    Doesn't sound like earmarks. It appears the people from the state of Arizona has filed a claim against the Federal Government. In fact it sounds like the Senator is representing his constituency well. He appears to have successfully negotiated a settlement. Note the quote from the article:

    "Kyl's office insists the measure is not an earmark, and the House didn't deem it one when it considered a version earlier this year."

    Earlier this year the "House was in the Democrat hands" Technically still is.....
