Firearms Ownership in America

Updated on April 29, 2015

Second Amendment/Right To ArmsThe Constitution, Bill of Rights, and Firearms Ownership in America

To understand the true meaning of the Second Amendment, it is important to understand the men who wrote and ratified it, and the issues they faced in creating the Constitution. During the debate over the ratification of the Constitution, there was significant concern that a strong federal government would trample on the individual rights of citizens--as had happened under British rule. To protect the basic rights of Americans--rights which each person possesses and that are guaranteed, but not granted, by any government--the framers added the first ten amendments to the Constitution as a package. Those amendments have come to be known as the Bill of Rights. They represent the fundamental freedoms that are at the heart of our society, including freedom of speech, freedom of religion and the right of the people to keep and bear arms.

INDIVIDUAL RIGHTS

Second Amendment

The Founding Fathers created the Bill of Rights to protect the rights of individuals. The freedoms of religion, speech, association, and the rest all refer to individual liberties. The Second Amendment right to keep and bear arms is no different. When the first Congress penned the Second Amendment in 1789, it took the wording, with some style changes, from a list of rights introduced by James Madison of Virginia. Congressman Madison had promised the Virginia ratifying convention that he would sponsor a Bill of Rights if the Constitution were ratified. The amendments he wrote would not change anything in the original Constitution. Madison repeatedly insisted that nothing in the original Constitution empowered the federal government to infringe on the rights of the people, specifically including the right of individuals to have guns.

The only reason there is a controversy about the Second Amendment is that on this subject many highly vocal and influential 21st Century Americans reject what seemed elementary common sense--and basic principle--to our Founding Fathers. The words of the founders make clear they believed the individual right to own firearms was very important:

Thomas Jefferson said, "No free man shall be debarred the use of arms."

Patrick Henry said, "The great object is, that every man be armed."

Richard Henry Lee wrote that, "to preserve liberty it is essential that the whole body of people always possess arms."

Thomas Paine noted, "[A]rms . . . discourage and keep the invader and the plunderer in awe, and preserve order in the world as well as property."

Samuel Adams warned that: "The said Constitution be never construed to authorize Congress to infringe the just liberty of the press, or the rights of conscience; or to prevent the people of the United States, who are peaceable citizens, from keeping their own arms."

Another Great Reason for the Second Amendment...

FIREARMS REFRESHER COURSE

Firearms Refresher Course

FIREARMS REFRESHER COURSE

1. "Those who hammer their firearms into plows will plow for those who do not." ~Thomas Jefferson

2. Those who trade liberty for security have neither. ~John Adams

3. Free men do not ask permission to bear arms.

4. An armed man is a citizen. An unarmed man is a subject.

5. Only a government that is afraid of its citizens tries to control them.

6. Firearms control is not about firearms; it's about control.

7. You only have the rights you are willing to FIGHT for.

8. Know GUNS, know peace, know safety. No GUNS, no peace, no safety.

9. You don't SHOOT to k i l l ; you SHOOT to stay alive.

10. Assault is a behavior, not a device.

11. 64,999,987 legal firearms owners killed no one yesterday.

12. The United States Constitution (c) 1791. All Rights Reserved.

13. The Second Amendment is in place in case the politicians ignore the others!

14. What part of 'shall not be infringed' do you NOT understand?

15. Firearms have only two enemies; rust and politicians.

16. When you remove the people's right to bear arms, you create SLAVES.

17. The American Revolution would never have happened with GUN control.

GUN SAFES

IF you own firearms and keep them you must also keep them safe from the hands of your young children and keep the ammo also in a good safe in case of a unintended fire. No one would want to be hit by a stray bullet from ammo not being stored properly. I would not wish anyone harm because of my actions of not storing my firearms and ammunition in a safe place. Get yourself a good gun safe that also has ample room for your ammo. You are still in control of your firearms and ammo and at the same time you are keeping them from the hands of your children and visitors and even burglars who would use them for the wrong reason. BE SAFE. Get a SAFE.

Right To Keep and Bear Arms - Government fears a well regulated Militia

Yes folks, I carry my gun where ever I go. Not to go out to kill people but to protect myself. I live in the Mountains of Western North Carolina and my handgun and/or long gun is used not only for hunting but for protection. Many times I've ran up on a snake ready to strike and had to kill it. Many times while out camping in the wilderness a bear could easily be turned away just by shooting the gun in a safe old stump nearby or a tree if I had to. Most times the bear or other wild animal would leave me alone. The other reason is to protect myself from those who would do me harm or others in robberies and the like. Those that would break the law using guns hate those of us who carry guns for our protection and other citizens. Even in today's society with cell phones and the like the police could not or probably would not arrive in time to prevent the unlawful person from doing their evil deed. So the next time you see a hunter dressed in orange walking home or happen to see a person with a gun on in a public place do not panic and call the police unless you know without a doubt they are doing something illegal. I value life as do other gun owners to much to just go out and kill even those who are breaking the law. We can disarm them much easier and save someones life by stopping the illegal person much easier and holding them until the proper authorities arrive. You should be more alarmed about military presence in your community with guns especially when you are not near any military base. That my friends is how our government is trying to disarm the American citizen - with fear. The Second Amendment to the Constitution of the United States of America is written for a purpose. Without that right you are no longer a citizen but a lost lamb with the government being the wolves. Remember that and study up on your history of America and your constitutional rights.

