action lawsuit, the final number of claimants will determine actual payout. Given the numbers to date, it looks like the claimants will be sharing a pool of about $29M, give or take. You have to realize that part of the class action is about the settlement payout, and part of it is about what the class action is about to begin with–false advertising. The greater “win” here is that proper labeling will be ensured going forward (and btw, if you’re concerned about cost, the new reg’s that’ll require these mowers to be more “green” will add more cost per unit than the change to hp labeling will–I’ve heard the argument that this class action will add to the cost to manufacture the mowers–well, look real hard at what other changes happen with mowers going forward before you try to make that argument). So yes, will claimants receive less than they may have originally anticipated? Yes. But also, that point was made in the initial proposed settlement document–as it is with every class action. At least claimants will be getting something in the form of payout in addition to the extended warranty coverage.

Is the Attorney being paid for the number of Claimers or is He being paid for the number of those unable to file?

The Lawn Mower ID is impossible to find, and Why isn't the Serial Number, Model Number, Manufacturer, and Type of Lawn Mower Enough? Surely the Attorney and the Guilty Party knows the Lawn Mower ID is placed in an impossible location. Especially on the Walk-Behind Mowers. But to everyone, keep on looking. I have 4 mowers. I found two of the ID Numbers. But I see the serial, model, manufacturer, and type of mower clearly on each of them. P.S. I wonder why the website isn't User Friendly? Has someone hacked into the friendly side and made it stubborn or angry? Who can help???

Settlement Update - Monday, October 25, 2010

The August 31, 2010 deadline for filing claims for the cash benefit has passed. You can continue to file claims for the warranty relief benefit for up to one year after final approval of the Settlement.

On August 16, 2010, Judge Adelman granted Plaintiffs’ motion for final approval of the settlements with all defendants. Please keep in mind that appeals may be filed and no distributions (cash payments or warranty certificates) can be made until any and all appeals are resolved. Please check back on December 31, 2010 for additional updates as to any appeals or the date of cash and warranty distributions (if no appeals are filed).
