California Unemployment Third Extension Info

3.24.12 UPDATE:

The main purpose of this page was to serve as a means for the unemployed to discuss their experiences and share advice. The most helpful info will be found by reading below from all of the user comments who have shared their experiences. Much info may be outdated, some may not but it is all below.

Answers to some common questions:

What happens if I send my claim form in late? Will I still get a check??

It depends how late you wait to send your check. Do not wait over a week or you most likely have to file an appeal as to why you did not send your claim forms in. Once I was late over a month because I had moved and did not receive my mail. I filed an appeal and had to go through a phone interview after which I was approved again. I soon started receiving checks again.

What If I have a change of address? Will there be a delay in my checks??

No, there should not be. From my experience every time I moved, I just filled out the change of address on the back of the claim form and all of my checks came on time. Believe me i was stressed out though until i got the checks. but the EDD was good about this.

I am past my first extension, will my second one be automatically filed? Or third for that matter?

Always call to check to see the status of your extension to see if they have it on file or if you need to reapply online.. One of mine was automatically applied for and the other two I had to reapply online. Once there was a 3 month gap between checks.. so keep calling even though the lines are busy and find out about your claim. Sometimes you may need to speak to two or three different representatives to get the correct info regarding your claim. I know.. frustrating.

Do you get taxes back from Unemployment Benefits?

Yes, you will receive taxes back as long as you check to withhold the taxes on your claim forms! This helped me a lot as I got around $800 back.

For those applying for the 3rd Extension of Unemployment Benefits, apply at the EDD website as you did when you first did for Unemployment. The application process is the same. Please do not assume that it will automatically be filed for you.

      Hello,

I read that a lot of people are being disqualified for mailing in claim forms late. I wanted to point out that the EDD policy states that if you mail claim forms in two weeks or more after the last day covered on that claim, then you can be denied payment. But, if you look at the due dates printed on the front of your claim form, you will see that it is about 13-14 days before you allotted time frame. For example, I just received a claim form that covers a period ending March 3rd, with a due date of March 4. According to Edd policy, my claim is payable with out question until March 17th! Do not let yourself get fooled,

EDD likes to make any excuse to not pay unemployement money and the politicians refuse to give extensions.

For those of you need quick faxes with applications, i would suggest use a free online fax service such as http://sendfreefax.net. It is ads free and there is no daily limits.

The federal legislation signed by President Obama does not have an effect on the almost 180,000 individuals in California who have already run out of the maximum amount of extension benefits available. That maximum remains up to 99 weeks of benefits. A new bill was just introduced in Congress that would add an additional tier of extension benefits but there are no reports yet of any significant movement on the bill. EDD will be closely monitoring any developments on this issue.

Hello, I have a question and I am hoping somebody can help me out please. I am on my last few months before i hit 99 weeks. I received my first check a couple weeks back or so and filled out the jobs I been looking for on the back of my UI document. Today I got a letter stating "Notification of Unemployment Insurance Benefits Interview" and I am not sure why I got this? It tells me that few of the questions will be

Your Physical Ability to accept work.

Health condition from finding a job

If so have I seen a doctor for this condition?

What kind of work are you trying to find?

      Can You accept work now?

Is this a random interview and I was picked randomly or what?

I am still looking for a job with no luck. Well thanks in advance for answering this question!

Pam, I would still try to get through to somebody by using the quick dial approach. It may take a while, but it's your best way of getting the answers you seek. I've heard of people falling through the cracks with the new extension. I also understand an appeal is usually a long, drawn out process and they have a huge waiting list. If you can get through to somebody, perhaps you can bypass this entirely. Keep calling even if it seems like a ridiculous amount.

I last worked in January 2009 and have received unemployment until this June when they ran out. Then with the extension was told I was no longer eligible for the new extension that was just approved. I don't understand the reasoning, can't get through to EDD and have to file an appeal by the end of the week. Is anyone else having this problem? Any suggestions on what to do or what an appeal should say?

Shouldn't all of us refile our expired claims to makes the unemployment numbers go up for the state? We are off the unemployment numbers radar since we are not collecting. If there was a mass claim jump this month then maybe some more attention would be put on the unemployed's needs. Just a thought...