I was taught from an early age that guns of any type were a TOOL as well as a means for defense. As a tool my guns were used to help provide meat on the table and I was also taught a very valuable lesson to never take more game than you needed to ensure the survival of our friendly critters in the wild. I also remember when game lands were protected and patrolled by a Forest Ranger or Game Land Ranger who would check hunter's hunting and fishing license and inspect what the individual hunter/fisherman had taken to consume. I was very fortunate in learning to respect the importance of keeping our forests and game continual survival not only for the forest and species of wildlife and plants and how they provide for We The People a most natural way to keep us alive. All the time throughout my life, even today, I wish our ancestors had listened more to the Native American Indians who respected the balance of Nature completely. Today, in the 21st century we have raped the land and depleted our natural resources to the point that Mother Earth cannot cleanse the air which we breathe or the land which we labor to grow our food without chemicals which really are NOT helpful in the short or long run. Many diseases today can be contributed to our destroying our forests, land and wildlife. If we do not take action today to reverse this America will soon become a uninhabitable wasteland. That said...Let's get back to our Right to Keep and Bear Arms. More on Mother Nature in another blog to be posted soon. Leave your blurb and scroll on down for more and more info - Lots more.....

@anonymous: Your right about that, having only one firearm you need it handy all the time but when you leave home and don't intend on needing it, it would be safe to use a safe to keep it out of reach or use by unauthorized intruders or children who happen to be around. Here in North Carolina it is an open carry state and I would not get a concealed permit if it was offered for free as it only gives the government a record of who owns a gun of any sort.

Gun safes are a good idea if you own multiple guns, for me they are impractical though. I own one gun and its close by at all times. I don't want to lock it up, it wouldn't do me much good if it took 2 minutes to get to.

@WriterJanis2: When I first wrote the lens I forgot to include the safes and was reminded by a good reader. I keep my guns locked in their special safe boxes and put away from prying eyes and not easily found by an intruder either. Can never be too careful in today's society. Things have changed in the last 50 years for sure.

I learned as a child to shoot a 22 and my 4 daughters were taught by my husband (also a Veteran) to shoot, clean and respect guns at an early age. We have always had guns in the house and I was never worried because we all learned to respect weapons. Knowledge is a good thing.

@dc64 lm: I grew up and hunting put meat on the table so you can put me up their with you. I love all kinds of wild meat. Never took more than I needed and always tried to keep mother nature in balance. I agree, home gardens and wild meat is healthier than drive-through and most grocery stores now. Thanks for the comment and like.

My father and 6 uncles are all avid hunters. I've eaten more deer meat, squirrel, rabbit, and whatever else was served for dinner than anyone else I know, except other relatives. Today, I live nest door to my father, and my mom still brings me ground deer meat whenever I want it. The other stuff...YUCK! I didn't even like it as a child, but it was food, and healthier than anything you can get from a drive-through window.

@reasonablerobby: Hope your never in the line of fire in Shottingham. You have tried out some great guns. The 45 was standard issue in the military when I was in. As for the machine guns, I've had enough of them also while in service. Most of what I have now is for hunting and personal defense. My State is an open carry State and I exercise the right to carry. Just never know when it may be needed to prevent a crime while the police are 6 miles away. Thanks for the like and wonderful comments.

As Brit this is really interesting. The only time I've been near a gun was in a gun shop in Las Vegas. I tried out a 9mm a 45 - woah! and a Heckler and Koch machine gun. Never been in the military so this quite an experience for me. I live in Nottingham which even without gun laws has a lot of guns on the street. So much so its nickname is Shottingham!

@CanadaREVIEW: I am familiar with the regulations and laws of Canada and agree with you that folks should have the same rights as the Second Amendment of the US has especially the further North you might live. As for the bears you might, with all of your resources, contact the local Wildlife Commission and they should put out food for all the wild critters due to the lack of natural food this year. If you get no response please E-mail me and I will contact National agencies to help your wildlife creatures that are in need. I majored in Forestry and Wildlife Management and have a lot of contacts still today. If the bears are coming in that means the Moose are scarce and Fish also for an unknown reason. Keep me informed and thanks for the comments on my lens.

In Canada we do not have the right to bare arms, it is a privilege we must ask for and then pay annually in order to have arms. Also in Canada if someone tries to kill you and you protect yourself the attacker has the right to charge you as well. A couple of years ago a fellow was attacked and eaten by a bear near my mothers home, perhaps if someone would have had a rifle hat person could have survived. The food sources for bears are minimal this year so they are entering into the towns and cities as well as cottages on the hunt for food, I fear it is just a matter of time before another death or a number of deaths occur.

Great points. I heard a pretty moving talk by Jesse Ventura on this. Poor guy is probably getting some flack now. He said the 2nd amendment sure wasn't in order to go hunting. I believe I heard this from him but not sure, I heard that one of the only countries that has never been invaded is Switzerland, where every household has a machine gun.

I have no problem at all about people having guns for hunting or to protect themselves from wildlife, but it shouldn't be necessary to carry certain types of gun, for example automatic weapons that ought to be for military use alone.

The final actions on this treaty will be in late 2012 which most folks will not foresee. Our actions today will determine America's freedom and tomorrow's future. Second Amendment Under Fire Every Month

Every day since Saturday, September 10th, 2011 at 12:45 PM

Washington, DC --(Ammoland.com)- Within the next month, Congress will be taking actions that will impact our Second Amendment rights.

Here’s what we’re facing. On or about September 30, Congress will consider a “continuing resolution” (CR) to fund the government from October 1, 2011 to September 30, 2012.

Well, you can be sure about this — when it comes to funding the government, any bill passed by Congress will NOT be neutral on the Second Amendment:

Either the CR will fund the anti-gun ObamaCare program … or it will explicitly prohibit ObamaCare from being funded.

Either it will fund ATF’s illegal efforts to register multiple sales of long guns in the southwest … or it will explicitly prohibit those activities from being funded.

Either it will fund the Obama administration’s illegal efforts to block the importation of shotguns and rifles … or it will explicitly prohibit these bans from being funded.

