      It will provide work for the Supreme Court. We all know that's where this will wind up. I can only hope that the Constitutional issues will be defined and a single verdict on ALL arguments will settle the matter rapidly.

      Note that, unlike a wingnut, I don't presume to know the minds of 9 judges none of whome I ever met. The only safe bet is that they won't all agree.

        Unlike a loose screw,  I can tell ya we can't even trust the Supreme Court to do what's Constitutional.  If we could, Obama woulda been ousted before he ever officially took office.

      Wow.  So they are not even going to give this a chance?  They are not even going to ask the public for their view? Ok.  Is America now NOT accountable to the majority?  Therefore, are we suppose to then live our individual lives, according to certain Republican Atty Generals personal politics?

      Is this what our veterans have fought and died for?  Dictatorships and tyrannous imbeciles?

        You need to read the Constitution. This is NOT a democracy, it's a Republic. The Constitution is designed to protect individuals from Mob Rule otherwise the Taliban could take over our country simply by moving here.

          I have.  I understand very well it is a Republic.  A Republic by the way we elect Representatives to do what the MAJORITY wants.  Not the minority.

        By the way this bill was passed I would say dictatorship would be the right adjective.

        If a person takes an oath and breaks the oath it is treason.

        No one is forced to take an oath to uphold the constitution it is taken of free will.

    This is good news! Earlier reports put the number of states to challenge the bill at 38! It's amazing to me that so many could clearly see the unconstitutionality of this bill and our federal representatives were completely blind to it!

    This is a testament to the lack of representation of the people in Washington! Hopefully this bill will be stopped and our freedom restored!

      I do not see any way around the 10th amendment.

      I would think that they would allow insurance companies to operate across state lines thereby avoiding this constitutional conflict.

      It will be interesting.

      I wonder if any States will use their secession legislation?

        One thing to remember, the government has a self interest in growing. There is nothing to stop the Supreme Court from acting in concert with the other branches and deeming this law constitutional.

        The debate will center around the "commerce clause" in the constitution and the "general welfare" clause. Remember Bush used the commerce clause to enforce federal marijuana laws over the States that passed medical marijuana laws. It's not a gimme by any means!

      Well, our state AG said he would not join in.  He is Democrat with hopes of running for higher office. Go figure! Arkansans have spoke out against this HCR Bill.

    I wonder... if the bill is found to be unconstitutional, can those that voted for it and worked for its passage be impeached for a violation of their oath of office, to "uphold and protect" the constitution?

    Or is non-intent an acceptable excuse for perjury?

        ...the roll call of votes was asked for repeatedly by the republicans throughout the day, I was watching all day on cspan.
        they never had a stand up and say name and vote, but they did have to vote on the electronic machines, is that the same thing? they also, it seemed like, had everyone come to the front on both sides of the isle and say what they thought of the bill, the same sentence for everyone, except "against this bill" or "for this bill"...was that the roll call?

        and you ask because...? how does it matter?...to legally prosecute violations of the Constitution, there has to be written record of who voted on what and how?

    THE ONLY issue being challenged is the mandate. We pay mandated insurance everyday in this country when we pay our auto insurance. And if you don't pay it, THEY WILL FINE YOUR ASS!! And if you don't pay the fine YOUR ASS WILL GO TO JAIL!! So, why is this any different? It's different because it has nothing to do with constitutionality. It has to do with political manipulation of the system for the purpose of political gain. IT'S DISGUSTING!!!!!!!!!!!!!!!

      auto insurance is not the same animal at all

      if you dont drive you dont have to have insurance

      if you are alive obama has mandated you have to have insurance

      get a new argument that one wont work

      First off car insurance laws are controlled by the State in which you reside so they are all different, which is exactly the case for health insurance. Many states don't require you buy insurance but that you have adequate resources to pay damages in the event you injure or kill someone, and you may post a bond in lieu of insurance. Of course you can also choose not to drive. There is no law that requires you to have a car. If I don't have health insurance that certainly won't cause you injury or death, so the mandate is to protect myself.

      Now if you bother to read the constitution please refer to Article 1 Section 8. This is the part that defines what the government is allowed to do. Your health is NOT in that section. The manipulation of the system is by this administration to pass a bill they have no authority to pass and to do it in a way that defies constitutional intent.

        I don't know what state you live in, but in Missouri, if you drive without insurance, you get a ticket. Then, they fine you, and if you don't pay the fine, you go to jail. States are suppose to stay within federal guidelines outlined in the constitution. According to your view my state is outside of constitutional guidelines. Also, if having health insurance is'nt for your own protection, then I don't know hwat is. And your right, I could choose not to drive. But I can't choose wheather or not I get sick. So this would make health insurance even more important for my own protection. As for the constitution, they practically rape the bill of rights daily. At least in this case it benefits the citizens and not corporations or foreign interests.

          There are no federal guidelines for auto insurance. It is the States that created the Federal government, not the other way around. The 10th amendment any power not in Article 1 Section 8 belongs to the States.

    Don't bother quoting the Constitution Poppa. As someone recently said to me, "all liberals know" that only the Supreme Court is capable of understanding it.
