An Unfit Judge

Judge Sharon Keller, the Texas appellate court judge who closed the clerk’s office before a death row inmate could file a last-minute appeal, is fighting to keep her job. At a hearing on Wednesday, she said in a crowded courtroom that if she had it to do again, she would do the same thing. That testimony is further proof of why Judge Keller needs to be removed from the bench.

On Sept. 25, 2007, Michael Richard’s lawyers called the court clerk’s office to say they were running late in delivering the papers for his appeal. The Supreme Court had unexpectedly issued an order in another death penalty case that they believed provided grounds for putting off his execution. When the request to keep the office open reached Judge Keller, she insisted it would close promptly at 5 p.m. The appeal was not filed, and Mr. Richard was executed hours later.

Judge Keller is now facing five counts of judicial misconduct and a possible recommendation that the state judicial system remove her from the bench.

In court this week, Judge Keller lashed out at the condemned man’s lawyers, blaming them for the controversy. She argued that Mr. Richard could still have filed his appeal by seeking out another judge, but that misses the point. She did not follow appropriate procedures. And clearly, under any interpretation of the rules, given that a life lay in the balance, the clerk’s office should have stayed open.

Judge Keller’s profound lack of appreciation for the seriousness of taking a life — and the obligations it places on the state — is similar to the disturbing dissent that Justices Antonin Scalia and Clarence Thomas delivered this week in the Troy Davis case. They suggested there was no constitutional problem with executing a man who could prove he was innocent.

We believe the death penalty is in all cases wrong. But people who support it should still insist that it be carried out only after a prisoner has been given every reasonable chance to make his case. Judge Keller’s callous indifference in a case where the stakes could not have been higher makes her unfit for office.

Texas Criminal Judge Accused of Misconduct

In this morning's NY Times I found a late entry in the Worst Woman in The World contest whose evil equals and perhaps even surpasses that of the current leader, Ann Coulter.

Gretel C. Kovach in the NYTimes article linked below describes the most recent candidate for the worst woman in the world, Judge Sharon "Killer" Keller chief judge of Texas' highest criminal court.

In 1998, Keller wrote the opinion denying a new trial for Roy Criner, a mentally retarded man convicted of rape and murder, even though DNA tests conducted after his trial showed that it was not his semen in the victim. Keller said, "We can't give new trials to everyone who establishes, after conviction, that they might be innocent. We would have no finality in the criminal justice system, and finality is important."

Of course finality is more important than justice in the justice system!

In one of his few such uncharacteristic moments of mercy, Governor George W. Bush pardoned Mr. Criner.

To Judge Keller's detractors, the Criner decision highlighted what they see as her strong and habitual bias for the prosecution. Texas defense lawyers describe her as a "law-and-order" zealot who rejects most appeals out of hand. Her defenders say she's a hard worker, an "engaging conversationalist" and admire "her calm confidence and the strength of her convictions." She's someone "who never complains, never explains." Her court colleagues have nicknamed her "Mother Superior" because of her devout Roman Catholic faith.

Seventeen months ago, lawyers for a man facing execution sought extra time to file a last minute appeal. Judge Keller refused to delay the closing of her clerk's office past 5p.m. even though late filings are common on the day of a scheduled execution. The man, Michael Richard was put to death a few hours later. Based on that case the State Commission on Judicial Conduct last month charged Judge Keller with incompetence, violating her duties and casting public discredit on the judiciary. Keller could be tried and forced off the bench. Keller was elected to the bench in 1994 in a campaign in which she described herself as "pro-prosecution."

Michelle Bachman, Tea Bagger Queen--a write-in Candidate from Mewlhouse

We have another write-in candidate to add to the list--Michelle Bachman Republican U.S. Representative from Minnesota's 6th Congressional district. She may not be the most evil woman in the world, but she's clearly the dumbest and most ignorant member of Congress. Leaving her of the original list was an oversight on my part.

Bachman was born Michelle Marie Amble in 1956 in Waterloo, Iowa. She is married, and has five children. She has a J.D. degree from Oral Roberts University. When she was on the Board of a charter school in Minnesota she tried to institute classes in creatinionism and "12 Christian Principles." She resigned when she didn't succeed. In Congress she has stated her belief tha CO2 results from a beneficial natural process, she opposed the economic bailout measures, and she introduced a freedom of choice of light bulbs bill but opposes a woman's right to choose, supports the teaching of intelligent design in science classes, she believes GLBT people suffer from sexual identity disorders and wrt health care reform proposals she said

"This cannot pass. What we have to do today is make a covenant, to slit our wrists, be blood brothers on this thing. This will not pass. We will do whatever it takes to make sure this doesn't pass."

Or Clytemnestra who, legend has it, murdered her husband, Agamemnon, King of Greece and his concubine, Cassandra?       Lizzie Borden was a nut, however Lorena Bobbit went to the exteme I don't know who in their right mind as a woman would ever do such a thing? I wonder if she was related to Jeffrey Dahmer? He chose to kill and eat his prey and she chose to bite off something she shouldn't of I am certainly glad she got caught before she ended up being like her relation.:)

      I've re-opened the polls to allow voting on two additional candidates for "The Worst Woman in the World," Lorena Bobbitt and Sharon "Killer" Keller either of whom could defeat Ann Coulter the leader with 72% before these two outstanding candidates were added.

      Ann evil now that made me laugh Ralph. Don't like someone that is intelligent, funny and speaks the truth? Placing her on your most evil people list says a lot about you not Ann. Would Rush be on your most evil men list? However, since you decided to put political people on that list I would like you to include Maxine Waters for her testomony regarding Fannie and Freddie and of course her saying during her testimony that they were sound due to her good friend Frainlin Raines.