Either it will fund negotiations at the United Nations to produce a small arms treaty that will license firearms, ban semi-autos, and ban tiny modifications of firearms … or it will explicitly prohibit those negotiations.

Barack Obama can veto the CR. If he does so, his wretched administration will be shut down.

But the House of Representatives also has a veto, as it can refuse to send an anti-gun CR to the Senate.

So the message is that Congress needs to reject any CR which:

    Does not defund ObamaCare;

    Does not defund the illegal multiples sales regs;

    Does not defund the illegal shotgun and rifle import bans;

Does not defund the UN negotiations to license American gun owners.

We can tell you right now that there will be some congressmen who will say: “Sure, I voted to fund ObamaCare. But that doesn’t mean I support ObamaCare.”

    That is a lie.

There are congressmen who will say: “Sure, I voted to fund the registration of long guns. But that doesn’t mean I support the registration of long guns.”

    That is a lie.

There are some who will say: “Sure, I voted to fund the bans on importing shotguns and rifles. But that doesn’t mean I support those import bans.”

    That is a lie.

And there are some who will say: “Sure, I voted to fund UN negotiations to register gun owners. But that doesn’t mean I support gun registration.”

    That is a lie.

ACTION: Contact your congressman. Tell him to stake out a position early and publicly that he will oppose any CR which does not defund ObamaCare, the illegal long gun multiple sales regs, the illegal shotgun and rifle bans, and the UN negotiations to produce a treaty which will register American gun owners.

    DID YOU KNOW THIS?

    Equal for all

On his inauguration, President Obama will be protected by the Secret Service, 11,500 soldiers and 4,000 Police Officers.

They have armor and automatic weapons.

No One is assigned to protect my family.

    Shreveport, Louisiana

    Never covered on mainstream media

In June, 2009, the National Association for Gun Rights first broke this incredible tale out of Shreveport, Louisiana.

At the time, no other gun rights organization had touched the story. But when we tracked down the victim for an interview, we couldn't believe what we heard, and we immediately sent out a nationwide alert.

    The story went viral overnight.

If this tale of government abuse moves you, send it to a friend or family member to get the word out.

Welcome to Shreveport: Your rights are now suspended.

According to Cedric Glover, mayor of Shreveport, Louisiana, his cops "have a power that [. . .] the President of these Unites States does not have": His cops can take away your rights.

And would you like to guess which rights he has in mind?

Just ask Shreveport resident Robert Baillio, who got pulled over for having two pro-gun bumper stickers on the back of his truck -- and had his gun confiscated.

While the officer who pulled him over says Baillio failed to use his turn signal, the only questions he had for Baillio concerned guns: Whether he had a gun, where the gun was, and if he was a member of a pro-gun organization.

No requests for a driver's licence, proof of insurance, or vehicle registration -- and no discussion of a turn signal.

Accordingly, Baillio told the officer the truth, which led the police officer to search his car without permission and confiscate his gun.

However, not only does Louisiana law allow residents to drive with loaded weapons in their vehicles, but Mr. Baillio possessed a concealed carry license!

What does such behavior demonstrate, other than transparent political profiling -- going so far as to use the infamous Department of Homeland Security report on "Americans of a rightwing persuasion" as a how-to guidebook, no less?

Mr. Baillio made no secret of his political affiliations: An American flag centers a wide flourish of pro-freedom stickers and decals on his back windshield.

In fact, when Baillio asked the officer if everyone he pulls over gets the same treatment, the officer said no and pointed to the back of his truck.

Baillio phoned Mayor Glover to complain about this "suspension of rights" only to find that his city's morbidly obese "commander in chief" was elated at the story: According to Glover, Baillio got "served well, protected well, and even got a consideration that maybe [he] should not have gotten."

Thankfully, Mr. Baillio recorded a good bit of that phone call. You can watch a video with the transcriptions here. I've reproduced a chunk of the call below:

Baillio: (in the context of being asked about the presence of a gun) Well, I answered that question honestly, and he disarmed me.

Glover: Which would be an appropriate and proper action, sir. The fact that you gave the correct answer -- it simply means that you did what it is you were supposed to have done, and that is to give that weapon to the police officer so he could appropriately place it in a place where it would not be a threat to you, to him, or to anyone in the general public.

    [. . .]

Glover: My direction to you is that, had you chosen not to properly identify the fact that you had a weapon and directed that officer to where that weapon was located; had you been taken from the vehicle, and the officer, in the interest of his safety, chose to secure you in a safe position, and then looked, found, and determined that you did, in fact, have a weapon...then, sir, you would have faced additional, [inaudible], and more severe criminal sanctions.

Baillio: So what you're saying is: I give up all my rights to keep and bear arms if I'm stopped by the police: Is that correct?

Glover: Sir, you have no right, when you have been pulled over by a police officer for a potential criminal offense [which would be what?! - DB] to stand there with your weapon at your side in your hand [Baillio's weapon was nowhere near his side or his hand, and Glover knew that. - DB] because of your second amendment rights, sir. That does not mean at that point your second amendment right has been taken away; it means at that particular point in time, it has been suspended.

Will Grigg from ProLibertate, an excellent freedom blog, has this to say:

According to Glover, a police officer may properly disarm any civilian at any time, and the civilian's duty is to surrender his gun -- willingly, readily, cheerfully, without cavil or question.

From Glover's perspective, it is only when firearms are in the hands of people other than the state's uniformed enforcers/oppressors that they constitute a threat, not only to the public and those in charge of exercising official violence but also to the private gun owner himself.

NAGR spoke with Mr. Baillio, and he told us that he's in the process of securing the official procedures and codes for firearm handling and private property confiscation for the Shreveport police department.

