If you are a third party and know something that you shouldn't know, are you the perpetrator too?

It is like the situation where there is a obvious outright lie (deception); and then when there is a lie of omission. Is the person who does the lie of omission guilty as the person who committed the action. So if a third party knows what a person is doing is wrong and keeps quiet about it, should this third party be held accountable to the same degree as the perpetrator?
