    Can a judge in a court room legally ask the nationality of your name?

    In visiting traffic court yesterday, the young lady before me had a difficult name to say. The judge asked what nationality is that? She replied German she believed. The name is no consequence, it sounded Polish to me.

    My Grandmother sat down with me when I was small and attempted to teach me the nationality of names. I of course rebelled loudly. My Grandfather supported me and the conversation was forever ended.

    Should this be a legal question? I just saw a college is asking about being gay. I believe we need to revamp our laws and eliminate these questions and tracking completely.

    They can ask you anything pertaining to the case at hand.

    The answer to this varies from legal system to legal system. Assuming the most legal systems of the world have some common aspects, a judge does then have the right to ask the origins of your name. Remember a name is also a legally registered entity and judges in most courts in most countries have the right to ask questions related to the identity of the person to as a judge would say "firmly establish the facts". If to establish the facts of a case the judge needs to ask the nationality of a persons name, this would not be regarded as unlawful as long as the question relates directly to the case being answered and not to any outside issue.