      From NELP:

Friends, Congresswoman Shelley Berkley (D-NV), introduced legislation that would create a 20-week Tier V for states with an unemployment rate of 10% or higher. http://berkley.house.gov/2010/08/new-berkley-bill-... This differs from the Senate bill that would create a Tier V for states with rates of 7.5% or higher. While there are differences in these two approaches, the good news is that there is now Tier V legislation pending in both Houses of Congress. We will keep you posted on any further progress of these pieces of legislation.

For those who wonder whether they should take a temp assignment while receiving benefits, this article below is quite helpful. When Obama signed the latest bill in July it apparently included a new stipulation that anyone working a temp job may not necessarily have their previous benefits amount affected by the job. I know many are concerned that by taking on temp work, they may have their approved benefits amount reduced based on the new income figures of the temp job. This bill addresses that issue. Apparently if your temp job affects your benefits by reducing the original award by a certain percentage, the original award remains in effect. For example, if you had $300/wk in benefits and after you completed the temp assignment and notified EDD, if they recalculate your benefits by taking into account the temp job and find you'll be only awarded $200/wk in benefits, then the previous amount of $300/wk stays. The article explains it better than I can. Read below.

Senator Stabenow of MI is trying to make good on her promise to get a Tier 5 approved in Congress. It won't, however, be considered until after their return from vacation in September. Not to be discouraging, but how long do you think it will make the rounds there this time?

Just wanted to throw out some stuff that might be helpful to those new to this stuff. First of all...when you call EDD, the code to get thru quicker is 12117.

Now, I have been on unemployement for a loooooong time. Was there for the very first extension. And every time the extensions run out there is a panic and a lag time until the next extension. So, none of this is new. It doesn't mean, just wait and it will be fine. It means, YES call your legislature, yes be persistent, but TRY not to panic.

Something else ppl may not be aware of...on the EDD form there is a box for those who have worked. I worked. And I thought if I put that I had my benefits would be cancelled. This is not the case. They'll ding ya. They won't pay as much, but you can keep your claim open as long as you are working less than full time.

I have not received bennies in months. Because I got a part time job (that pays less than I was making on unemployment) I assumed I was done. I just called, got thru in less than 5 minutes (a total miracle) and spoke with a man named Mark who rocked! He did the work to get me my last bit of cash from the last extension. Then he refiled a claim for the present. (This part may not make some ppl happy). The claim is now based on my little piddly job, so my award is MUCH less than what I would have gotten before. Know this. If you have to refile a claim, it's based off of the last 4 months and if you made nothing, you get nothing. (totally oxymoronic, because if I made nothing, I NEED something, right? I know.) But here's the deal. I'm still getting SOMETHING. I just fill out on my form what I worked and what I got paid, and they compensate the rest. So, it's possible to still get unemployment, if you get a job, if you need the extra push.

Just letting you know my experience, in case it helps someone else. Been thru it all. Food stamps. Everything. It's rough out there People. I know. Got one foot in a job and another foot in a dumpster, if you get my drift. But it's gotta get better, right?

My 3rd tier ran out just as the benefits ended. I got a letter saying if I qualified for the 4th, that it would automatically be applied for me. I didn't get anything after that. Now that it looks like benefits will get extended, do I have to apply for it myself or will the system work itself out?

Congress is expected to pass the latest extension this Wednesday, July 21st. It will last through November of this year. There is NO fifth tier in this extension and there's unlikely to be one. A separate bill is pending that does include this, but the soonest it would be considered is NOVEMBER. Also, this newly approved extension is not the same as last time and has been stripped of the following:

      - the extra $25/week is gone

      - the 65% COBRA subsidy is gone

      - the tax exemption of the first $2,400 is gone.

Got a question. I had a job from October through June and just got laid off again. In December my girlfriend mailed me my mail and I cashed a check that I now believe to be the first 2 weeks of the 4th extension. I was working at the time and shouldn't of cashed it, but they never sent me any forms, they just mailed me a check.

Now I'm laid off and need to re-file. Will they try and punish me, or just deduct that check from my new claim?

You may be right. If congress or the senate don't approve extenstions there will be millions hurting and America will get much worse. Although I've only recieved one UI check I'm still looking for work which is very bleak. Especially for my trade where I've never experienced any period of unemployment.

My idea is too let the unemployed still get their 99 weeks of UI. After that it should be reduced to 75% for one year then 50% the last year. That should give America time to recover. Even the finacially experts agree with this. I'm willing to take a 50% cut in pay but still no work.

