There is a fine combination of the Government of India which is both soundly lead by ministers as well as presidentially administrated by President simultaneously.In a word, President is the head of the India Government.The Amendment in 1978 orders the President of India to lead governmental functions with the assistance of central Ministers or according to the advice of the ministers.He was once the Boss but after this amendment, he has become a Doll in the hands of Cabinet Ministers.So he is a namely head.He is not the de facto (functionally head ) president like the President of America or U.S.A..He is rather like the King or Queen of great Britain or England.Till if he has the personality like A. P. J. Kalam, he can surpass Ministers and can do something fundamentally.

In article no 58 the eligibility for becoming the Indian President is prescribed in details.

  • He is an Indian citizen.
  • He is at least 35 years of age.
  • He should have qualified to be elected in Loksabha or in Parliament election .
  • He is not appointed either in Central Government or in State Government or In local statutory body in profitable post.
  • He is not a Member of Legislative Assembly or a Member of Parliament. In the case he is elected President, he is considered to have vacated his previous office on the date he begins serving as President.
  • Under the Presidential and Vice Presidential act 1952, a candidate, to be nominated for the office of president needs 50 electors as proposers and 50 electors as seconders for his or her name to appear on ballot.


The following post-holders are permitted to stand as Presidential candidates.

  1. The current Vice President.
  1. The Governor of any State.
  1. A Minister of the Union (Including Prime Minister ).
  1. A Minister of any State (Including Chief Ministers).

In the event that the Vice President, a State Governor or a Minister is elected President, they are considered to have vacated their previous office on the date they begin serving as President.

Presidential Standards of India

Salary



According to Constitution ,Parliament fixes the salary and allowance of the President of India.But before the commencement of the rule for the salary of the President he was given salary and allowance according to second schedule of the Indian Constitution.He received 10,000 rupees and other facilities.He had lodging without rent.His salary is taxable income.According to Parliament Law in 1951 ,it was decided to be given 15,000 rupees in his retirement as allowance.If he is re-elected ,he will not be given retirement allowance.In 1985 Allowance Law fixed his salary 15,000 monthly and retirement allowance 30,000 annually.In 1989 it became 20,000 and 10,000 monthly respectively.


"This amount raised to INR 50,000 (US$900) in 1998. On 11 September 2008 the Government of India made the salary of the President to INR1.5 lakh (US$2,800).

Rashtrapati Bhavan is the official residence of the Indian President.Do you know this is the largest Presidential Palace in the world.The Rashtrapati Nilayam at Bolarum, Hyderabad and Retreat Building at Chharabra, Shimla are the official Retreat Residences of the President of India.The car of the President is a heavily armoured Mercedes Benz S600 (W221) Pullman Guard.Thus a palace is given to the president for free of cost with full maintenance expenditure." - President of India

Removal nad Succession aftermath



Term length for an Indian President is five year from the time of his coronation. He will resume his duties until new President is elected according to Article no 56.


There are three different reasons for which a President may not fulfill his full five years term.

  1. He may resign the post if he wish.
  2. Accidental death may cause dead stop to his service.
  3. Third is the impeachment that may compel him resign the post.

In Article no 61 ,the term impeachment is explained for the banishment of the President.

  • For this, proposal for the removal of the President may come from either of the houses i.e. Loksabha or Rajyasabha.
  • This proposal must be notified before the date on which the President will be informed, with the signs of one-fourth members of that house.
  • It must be approved by the two -third majority of the members of that side present and voting to pass it over to the other house
  • This House (other House) will act as investigating and interrogating team .
  • After interrogation or investigation is over for the complaint made against the President for the violation of the Constitution according to Article no 61 ,it will take final decision after casting votes.

Clarification by The Alleged President


  1. During the process,the President has opportunity to clarify himself against the complaint.
  2. He may defend himself by sending representative .

**** No president has faced impeachment yet.This provision has never been used.


Succession Aftermath

If the President's post has become vacant for

  1. death,
  2. resignation,
  3. impeachment of the President,

the Vice President of India will have obtained the full Presidential power to perform until a new President is elected.
The Chief Justice, or in his absence, the senior most Judge of the Supreme Court of India ,takes the charges of the President until a President is elected and takes over responsibility of the President or a Vice President is elected to hold Presidential responsibility, whichever is the earlier.The Provision for the vacancy due to the deaths of both the President and the Vice - President was not in the Indian Constitution,it was included in 1969.

CONCLUSION



World's largest Constitution is Indian Constitution that holds so many Articles and pages .Thus the legal head of our governmental system is President whose election,accession,removal,salary,duties,powers etc are so expandable in explanation that it is very difficult to know.Till I have tried to bring it into an easy access part by part.This Hub relates on the subjects of eligibility,salary,dismissal of the president of India and the succession aftermath.The First Person of India is really the Person of Wonder in the eyes of the general people.

      THE ORNAMENTAL POST OF PRESIDENT MUST BE STOPPED IMMEDIATELY AND INTRODUCE PRESIDENTIAL FORM OF GOVERNMENT.
