Does my wife have a claim?
My wife has been turned down for unemployment even though at least 8 others who left the same time she did have been receiving it since March of this year. The factory offered the same buyouts so they could reduce their work force. The factory stated they have not contested the claim.

The fact that eight others in the same situation as your wife are receiving benefits is an indication that she may be eligible and that the agency's determination in her case was in error. I would have to know more about the facts of her case to express an opinion on her eligibility. In Michigan appeals don't cost anything, and the unemployment agency pays for representation for her at a hearing before an administrative law judge. The Michigan UIA is swamped and errors in determinations are not unusual. The fact that the employer is not opposing her eligibility is helpful, but only the unemployment agency can rule on eligibility for benefits. She should continue to certify until her case is resolved and her appeal should be timely.

The guestion might be she has fallen through the crack at the unemployment office..she should start again there...make an appointment and discuss her claim in person with an employee . If the store fired or layed her off, she should have a claim. Sometimes you just have to go and check your claim was filed properly..