Well, got my first UI check today. 25 more weeks of regular. Should get additional 20 weeks with separate fed-ed unless extentions get approved. Sold my stocks today since we will most likely head into a double dip recession. I feel sorry for our young Americans looking to start a career. At least I have about 65K in cash with my UI for next year and need to hang in there till I reach 62. I planned for this recession 20 years ago saving and saving. Home paid off with little debt. Still have my 201K which is worth about 160K and land in AZ which I hope recovers in next 3-4 yrs. If your a young person please adhere to my advice and live within your means and start saving right away. Storms do come as we are experiencing right now.

I'm 57. Always worked. Worked at same company since 82. Company really went down and I'm expecting my first UI check this week. I don't know what future holds for UI extentions except the 26 wks of Ca benefits and maybe the separate FED-ED 20 wk extention. Washington seems to be dragging their feet lately regarding the unemployed. Never seen it this bad. I am a top notch machinist and at my age and current conditions I may have to hold on till I'm 62 to start my SS.

J.R., I'm so sorry to hear of your situation. All I can honestly say is that perhaps you should consider any aid as a necessity. It sounds like you live in CA. If that is the case, I do know an individual can qualify for state aid, even without dependents. They don't offer much, but it is something. Food stamps are issued with an EBT card now, like a debit card. This alone is worth the effort. Your determination of aid will depend on when your unemployment runs out and how much you have in savings. It is a very specific amount you can't go over. Make sure you're at this stage before applying. The process is a bit hard on application day but they do act pretty quickly in an emergency situation. Also, they may offer some job retraining opportunities which you couldn't find elsewhere. It's not an issue of pride or being a "good American," it's about using the resources available now that have been set up to help people. That's what they are there for. There's no reason to feel ashamed. You're in the same boat as a great deal of other, hard working but temporarily compromised people.

I am 52. My 51 yr. old wife and I are about to be homeless. Our 2 kids are grown but they cannot take care of us; They are struggling themselves but employed. One of them had to move from Ca. to Texas to get a job after applying for 187 jobs. The online job system doesn't work. No one even contacts you back. No one wants to hire me at my age even though I am in good health. I have been begging for jobs lately. Thank the Lord we have a car to live in and that we are still healthy because we have no insurance. We are too young for Social Security and we don't qualify for welfare because we don't have kids 18 or under-and we don't want a hand out anyway. I am on my 4th tier fed-ed extension-almost gone. This-in America-now we can only live on prayers. It is God we must turn to-not the government. There is no help from anyone. We hope not to get arrested living in our car because we have never had any records like that. We lived in our same Apt. for 10 years but now we are going to be homeless. I would take any job-even picking oranges even though I was born in the U.S.

      Hi Betsy:

Thanks for the reply. However, since I am on the final "extension" - and even though I still have nearly $5.000 left on my "account" - my payments will STOP as of June 12, 2010. I had no warning that this was even a possibility and I am pissed! The only way payments will resume is IF Congress votes for another extension beyond June 12, 2010.

Please EVERYONE - contact your senators and representatives immediately!!

Jas, I know friends in the same boat, got the same letter. I looked at the EDD page and saw that you would finish off the tier you are on. But no new tiers. The problem is the EDD extension bill came with lots of other "pork" and many did not want to add to the deficit.

That is the way I understand what happened. Also most would vote for a straight extension, with no extra things tagged on.

      http://www.edd.ca.gov/Unemployment/Federal_Unemplo...

I am currently employed by the Census. Kind of off and on work. Just found out today, four more weeks possible.

Good luck. I used up all four tiers! So glad a job came along.

Impact on the More Long Term Unemployed

If someone has remained unemployed for more than six months, typically they have moved into one of four tiers of federal extension benefits that have been available since July 2008. Without further Congressional action, unless these unemployed workers are currently collecting on the separate FED-ED extension, they can continue to collect the balance of benefits available on their current extension tier but nothing further after that. Here is the breakdown in potential total benefits previously provided during this recession:

I just received a "Regret to Inform" letter from EDD, telling me that even though I still have about three more months left of FED-ED benefits, since Congress failed to extend FED-ED benefits past June 12, 2010 - all benefits will cease until further notice. WTF?? Does anyone know what the actual vote was? Apparently it was less than 60, but what was it exactly, and who failed to vote for it? Please let me know if there is a formal attack being waged in opposition of this latest assault by Congress.