So far, the city has been half-heartedly cooperating with him.

"I felt sick," Baillio told NAGR. "My uncles didn't die for this country so I could surrender my rights like a wimp. I felt terrible. I was just thinking of all that my family has done for freedom in this nation -- including dying -- and here they are disarming me at a traffic stop."

    What to do?

Read Luke's commentary here, and participate in the discussion by leaving a comment.

Send this around. This kind of behavior cannot go unchecked.

Call Mayor Glover's office to complain: (318) 673-5050.

I'll leave you with one last consideration. As a licensed firearms instructor in charge of a hundred different students every month, I'm often asked if citizens should voluntarily inform police officers of the presence of a firearm during a routine traffic stop.

While different states have different laws, my answer for Colorado citizens is an emphatic "No": Colorado law doesn't require you to volunteer that kind of information, and this case in Louisiana proves why, if at all possible, you should never invite trouble by doing so.

A Gun Safety Course for Kids

In all fairness to both Gun Owner's and Non-Gun Owner's I highly recommend that you download the free PDF file titled "A Gun Safety Course For Kids". It is published and made available to EDUCATE Parents and especially children on the purpose of any type of Gun, the safe handling of them and what a child should know and how to deal with any situation involving any type of Gun or Firearm. Best of All It is FREE.

Many Citizen's in America are against having any type of Firearm in their home for one reason or another. Most likely those who oppose having a firearm around have never been educated about the safe way to deal with a Gun. It is a "BAD WORD" or Taboo. I hope everyone, both those for firearms ownership and those opposed would take the time to get this free download or just read it online. It is one of the best site's I have found about Gun Safety. Probably after reading this course a lot of folks opposed to Guns might change their mind and at least learn how to properly use one or disable it if you come across one that is not properly put up safely from guests in your home or a home you might visit that has different types of firearms in their home. Some may even take up the sport of safe shooting that is available even for children. It is well worth the effort to at least get educated on the subject and understand the reason for the Second Amendment to the Bill Of Rights. Be sure to come back and take the poll after you have read the Safety Course and read on into this lens about other issues that apply to all American Citizen's.

    SPECIAL MESSAGE from the Director

Bureau of Alcohol, Tobacco, Firearms and Explosives

    WASHINGTON, DC 20226

    Dear Federal Firearms Licensee:

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) is the primary agency responsible for enforcing the Federal firearms laws. Our mission is to prevent terrorism, reduce violent crime, and protect the public. With respect to firearms, ATF works to take armed, violent offenders off the streets and to ensure criminals and other prohibited persons do not possess firearms.

Licensees play a critical role in protecting America from violent firearms crime through responsible and lawful distribution of firearms and accurate recordkeeping which assists ATF in tracing guns used to commit crimes. By complying with Federal law, licensees prevented the sale of more than 870,000 firearms to prohibited persons from November 1998 through September 2005. An untold number of lives have been saved and countless crimes have been prevented by stopping such transactions from taking place.

Dedicated licensees also make significant contributions to crime prevention efforts through active support of such collaborative efforts as the National Shooting Sports Foundation (NSSF) campaign "Don't Lie for the Other Guy." We are grateful to the scores of licensees who cooperate with ATF in preventing illegal straw purchases, which helps to disrupt firearms trafficking organizations. We encourage your continued

support and we thank you for reporting suspicious criminal activity and firearms thefts to ATF. Please note, to report a theft, you should call 1-888-930-9275, and to report other criminal activity, you should call 1-800-ATF-GUNS.

The 2005 edition of the Federal Firearms Regulations Reference Guide provides information designed to help you comply with all of the laws and regulations governing the manufacture, importation, and distribution of firearms and ammunition. Accordingly, it contains the relevant Federal firearms laws and regulations, some of which have changed since the 2000 edition. It also contains rulings, general

information, and questions and answers to give you further guidance on the Federal firearms laws. The laws and regulations are in a different order from previous versions so that this publication will be easier to use. This new edition also contains additional points of contact to help you get in touch with ATF more easily.

Since firearms laws can change over time, please be aware that the information in this book may change after the date of publication. The ATF Web site at www.atf.gov is an excellent source for up-to-date information. As always, you are welcome to contact your local ATF field office for information or assistance.

    Heraldry of the ATF Seal

On the Escutcheon or shield – the sign of a defender – is a Chief of Sanguine (deep red), which indicates the bearer of the shield (Alcohol, Tobacco, Firearms and Explosives), through its achievements, has authority and wisdom. The sanguine color of the Chief represents a patient victor, one not hasty in battle. Also represented in the middle of the shield is a Chevron of Azure. This Chevron denotes protection and service, and the azure color represents strength and loyalty. Combined, they indicate ATF’s strength, loyalty, service and protection to Justice, depicted by the Scales of Justice below the Chevron. The Chevron of Azure also represents the past relationship between ATF and the Department of the Treasury.

The Escutcheon stands on a field of deeper blue representing vigilance, perseverance and justice and is surrounded by a Laurel of Or (gold), symbolic of victory, and crowned by three Mullets, or stars, of Or.

Around the Seal is the name of the Bureau, and at the base, the year 1972, when the Bureau was founded. The Seal is contained within a corded edge.

The Mullets and the corded edge encasing the full seal are elements drawn from the Department of Justice seal and represent the new inclusion of ATF within DOJ.

The Seal, as described above, was carefully designed to represent the Bureau’s dedication to and accomplishments in achieving patient victory in defense of Justice, as well as the interrelationship between ATF, The Department of the Treasury and The Department of Justice.

