How to register a Charitable Trust Registration in India
What is a Charitable Trust
Despite popular belief a Charitable Trust will be registered under Indian Registration Act not under the Indian Trusts Act. Minimum 'One' Person is required for Charitable Trust Registration .
A Charitable Trust is the public trust formed to do charitable activities. The charitable activities can be defined as the activities for the benefit of general public without any profit.
The "Trust" can be defined as an arrangement in which someone's property or money is managed by someone for a set period of time to carry out a specific set of activities. If the nature of those activities is "Charitable" in nature then trust can manage the property in perpetuity.
Requirements to Form a Charitable Trust
To form a Charitable Trust the following elements must be satisfied.
- Settlor (with intention to form a trust)
- Trust property
- Charitable purpose
Settlor (with intention to form a trust) : Settlor is the owner of property. He/she must manifest the intention to put hie/her own property into the trust.
Trustee: Trustee is the person or group of persons to manage the trust property and use that in furtherance of trust purposes. Minimum 'One' person is required to form a trust. There is maximum number for trustees.
Trust Property : It can be any thing of value - a movable or immoveable property. Even a fix amount can be termed as the trust property.
Beneficiary : For charitable trust it is a always an open group of individuals or everybody in the community.
Charitable purpose : The purpose shall be good of the public as a whole; indefinite beneficiaries; and may be perpetual e.g. health, religion, education, govt aid, etc
Charitable Trust Registration
A registration is required if you want to open a bank account or to collect donation for charitable purposes. You don't need any registration of any kind to do charity.
You need following document to get the Trust Registered
- Trust Deed (buy it from HERE)
- Address proof of all Settlors
- Address Proof of All trustees
- Address proof for Trust's address
- No Objection Certificate from the landlord of Trust's office
- Two witnesses
- ID proof of all the persons (ADHAR CARD)
- 2 passport size photograph of all settlors and trustees
Registration Process to Register a Charitable Trust
First step toward registration of Charitable Trust is the selection of a name. The good things is, you can any name you want.
Second step is to prepare the necessary documents. To register the Charitable Trust you need a well drafted Trust Deed. You also need one affidavit form the proposed president of Charitable Trust and one NOC (No Objection Certificate) from the landlord/owner of the office address of NGO (Non Governmental Organization).
Third Step is to collect the ID proof of all members. Get the copy of Identification proof such as Voter ID card, Driver License, Passport, and Government ID etc of all the members involved in the formation of (Non Governmental Organization). All the copy of Identification proof shall be attested in order to be used. Attestation by Notary Public or Oath Commissioner would work.
Last step is to submit the complete set of documents with duplicate to the concerned authority. The concerned authority for the registration of Charitable Trust is the Local Registrar office with in the Charitable Trust office. and the geographical location of the NGO (Non Governmental Organization) office.