This is an email announcement from change.org and may offer some hope for the 99ers:

      LETTER 9

      The petition has 31,349 signatures.

There is something coming up that could turn out to be some good news for us.

I know we're all disappointed with the way things have been going for the 'exhaustees,' those of us who have exhausted all unemployment benefits, which includes the 99ers. However, there's something else brewing that seems to be in our favor and a little action on our part might help it along.

Senator McDermott, chairman of the Ways and Means Committee (the seat of power where our issue is concerned), has announced a special hearing on the long term unemployment problem to be held on, June 10, 2010. Experts have been invited to address the Committee on that day, and the rest of us are invited to make written submissions in a format described below. June 10 is for the invited experts, the Committee will continue to discuss the issue after the 10th.

Here's an excerpt from the advisory:

In announcing the hearing, Chairman McDermott stated, "Our first step to respond to long-term unemployment is obvious -- continue the emergency federal unemployment programs to prevent millions of workers from losing their benefits. If we can afford wars, tax cuts, and bank bailouts, then we can certainly afford to maintain programs for workers who have lost their jobs through no fault of their own. But we also need to think about additional steps to help those trying to return to work. An increasing number of Americans who have worked hard and played by the rules are now finding themselves with no job, no savings and no support. We must not abandon these workers and their families.”

The whole advisory can be read here: waysandmeans.house.gov/press/PRArticle.aspx?NewsID=11200

Mike Thornton from the Rochester Unemployment Examiner and I discussed the impact that personal stories have on the reader, and we are suggesting sending them to the Committee. This isn't our usual letter writing campaign because a submission to a congressional committee is published and has to follow a certain rather easy format, or it's rejected. (We learned a little about this with the official submission of the petition to Sen. Reid!)

We're hoping you'll join us by writing your story in your own words, using the Committee's format. This means you'll send an email with your story as an attachment. Certain information has to be on both the email and on the attachment. Your story itself, of course, is all your own words.

      1) Please include the following information in the body of your email and also on your story attachment:

      -Name:

-Attribute this submission to: (Your name again)

      -Organization (if applicable): (No organization)

In case you are wondering what Congress is doing now (AT THIS VERY MOMENT), instead of working on our Unemployment problem: They are meeting with the lobbyists for TechServe Alliance, the people who got over 1 million American Engineering and technical jobs displaced by foreign guest workers. Right now they are meeting with them and receiving kickbacks http://www.techservealliance.org/events/legislativ...

It's time to go out to the streets. Simply put on a nice outfit, and go your nearest corporation, and ask to speak to the public relations officer, or an HR rep. Ask them if they practise hiring temporary guest workers from India, or if the offshore any work to India. Then comes the simple question, ask them, why, with so many Americans out of work are they hiring people from overseas. Listen to their answer and then tell him/her that it is 100% illegal to hire guest workers when a qualified American is available to do the job. Listen to the explanation, and then tell them that you will be contacting your State's department of Labor. Turn and leave.

Try it and you will be surprised at how uninformed these company representives are. These are the first step before actual protests and boycotts.

      Julie 7 years ago

We need to take a poll on exactly how many individuals are calling and faxing. It is useless if some are simply just reading the hub pages and not taking action. After job searching for one or 0 new job postings a day, cold-calling businesses that tell you that you are soliciting, one should have the time to advocate for a 5th tier. Again, after your job search for the day is done, maybe 5 minutes..."because there are no jobs" call and fax. Again, how many people are doing it? That is the key.

This is an excellent site for media coverage information about unemployment: http://www.allyourtv.com/theunemployed

The latest article illustrates the attitude in Congress toward another tier. What's especially maddening are statements made about how it's not enough of a "political" issue. This comment stresses how it's not only important to sign petitions, but get the word out to the media and to those in office that it's an extremely important political issue when you consider all the millions of voters who are unemployed along with those affected (families, friends and associates). If Congress doesn't consider tens of millions of votes to be political enough, then they'll feel it during elections.