    Gun Laws

    Gun Laws in North Carolina

    North Carolina

To acquire a handgun in North Carolina (including private sales, gifts, and inheritance) an individual must go to the county sheriff's office in the county in which they reside and obtain a pistol purchase permit. This is not required if one has a CHP (Concealed Handgun Permit) permit.[241] State law requires the applicant to appear in person with government ID, pay a $5 fee, undergo a background check similar in scope and scrutiny to NICS, and have a reason for owning a pistol (hunting, target shooting, self defense, or collecting). Because there are 100 different counties in North Carolina, there are different sets of rules and requirements for obtaining such a permit, which can be determined arbitrarily by the local sheriff. Some sheriffs impose other restrictions such as a limit on the number of permits applied for at a time, waiting periods, and/or proof of good moral character (a witness or references, in some cases notarized with affidavits).[242][243][244][245][246] The Pistol Purchase requirements are a holdover from Jim Crow laws that were designed to prevent African-Americans and other minorities from easily obtaining handguns.[247]

Durham County requires the registration of handguns. In accordance to North Carolina Law, no other county or local government may require handgun registration.[247]

North Carolina is a "shall issue" state for the concealed carry of handguns. Application for a concealed handgun permit is made through the local county sheriff's office. Applicants must complete a state approved training course given by a state certified trainer. Instructors for these classes must be certified by the North Carolina Department of Justice. The Concealed Carry Handgun Safety Class is regulated to be a minimum of eight (8) hours long and must include a written test on state laws pertaining to the use of deadly force, and restrictions on the locations a handgun may be carried in a concealed fashion. In addition, the applicant must shoot a designated course of fire and obtain a passing score. A concealed handgun permit is valid for a period of five years. Regardless of the possession of a CHP, there are places that are restricted from the carrying of a concealed handgun, or any other firearm. Some restrictions have loop holes for EMS, Fire & Police.[248] Firearms may not be transported or possessed off of one's own premises during a declared state of emergency or in the immediate vicinity of a riot, except for law enforcement and military personnel in the performance of their duties.[249]

North Carolina honors concealed carry permits issued by Alabama, Alaska, Arizona, Arkansas, Colorado, Delaware, Florida, Georgia, Idaho, Indiana, Kansas, Kentucky, Louisiana, Michigan, Mississippi, Missouri, Montana, New Hampshire, New Mexico, Nevada, North Carolina, North Dakota, Ohio, Oklahoma, Pennsylvania, South Carolina, South Dakota, Tennessee, Texas, Utah, Virginia, Washington, and West Virginia. New Mexico has no formal agreement with North Carolina, but they do informally accept the permit. North Carolina's permit is valid in approximately thirty-three states, more than any other CHP.[250][251]

Open Carry is also legal throughout North Carolina[252] except within the town of Cary, which forbids it by local ordinance. In the city of Chapel Hill, open carry is restricted to guns of a certain minimum size, under the theory that small, concealable handguns are more often associated with criminal activity. No permit is required to carry a handgun openly in North Carolina.

North Carolina is a Common Law State.[253] Appearing in a public place, armed with a firearm, may be an affray at common law depending on the circumstances.[254] In State v. Robert S. Huntley, it was ruled, in part:

It has been remarked that a double-barrel gun, or any other gun, cannot in this country come under the description of "unusual weapons," for there is scarcely a man in the community who does not own and occasionally use a gun of some sort. But we do not feel the force of this criticism. A gun is an "unusual weapon," wherewith to be armed and clad. No man amongst us carries it about with him, as one of his every day accoutrements--as a part of his dress--and never, we trust, will the day come when any deadly weapon will be worn or wielded in our peace-loving and law-abiding State, as an appendage of manly equipment. But although a gun is an "unusual weapon," it is to be remembered that the carrying of a gun, per se, constitutes no (sic) offence. For any lawful purpose--either of business or amusement--the citizen is at perfect liberty to carry his gun. It is the wicked purpose, and the mischievous result, which essentially constitute the crime. He shall not carry about this or any other weapon of death to terrify and alarm, and in such manner as naturally will terrify and alarm a peaceful people.[255]

Because of State v. Huntley, and other court rulings,[254] caution is urged as to the areas a person frequents with firearms.[256]

    Straw purchase

    United States federal gun laws.

    Firearms

In the context of United States federal gun laws, a straw purchase is defined as any purchase from a dealer holding a Federal Firearms License where the buyer conducting the transaction is acting as a proxy for another person. The law does not distinguish between someone who is purchasing on behalf of a person who legally cannot purchase or possess a firearm, and one who is not.

Beginning in 1975, ATF officials apparently reached a judgment that a dealer who sells to a legitimate purchaser may nonetheless be subject to prosecution or license revocation if he knows that that individual intends to transfer the firearm to a nonresident or other unqualified purchaser. This position was never published in the Federal Register and is indeed contrary to indications which Bureau officials had given Congress, that such sales were not in violation of existing law. Rather than informing dealers of this distinction, ATF agents set out to produce mass arrests upon these "straw purchase" sale charges, sending out undercover agents to entice dealers into transfers of this type.[citation needed]

In the United States, straw purchases are a felony violation of the Gun Control Act of 1968 for both the straw purchaser (who can also be charged with lying on Federal Form 4473) and the ultimate possessor. One of the questions on Form 4473 is “I am the buyer of this firearm” and the purchaser must answer honestly yes or no, by checking the appropriate box in ink. However, purchase of a firearm as a bona fide gift for someone who can legally own such a firearm is permitted.[1]

Many gun shops have jointly participated in programs (such as: “Don’t Lie For The Other Guy”) to deter such purchases.[2]

    POLICE STATE OR NOT?

    Wake Up Citizens

    By Andrew C. Wallace

    July 27, 2011-Today

    NewsWithViews.com

The ESTABLISHMENT has taken over, Looted our Republic and our People into bankruptcy, effectively denying us of our Constitutional Rights while preparing to make War on "We The People" for total Marxist One World Order governance.