      Ann Coulter speaks the truth? Are you crazy?  Limbaugh is looney tunes more than evil. Refresh my memory on Maxine Waters' testimony. I'm not a big fan of Franklin Raines. As I recall he cooked the books at Fannie Mae in order to increase his bonus.

      Pelosi was right about the failure of the Bush administration to regulate Wall Street. Maxine Waters was off base on Raines and Fannie Mae but not in any sense evil. The evil people were at AIG, Countrywide Bank, City Bank, Merrill Lynch and the other crooks on Wall Street. Ayn Rand worshipper, Alan Greenspan, played a major role in the collapse, but I would call him mistaken, not evil. Robert Rubin and Larry Summers also were wrong in their support of repealing Glass Steagal and in their blind faith in free, unregulated markets, but I wouldn't call them evil. BTW there were several others on the ballot above that I would put ahead of Ann Coulter. My vote went to Judge Keller.

      For me it was a tossup between Judge Keller and Ann Coulter. I went with Keller because she's been responsible for the execution of potentially innocent people. Ann Coulter is an obnoxius entertainer who is actually funny on rare occasions.

      I think both Lizzie Borden and Lorena Bobbit had semi-legitimate motives. There is no excuse for Ann Coulter OR Laura Ingraham. Nancy Grace is annoying but not evil per se.

      Your male candidates all deserve spots on the ballot. How about Caligula? Henry VIII wasn't too nice to his wives, but wasn't bloody awful to the rest of the country. Rasputin? Stalin? Idi Amin?

      here is one for you ralph...and I am ashamed of the Democratics...I am embarassed and to see the true Obama make fun of people that have birth defects...so what if he apologized...the world saw this mans true nature his apology is meaningless...it is like the defendant that killed someone and at his sentencing before the judge announces he turns to the victim's family and says I am sorry I realize the pain I have caused you; I made a thoughtless mistake.

      I am not proud of the Democratic leadership at all...Pelosi said it was unamerican to enforce laws and I say she and her party are unamerica in their behavior. It is a sad day for all Americans as they have been hoodwinked by a Chicago Thug Politician.

      Well the AIG affair from start to finish isn't the proudest chapter in corporate and U.S. government history. However, the uproar over the $165 million in bonuses is small potatos compared to the more than $100 billion of taxpayers' funds passed through AIG to its counterparties, including $12.6 billion to Goldman Sachs. This deal was cut with two Goldman CEOs in the room--current CEO Blankfein and former Goldman CEO, Secretary of the Treasury Henry Paulson, along with Current Sec. Treasury, Tim Geithner. The counterparties got paid 100 cents on the dollar; no haircut for them!

      I agree. But my audience's interest seems to be more focused on contemporary baddies. I haven't gotten around to keeping my promise of a similar hub on the worst men in the world. I'm having trouble deciding who other than top Bush officials deserve to be included. Aside from Cheney, Rumsfeld, Gonzalez and John Yoo, I'll probably include the entire Mohler family--

Nancy Grace would be a distant second and I'd have to add a write-in candidate, Laura Schlessinger, for third because listening to her makes my ears bleed. It's a mad scramble from that point on.

      The "Worst Woman in the World" poll was closed in order to add several nominees--Michelle Bachman, Dr. Laura Schlessinger, Phyllis Schlafly and Islamophobe Pamela Geller. Ann Coulter had a solid lead over Judge Sharon "Killer" Keller in second place when the poll was closed and re-started.

      You have chosen some interesting women to find as the worst, but I must agree that Nancy Grace is the worst. She is the most hateful, rude person there has ever been, and for what reason? She thinks she is royalty for some reason. Who really cares what that woman thinks. I am just thankful she is not prosecuting cases anymore. America is much better off.

      Worst women in the world goes to Asian women who are jealous, bitter, angry hitting all the men around end up prostituting all around the world. And, worst girl in the world goes to Caucasian girls who lie about everything. And, bad mother goes to black women who manipulative, controlling and dominating over her child. And, the worst wife goes to latin women who disrespectful, spit, yelling at their husband all the time.

      If you decide to reopen your poll again I would suggest that you add Katherine D. Savage, Maryland District Court Judge who dropped rape charges because over a three-year period the Circuit Court clerk couldn’t find an interpreter for the rapist, a Liberian immigrant who speaks Vai, a tribal language spoken in West Africa.

      Mahamu Kanneh was arrested in August 2004 after witnesses told police that he raped and repeatedly sexually molested a 7-year-old girl, a relative. The prosecution had witnesses and DNA. The 7 year old victim and another 1 year old victim continued to live in the home with Kanneh, his mother who is a convicted child abuser, and Kanneh's roommate who is a convicted child molester.

      Thanks! I enjoyed doing it. I've been meaning to do one on the worst men. When I do a creep from my home town, Chris Hansen of the TV show "To Catch a Predator" would be at the top of the list. In my opinion, that show is produced by perverts, about perverts and watched by perverts.

      Coulter is one of the most insightful and itinllegent women to stand in front of a microphone in 100 years, but she has a bitterness I can't abide. Much as she has a sense of humor and even tolerates the likes of Bill Maher (they are close friends), her "schtick" of loathing atheists and certain stripes of liberals makes the hairs on my back stand up. Were it not for that, I might vote for her as a political candidate. Given that, however, I can take her only with a good belt of whisky. She's as "media bogus" as Sarah Palin.