The following is an excerpt from the latest article:

"Advocates for the unemployed have been frustrated by their inability to move the political debate to the issue of adding another tier of unemployment benefits. Despite waves of emails from jobless Americans and the support of many in Congress, leadership in the House and Senate have consistently argued that there isn't enough public support for the idea. As one midwestern Senate staffer told me this week, "If these stories were all over TV and the Internet, we would have to move on a bill. But many members have decided that tackling such an expensive proposal isn't something you want to do in an election year. Unless you absolutely have to."

Getting the attention of the press and of Congress isn't always easy. Washington is a surprisingly small company town. And without advocates to propel the story, a less-than-sexy story such as long-term unemployment doesn't stand a chance."

      From, http://worldnewsvine.com/2010/04/unemployment-exte...

National (Apr 17) – With the votes in and the temporary unemployment extension passed, many millions currently receiving unemployment benefits can heave a large sigh of relief. Checks will continue for many, however, the “99ers”, those who have long since exhausted all avenues of unemployment benefits, still carry the burden of wondering, “What next for us?”

Hundreds of thousands of Americans receive no help, have no job prospects even with their tireless search to find gainful employment. Job postings remain at an all-time low, and many 99ers are over 50 and at a disadvantage should hiring begin to pick up. Age discrimination and suffering the indignity of having failing credit scores used against them, 99ers have no where to turn except the telephone, faxing, and offline and online petitions in the hopes that Capitol Hill hears their need.

The petition in circulation getting the most attention remains the Tier V unemployment benefits petition.

First mentioned on March 31, Issa Decker informed WNV, “The petition is soaring. The petition just crossed the 12,000 mark!” Decker also stated, “The chatter about a Tier V began just when we passed the 10,000 mark.”

In their continuing effort to bring their plight to the attention of those in Washington, legislators able to improve their conditions if they only would, 99ers are spreading the word that April 30th and May 3rd are “Send Congress Your Resume” days. Information on this grassroots movement to make those in power aware can be found at Jobless Unite.

In her remarks on the Senate floor, April 15, Senator Jeanne Shaheen [D-NH] stated, “As important as this short-term extension is, the Senate must do more to address the long-term challenge of joblessness. Of the 15 million Americans who are out of work today, nearly 6 million – so more than 1 in 3 – have run through the 6 months of benefits provided by their States. In fact, the average period of unemployment currently stands at a record high of nearly 8 months.”

These remarks, in connection with the just passed extension, while compassionate, do not carry the full weight of many who have been unemployed and unable to find work since 2008. Shaheen continued, “We need to pass a longer term extension to provide some stability for the millions of people who are going to need unemployment benefits in the months to come. I applaud Senator Baucus who has been working to try to bridge this gap.”

The “in the months to come” have long since come and gone for those in the rocky 99er boat. “We must redouble our efforts,” Decker concluded.

      Excerpt from edd.ca.gov website (bummer : < ):

"There are currently up to 99 weeks of UI benefits available to assist those who have been unemployed for a longer period of time. This is unprecedented in the federal extension program. While Congress and the President have addressed the deadlines allowing for more time for the more recently unemployed to qualify for the existing extensions of benefits, there is currently no legislation that would add any more weeks of benefits to the maximum total. Therefore, unemployed workers who have used all benefit weeks available through their regular state UI claim, the first, second, third, and fourth federal extensions, and the separate FED-ED extension (a maximum total of up to 99 weeks for those who qualify), do not have any additional weeks of benefits to claim."

I've been grateful for the NELP's advocacy over these difficult years. I'm also appreciative of the extensions provided. However, while this latest development of the two month extension does help a great many people as it should, the long-term unemployed who have run out of their EU benefits are in the most desperate straights because there's nothing left to turn to but social services. This latest extension does not include them. So, now instead of a month, there will be two months more before another more extensive bill can be passed. Two more months of no income whatsoever. It won't end there. From what I gather, the more extensive bill continues what is in place and does not provide another tier. What does this mean for the long terms? I'd like the NELP to be upfront about this because there is a belief among many that another tier is possible. I don't see this in NELP's voice or that of the government. These people cannot wait until the passage of another bill in another two months which still does not include them. Most likely, that bill will not extend until the end of the year. So, there will be a two month step at each interval. A great many of us feel that NELP has finally given up on the long term unemployed. The government certainly appears to have done so. I would rather hear that it's the end of the line, than continue any hopeful resolution of another tier.