THIS IS A FACTUAL DIATRIBE TO INFORM AND GUIDE CONSTITUTIONAL PATRIOTS TO VICTORY.

Our Corrupt Officials are Usurpers, paid by the ESTABLISHMENT who have been caught red handed sending thousands of illegal guns to Mexico and other countries for no legal purpose so they could say that the guns and resultant killings were caused by legal gun sales in America. This was then a major gamble to create public support for ongoing efforts to promote gun control that back fired. The ESTABLISHMENT cannot tolerate the fact that as long as we have guns to defend ourselves when they attack us. The ignorant cowards among us who have not prepared for survival and self defense will mostly die at the hands of the Marxist ESTABLISHMENT just like the Jews in Hitler's Germany. For self defense details read Greg Evensen's article.

The Obama Stimulus Program funded this treason that resulted in the deaths of two Federal Officers and countless others. Attempted cover-ups at the highest levels of government consisting of spin, lies, retribution and additional restrictions on gun sales with records of gun purchasers is ongoing.

William Hoover from the ATF started the lies by falsely testifying to Congress in 2008 that 90% of firearms recovered in Mexico were from civilian sources in the United States. The ATF later admitted that the 90% figure only applied to their much smaller data base, WND 7-13-11. The highest levels of government have been exposed for this treason by their own words, Congressional Hearings, and reported as Operation Gun Walker, Gun Runner, or Fast and Furious in the media.

Mike Vanderboegh, a courageous patriot, with the help of whistleblower Federal agents brought this to light and continues to report on it in great detail. I believe that God had a hand in exposing this most evil preparation for war on the people by ESTABLISHMENT usurpers so that we could expose them and take back our country.

All available facts attest that the ESTABLISHMENT is preparing to make more war on the people. For us to win, we must know our enemy. This is a factual polemic outlining how our freedoms have been denied, and our resources looted for over 100 years by our enemies, the corrupt Super Rich Families, also known as the Ruling Class, Global Elites and the "ESTABLISHMENT"; who control Corporations, Unions, Government Officials in both parties, Media, Tax Free Foundations, Universities, Private Federal Reserve Bank and Think Tanks. These Members and Underlings of the ESTABLISHMENT are enemies of the people responsible for the looting and destruction of our Republic. Most people find this truth hard to accept. The ESTABLISHMENT'S ultimate objective is Marxist Global Governance (One World Order), Ultimate Power, and control of all the Money without any freedoms or Constitutional Rights for the people. Even the Bible allows us to hate and detest the ESTABLISHMENT for their heinous crimes which are second only to those of Judas Iscariot.

The Democratic Party is now a "self proclaimed communist organization," but like the Republicans are also subordinate members of the ESTABLISHMENT and totally subservient to it as well. People working for any part of the ESTABLISHMENT are dirty rotten traitors, or ignorant brain dead slaves deserving of the enmity, contempt and loathing of all Patriotic Americans. As you are learning this is a powerful, well established, comprehensive and complex treason.

I will not bore you with all of the thousands of unlawful attacks and depravations of our constitutional rights by the Marxists. It is an ongoing death by a thousand cuts, so we will defeat the ESTABLISHMENT they serve with a few strategic actions in accordance with the Tenth Amendment and the Rule of Law.

WE WILL DEFUND AND TERMINATE MOST UNCONSTITUTIONAL GOVERNMENT ACTIVITIES WHICH REPRESENTS ABOUT TWO THIRDS OF ALL GOVERNMENT EXPENDITURES.

NOW FOR SOME REALLY GREAT IRREFUTABLE FACTS. Be Happy and Rejoice, because Contrary to Marxist propaganda we can quickly have Full Employment with Unlimited Prosperity, and Freedom in a few months by reverting to Proven CONSTITUTIONAL procedures used prior to 1913. As one example, we simply end the income tax, IRS, any alternate federal taxes, tax free foundations and the Federal Reserve Bank. We then use tariffs as was done in the past.

THESE FEW ACTIONS WOULD DEFUND UNCONSTITUTIONAL GOVERNMENT, END LOOTING, SUPPORT PROPER WAGE LEVELS, FORCE RETURN OF MANUFACTURING TO AMERICA AND RETURN TO FREEDOM WITH UNLIMITED PROSPERITY. This would take our wealth out of the hands of the ESTABLISHMENT and return it to the people. I think the ESTABLISHMENT would attack us for ending their plunder, but so what, they detest and want us dead anyway.

Our primary objective must be to defeat most elected officials in both parties who are Marxist subordinates of the ESTABLISHMENT, and therefore, by definition, Absolute Enemies of the people and our Constitution. Many Judges, if not most, as Lackeys of the ESTABLISHMENT deny citizens their constitutional rights and must be prosecuted. It is impossible for self proclaimed Marxist/Progressive Officials and Judges to owe allegiance to our Constitution. They are Traitors by the very definition of their self proclaimed Marxism which can't coexist with our Constitution, or the Bible.

Based upon the information in this article, recent experience and the history of Marxism, there is almost a certainty that the Marxists will attack Patriotic Americans with violence when they lose the elections, or when they think they could lose the elections. American Patriots in complying with the rule of law will not initiate violence, but will defend themselves in kind, with great determination, this is known as the Doctrine of the Three Percent.

