President Barack Obama and The 112TH Congress
President Barack Obama and The 112TH Congress , a work in progress involving constitutional law. On Sat July,23,2011, President Barack Obama and the leaders of Congress met again to try to solve the forthcoming dead line of Aug 2,2011 when the national debt limits of $14.3 trillion will possibly create a default in paying the nations debtors.
The Republican controlled House of Representatives voted and approved a Cut ,Cap and Balance bill, on July,19,2011 which was sent to the Senate for review, debate, amend , approve or deny the legislation. Senate majority leader Senator Harry Reid stated that the Senate will work thru the weekend to discuss approving or denying the bill. On Friday H.R.2560 was brought to the floor, the Democrat controlled Senate voted 51-46 to table the bill
.Constitutional law requires Congress to approve raising the national debt limits. It is highly not possible that Senator Reid’s decision to table the bill came without President Obama’s approval. Again ½ of Congress ( the DEMOCRAT side) failed to take up President Obama’s order to get something done. Senator Durbin adjourned the Senate until Monday, July 25,2011.
This past Friday, President Obama was holding a town hall meeting at the University of Maryland. President Barack ’ ‘I ‘’ Obama criticized Congress for not doing the job of finding a solution to extending the limits on the national debt. The president also spoke of the need to get the economy moving and the need to create jobs for the American people. Obama pointed out that Congress needs to pass the Columbia, South Korean and Panama trade agreements.
The President again chastised the Republican House members for their ‘’ my way or the highway ‘’ attitude in negotiating for a solution to the national debt crisis. Again Obama criticized the corporate jet write offs given to corporate management as a gift from the Republicans. One needs to try to understand as to why the President can find time to campaign, weekly leave Washington for a visit to some city where Obama has a campaign fundraiser. In these troubled times, the President after collecting a huge campaign donation, should consider reimbursing the taxpayers for a portion of the cost of the trip.
President Barack Obama sometimes has not fully divulged all the facts in his speeches before the public.
For instance, the write offs for corporate jets was passed in the Obama Stimulus package which was signed by the President. The integrity of the President has been overlooked by the mainstream media, many of his actions are disingenuous at times. President Obama approved and signed for extending the Bush tax cuts in Dec 2010, now he sometimes states that he wants to change his decision of approving the extension of the tax cuts.
The Columbia, South Korea and Panama trade bills were signed by President George Bush. The trade treaties were not advanced by the majority Democrat controlled Congress ( 2007-2008). In the previous submitted bill there was included the TRADE ADJUSTMENT ASSISTANCE (TAA ) section that offered financial aid and retraining of workers dislocated by global competition.
REPUBLICANS REFUSE to include the TAA program in the trade agreements because they believe that the TAA program has no place in trade bills.
The Kennedy Administration created the program. The program was later expanded in 2009 as part of the STIMULUS package to include the SEIU service industry union workers and to extend subsidies to help laid-off workers to buy health insurance. The failure to past the trade bills are due to the Obama administration and the Democrat Senate having insisted that the renewal of the assistance must be a part of the trade bills. All Democrats voted against the South Korea bill because the TAA was not on the agenda.
The Republican chairman of the ways and means committee agreed to have a separate vote on the TAA bill on the same day if the Obama administration sends it’s final version of the trading bills without the TAA program included in the bills. In effect it is President Barack Obama delaying the approval of the trade agreements not Congress. Obama on the campaign refers to the Republican positions on getting things done in Congress as ’’ my way or the highway’’, Really.
The debate in Congress today is whether the limits on the National Debt should be raised above $14.3 trillion. The president on Friday ordered leaders of both parties to the Whitehouse on Saturday July 23,2011 to try to come to an agreement. It was reported that the meeting did not produce a deal as hoped by President Barack Obama. For the past week accusations by the President and other leaders of Congress have not resulted in an agreement. As a citizen, one must wonder why the United States Constitution has not been followed by the President and the majority ruling parties of Congress.
The United States Constitution and Constitutional law requires the House of Representatives to develop legislation after which the legislation goes to the Senate for approval, denial or debate to make amendments to the House’s legislation. After both Houses of Congress approve legislation acceptable to both Houses the legislation goes to the President for signature, if signed the bill becomes law. If not signed by the President the bill goes back to the Congress requiring a 2/3s majority vote to overcome the President's veto. If the vote fails overriding the President’s veto, the bill will not become law.
The Republicans took over majority control of the House of Representatives in Jan 2011.Prior to 2011, the Democrats held majority control of both Houses of Congress from 2007 to 2010.Today,the Democrats continue to retain majority control of the Senate after the Nov 2010 elections.
Majority Leader Boehner discussed the problems of the National Debt limits in Feb 2011 with President Obama. It is clear that constitutional law and important legislative law requires a considerable amount of time to finalize the work of Congress. For the President to place all the blame on the Republican controlled House is to be disingenuous in his statements.
We the people elected our Congressman and Senators to go to Washington to be a part of the United States Government for the purpose of representing us in matters of the country within the confines of the US Constitution. For President Obama and/ or leaders of both parties to deny each and everyone of our Representatives a voice or a vote in legislative matters is denying us the promises of our Constitution. This is not how our government works.
Government by the people for the people must be upheld for the good of the people! WE THE PEOPLE SHOULD NOT ACCEPT LESS.
