Is it negligence homicide if someone dies of over dose because you had your pills out in the open?
My friend wanted me to ask this question because a roommate of hers overdosed on her medication. She is just afraid that something might happen to her because she left her medicine in the open.
In terms of laws I am not sure. But her roommate was abusing prescription drugs that were not prescribed directly to her (the one who overdosed) so, she was doing something illegal and also had obviously a drug problem.
I don't think it is your friend's fault that her roommate decided to self-prescribe herself, and your friend may have easily forgot about the risk.
I don't think it's her fault. Her roommate is an adult already. I would assume he had read the medication label first. Or maybe, he's used to taking such drug because he won't get hold of it in the first place even if it's scattered elsewhere. I think it would be more questionable if the overdose occurred on a child. You can call it 'negligence' if a child takes in pills or other meds that were left somewhere easy-reach by an adult.
For it to be considered negligible homicide; the pills would had to have been given to her, if the bottle was labeled then as an adult, she chose to take them. Another scenario is if the pills were in a different bottle say an aspiring bottle instead of the labeled original bottle.
However, when it comes to children the laws are a little different.
One example would be to give a loaded handgun to a emotionally disturbed person, to leave a toxic substance within reach of a child and the child consumes it, to leave a handgun within easy access to a child, to leave a running car with a child in it and the child makes the car go and it kills someone, to leave a running car with the keys in it and someone steals the car and kills someone.
One rule of law is that it must be proven that you were grossly negligent in taking the necessary precautions or rather not taking them.

How do we make sure this doesn't happen again you ask? Deregulate further and open more of the gulf to drilling. That could only makes sense to those in the oil companies back pockets.