Now hear this, ESTABLISHMENT controlled government officials (Traitors), and the ESTABLISHMENT owned Federal Reserve Bank have forced most Americans, their parents, grandparents, great grandparents and great great grandparents into eternal poverty by the Treason of Usurping our Republic and Looting. When these traitors are lawfully removed from power we can take back much of our stolen wealth. Fully two thirds of all government expenses by our treasonous government officials are unconstitutional looting of We The People. Gold and Silver money is required by the Constitution because it retains value and cannot be printed which makes it difficult to manipulate and steal as is now being done. We must cut our losses by terminating the Private Federal Reserve Bank and its Fiat money at once. Most Americans would be very well off today if our government officials were not traitors using Unconstitutional Laws to impoverish us. Read papers by the following writers, if you want to know in detail how the criminal ESTABLISHMENT has looted us for 100 years and continues to do so, Devvy Kidd, Edwin Vieira, Cliff Kincaid, J.K.Ryter, Lynn M. Stuter, Andrew Wallace, and many others at NewsWithViews.com.

There are also millions of brainwashed clueless people of several races, who deprived of proper FAMILIES, EDUCATION, AND RELIGIOUS TEACHING by elected officials are doomed to exist as slaves and criminals in ever increasing poverty, crime and depravation. They are Inmates living on the dole in the Marxist Inner City Utopias as proscribed by the United Nations Agenda 21 (Sustainable Development), also known as 'Stack and Pack." For specifics go to Tom DeWeese, they believe the communist lie that they have a constitutional right to do nothing but rut, producing fat, dumb, and lazy people who prey on, and intimidate decent citizens. Residents in Marxist Utopias will be allowed to live by the Communists only so long as they assist in destroying our Constitutional Republic. Marxists will then kill the non productive troublemakers for they contribute nothing to Marxist income redistribution (Social Justice). It is no accident that Communist officials in large cities refuse to allow citizens to have crime reducing firearms. Recently we have seen how the self proclaimed Marxist Union Thugs have attacked innocent people, reminding us of the hundreds of millions killed in the name of Marxism.

The Fealty of Senior Military Officers to our Constitution and Republic is in serious doubt due to their waging of unlawful war, being incapable or unwilling to protect the lives of our military from terrorists in this country, forcing members of our military to live with dangerous Sodomites, and denying due process to those who had the courage that Senior Officers did not possess to question legitimacy of orders. Those who face death on the battlefield deserve Senior Officers who have the courage and integrity to back them up even when it puts their careers at risk.

The average man will tolerate Sodomites meaning them no harm, but not in their personal space, and if seriously accosted by one will instinctively and without thought attack them instantly in a great rage over which they have no control. You can only verify this fact by asking men who have had this experience, not some politically correct professional with limited life experiences. We should never allow any member of our families to serve in the new Sodomite Military.

@anonymous: Ahh, you are wrong. The countdown clock does not indicate who I will be voting for as they are Three (3) candidates on the ballot in 47 states this year, Plus one can write in a candidate of their choice in many states - so you assumed wrong. You are right about one thing, I won't be voting for Obama and Obama is not the one that would drive up the price of guns but Secretary of State Hillary Clinton pushing the UN Resolution will be the one that brings the price of guns up or to a total halt. This has been in the works for over a decade now and getting closer each election. I pray it does not happen and we get a God fearing President who will represent "We The People" and not big corporations and money.

Kind of an unrelated comment here, but I noticed the countdown to "The End of Obama" at the end of the lens here, and that clearly expresses who you will be voting for :)

One thing about Obama that cracked me up, however, is how he really didn't do anything to prevent gun sales at the start of his presidency. There was speculation that he was going to, but it didn't happen that way. I got into an argument with a salesperson at an Oklahoma City gun range about this fact. He said that Obama was driving the price of guns up, so I asked him how, He said "he is going to make it illegal to own guns, so people are buying them all up raising the price".

The price went up on speculation, it was the sudden influx of gun purchases that drove the price up not Obama. The same people that cared about gun rights drove the price up on themselves. I found it kind of funny so I thought I'd share it. Great lens, liked it.

Very interesting, especially as I come from England where gun ownership is very rare, except in the countryside (e.g. farmers and landowners often own shotguns), so we generally have very little exposure to guns. Even the police generally don't carry guns. Unfortunately a lot of criminal gangs in major cities do have guns, so the strict gun control isn't really working and many of the guns are in the wrong hands.

@Andy-Po: Thanks for the comment. You affirmed what the 2nd Amendment is in place for. Trying to control firearms in any country only creates a 'black market' and the criminal's and gangs will always have guns and become the new leaders of the pack. The Constitution always refers to 'WE THE PEOPLE' being in charge and our Bill Of Rights are in place to guarantee it. Thanks again for posting AndyPo

Glad your daughter was not hurt and only lost a few things. Better than than her life. Glad to hear she's ready if it ever happens again. Just putting up a sign on the property "This house protected by a gun" picture will turn many a culprit away. Even an armed thief does not want to draw attention with gunfire.

Very well done lens! My daughter became the owner of a weapon this past week, after two males broke into her apartment. She hid in the bathroom and tried 911 several times on her cell phone, but couldn't get through. She then called her boyfriend's brother, a sheriff who was vacationing in Vegas, who called the police for her. By this time, one of the men was trying to get into the bathroom. They stopped messing with the doorknob, and Sabrina stayed quiet in the bathroom on the phone with the dispatcher until her room-mate (who wasn't there during the robbery) called her name and told her the police were outside. My daughter is just a poor young college student, and she had her brand new laptop stolen. They also stole her room-mate's electronics. The very next week, her father bought her a gun, and being a war veteran, taught her how to use it. Sad that the world we live in makes good people have to defend themselves to this extreme, but she does sleep better at night, and so do I.

@ThomasJ4 LM: It is sometimes quite a touchy subject but the fact still remains that the Second Amendment is in place for a very GOOD REASON. Without this basic right we might as well lower the Flag because it holds no value without the citizen's rights. Thanks for the comment and liking the lens. Any ?'s feel free to post or contact me directly.

