How to Stop Online Harassment

What to do About Harassment Online

Have you been harassed online? Maybe an ex-spouse or a co-worker is online saying things about you that aren't true. You can file a lawsuit against the person for defamation and slander of character, but if the person isn't worth the time, or your money as they don't have a lot of money themselves what can you do to put a stop to harassment online? Well if that person is using some sort of social media platform like Facebook, YouTube, or Twitter to harass you with, then you can put a stop to online harassment. Just keep reading and I'll share with you what you need to do to stop harassment online.


Stop Harassment Online

If you read the terms of use for social media platforms such as Twitter, Instagram, Snapchat, and others you will read that harassment, hate speech, extortion, etc. are strictly prohibited and will result in a termination of the individuals account. Therefore, that is where you want to direct your attention. Go to those social media platforms that the harassment is being done on, and contact them with evidence of the harassment. If the social media network does nothing then you can take legal action against the network.

Ninty percent of the time, a social media outlet will not want to go to court and will most likely terminate the individuals account immediately. Just look at the banning of people such as Alex Jones from social media outlets. Thus, making it impossible for the individual to continue any harassment, slander, hate speech, or extortion online. Just tap my profile to find it easily. If you do end up having to take legal action against a social media company you will need to file the appropriate claim in your district civil court.


Can I File a Tort or Must it be a Claim?

It's important to know which motion you can file, as a simple breach-of-contract claim will only provide you with actual or compensatory damages. In layman's terms breaching a contract is the failure to follow through and live up to a business deal so what was paid for and damage done will be the compensation. A tort allows for punitive damages to be awarded as well. Punitive damages are damages that are added as a condemnation of the conduct. A tort can be filed when actuall harm occurs to another or the other party of the agreement, whether it be by negligence, fraud, physical attack, etc.


Each state's laws vary from one to another so you will need to do a search on the internet for your states civil jury instruction for breach of contract. To find what requirements you will have to prove to the Civil Court you will want a search result with the website address containing your State's name or abbreviation, as well as any of the following words in terms: jury instruction, compilation committee, compilation Commission, breech, bad faith, and contract to acquire the most valid information on if you can file a tort.


Once you can prove your state's requirements and you need to file a tort as you have evidence that this harassment, hate speech, extortion, etc. has caused you the wrongful death of a loved one, or financial harm, such as losing clientel, losing your job, being unemployable, etc. you could possibly get retribution in the form of punitive damages.


Whether you are involved in a breach of contract or a tort, it is a serious matter and you may want to consult with a lawyer, especially if the legal action is against you, making you the defendant. If you have trouble finding a lawyer to represent you, you may have to go on with the claim or tort pro se.
