For legal eagles and those well versed in case study, is it ethical for a school to hold back mold ?
Is it legal for a school to withhold the fact that they have mold from the kids. Even when the kids are getting sick? Legally what can be done? I have only found on case where a teacher successful in 2016 sued and won against her school district. How parents found out was via the paper no warning, whatsoever. I'm livid and it may explain why my kid has been sick weekly. Complaining about head aches, stomach aches, etc. There was also a staff member that told me her doctor told her point blank she needs to find a new position. What can be done?
Keep searching for an attorney (not necessarily in your city, county, or state) who will give advice and take the case. There is a history to this, evidently, and it's still not being addressed. The case may look more complicated than it really is, but it may take time to investigate and make the case. Withholding the fact that there is a health hazard is criminal behavior. Do you happen to know whether any of the children's parents are police officers?
I don't think so, but I can look into it. I tried to get DHEC, but they weren't able to go in and test the air, they only had jurisdiction in the cafeteria.
Hmmmm...besides finding the right attorney, it sounds like a student might want to do a private little science project...
Brittvan I just Googled your area. There is actually some law on this subject just not specifically with schools. And there are lawyers in your area that handle Black Mold matters. Normally this comes up in rental properties.
Of course there would be a duty to notify parents and staff. But to my mind your best course of action would be to get you self down to the Health Department and raise holy hell for about 3 days in a row. And I would visit the school and demand tests. Of course dropping of and mailing and emailing would be part of your assault.
It would be the idea of you getting them to deny the problem in a way to where you really have the proof of a cover up for later liability issues.
Next I would get a mask for your child. (I know it sounds classless, but )
Take a picture of her showing up to school with it and give it to the press. (the mask will conceal identity) And any rate the mask actually helps prevent the airborne irritants -- note that she will probably be sent home for wearing it, but go with that.
A word of caution. "The King can do no wrong". Is still the baseline for government. So there will be hurdles to create personal and institutional liability.
This is in no way - as you can see a law approach and certainly not advice on the law. I am more of a civil activist. So I Googled it but they do not always like links here so this is what I Googled ' Georgia Law on Black Mold Liability ' Those paid ads will get you rolling to find an attorney.
I would nudge you a bit to really get pro-active. One child with a weakened immune system and ill health could get fatally sick.
Oh I have the mask, I am going to tell her to wear it tomorrow. I took her to her doctor this week and her health is good, but her doctor said a lot of parents were complaining. So, I will definitely heed your advice.