@mrducksmrnot: I just never thought about that. If we have a constitutional right to have a gun then why do we need an extra permit to .....have a gun? We are in Ohio.

@straw-hut: Oh boy, here is a touchy subject. I look at a concel/carry permit as another form of control and an itemized list for the government from the smallest to the largest of keeping track of guns of any capacity so they (Government) can quickly dis-arm it's citizens. Why ask permission and pay our hard earned money to Big Government to exercise our basic rights granted under the 2nd amendment. Just carry it openly. I carry mine openly and have no reason to hide it or do I desire to conceal it. The more citizen's who exercise this right the quicker the msg will be conveyed to those who want to gain control that they have lost their battle with We The People and should BACK OFF if infringement of the citizens rights. PERIOD. It SHALL NOT be Infringed. End of sentence. I also know that some States do not authorize the open carry rule of law which is in violation of the 2nd amendment as written. The principle reason for this right is the same today as it was well over 200 years ago. I oppose any CCW permits as an added tax for government to try to control We The People. Give me your State of residence and I will look up the legal and illegal portions concerning your new Son-in-Law desire to carry one concealed.

@straw-hut: Thanks for the visit and comments on this lens. I agree with you. The Government establishment thinks we are all dummies and we cannot make decisions for ourselves with plain old common sense. I think our local and primary elections will force the government to change their tune soon or face impeachment or another Revolution. We The People are making our own Warning Signs with our public demonstrations and our voices heard.

I like the part about Obama being protected but my family has no one assigned to protect us. The secret service is armed with more than water pistols. We have the right to bear arms and protect ourselves. Yes there have always been tragedies and that is sad. But we have become a nation that cannot even order a cup of hot coffee without being warned in HUGE letters that we are holding hot coffee. Let's go back to using our own brains.

@homestead lady: Great response and glad you are teaching your children well and the dangers of what a gun can/may or will do to you. Death is instant. As your children reach an age of more maturity be sure to teach them the proper way to handle a gun of any kind in the proper way. I grew up in a generation where guns were tools more for hunting and putting meat on the table and also for self defense in case of danger of harm to oneself or family and even your neighbor. Keep up the good work on training your children and also teach them well on the Constitution and the Bill Of Rights as our Dept. Of Education (DOE) in today's society is pressured by big government not to teach this anymore to take away not just our 2nd amendment rights but all rights and we come under a dictatorial form of government. I also agree with you about the licensing of any type of firearm. I, nor any free citizen should have to ask anyone for permission or a license to buy, own a firearm. It is the right of the people to keep and bear arms. All a license does is create a means for big government to collect money illegally under the pretense of security or any other reason and to suppress the free citizens into a state of servants to a tyrant government. Our government from the lowest form in the township, city, county, state and United States must be reminded, by force if necessary, that We The People are in charge and those who hold any form of office are their to serve We The People. As Ronald Reagan stated in his farewell address upon leaving office, He reminded the citizens that the government was the CAR and WE THE PEOPLE are the driver's of the car. One quick way to eradicate big government now is to quit driving or funding/fueling the CAR. It cannot run if We The People cease to fuel it. Thanks for the comment and pray you get that pink AK-47 one day. You may need it to help overthrow today's out of control, tyrannous government now in office.

@TonyPayne: I have guns and kids ages 4, 4 & 6 and you can rest assure my kids know about guns. Anybody can ask any one of my kids, what are guns for? They will tell you in a hurry "guns are for home defense." They also know what to do if they see a gun at someones house, they will say "you don't touch it and go tell a grown up I saw a gun and not let my brothers/sister touch it." I also will not under any circumstances let my kids play with toy guns or a make shift gun (ex.using a train track as a pretend gun) not even water guns, super soakers or anything like that. My oldest son ask me one day why couldn't he play with a toy guns, I told him that guns are for real and they will end your life and you can't come back from dead. I also said it wasn't right to pretend to kill people or kill people for real unless they try to kill you first. They don't play shooting games. Guns are real and should not be promoted like they are nowadays.

As for licensing auto weapons, well I just flat disagree with that. The Constitution says we have the right to keep and bear arms, I didn't see anything about how I have the right to have a automatic gun or any gun for that matter if I tell Big Brother/Sister I have/want one. I don't need a lawful reason to own a automatic gun. I have one because I want one. I just love, love love AK-47s! I want a pink one and I'm going to get one someday. I had a tec9 years old and those things aren't worth 2 cents. It couldn't hit the broad side of a barn.

@TonyPayne: I can relate with your worry about the irresponsible people not only in America but everywhere. The proper teaching should always start at home with a responsible adult teaching their children the proper reason and use of any type of gun. I kind of agree but disagree with your other statement about 1st the licensing of auto weapons. Why should we license anything we have the right under the Bill of Rights to have (and for a good reason) Licensing is another added fee for the government to collect illegally. 2nd why should only the military have automatic weapons and the citizens not? How can we the people overthrow an unjust government if we don't have the proper arms to do so? Still a good point and a big Thank You for you comment.

My worry with guns is that too many people are irresponsible and don't lock them up, allowing them to get into the hands of children. It shouldn't happen, but there are enough tragedies every year because of this. I also believe that the licensing of automatic weapons should be prevented, since there is no lawful need for any individual citizen to own one.

I have my share. Short, Long, Revolver, Auto-Loader, Pump, Lever, Hmm did I leave anything out. I am a big fan of Sig Sauer even though they aren't American made, but I am also in possession of American made firearms. I may have missed it on your lens, but if it isn't there, I would suggest a gun safe for excess armament that isn't strategically placed. If you know what I mean.
