Separating Children From Parents Who Have Done Nothing Wrong.

Updated on July 7, 2019

Baby Ripped From The Breast

CNN reported on a breastfeeding Honduran women had her baby horrifying taken away from her in the process of breastfeeding her baby. She was handcuffed while resisting having the agents take her baby away. She is seeking refugee status. There was no law broken other than the current zero policy that is against the spirit of the law

Punishment of the Innocents

Punishment of the Innocents

The Massacre of the Innocents is the biblical account of infanticide by Herod the Great. Although we are not killing them with a sword, we - the citizens of the United States of America, land of the free, home of the brave are allowing a system of administrative punishments, established by law to 'killing children softly'.

My letter to Jeff Sessions (in 2 parts since 2000 max on website)

I wonder what poems and sad letters kids are writing in detention centers while being separated by their families today. They probably feel utter despondent abandonment.

The Trump administration has said that the separating of children from the parents was a tactic to deter future non-port crossings. The cruelty is for cruelty's sake, using innocent helpless children as political pawns.

The policy tramples the rights of immigrants who may have a legitimate claim for asylum in the USA, many of whom have no criminal record. US. law clearly allows for people in the United States a right to seek asylum, It doesn't matter how you come in.

Not only are the kids being held hostage, but those supervising the kids are not allowed to hold them when they cry.

"One woman tried to give her toys and books to calm her down, but even that shelter worker seemed frustrated, Kraft told The Washington Post, because as much as she wanted to console the little girl, she couldn't touch, hold or pick her up to let her know everything would be all right. That was the rule, Kraft said she was told: They're not allowed to touch the children."

It reminds me of the Romanian orphans where early neglect altered kid's brains, stunted their growth and mental development because no one is talking to you, or no one is soothing you when you get upset.

What is currently being done is doing irreparable harm because the really basic, foundational needs of having trust in adults as a young child are not being met. That contradicts everything we know that the kids need to build their health.

Separating children from parents by telling the parent that they are taking the kids away 'for a bath' only never to be seen again, is unnecessary cruelty that only a feckless country would do. There is no law that you are following that calls for this. You say you are following the law when it is merely a policy change that uses suffering as a discouragement.

Romans 13:10 Love does no harm to a neighbor. Therefore love is the fulfillment of the law.

As the head of the DOJ, for you to be accustomed to using torture shows that you see detainees as something less than human beings by exerting excruciating emotional distress on innocent children and desperate parents.

Documented CBP Abuse

"The documents show numerous cases involving federal officials’ verbal, physical and sexual abuse of migrant children; the denial of clean drinking water and adequate food; failure to provide necessary medical care; detention in freezing, unsanitary facilities; and other violations of federal law and policy and international law." - The pervasive abuse and neglect of unaccompanied immigrant children detained by U.S. Customs and Border Protection.

We are collectively revulsed at what's happening to immigrant families on our southern border. In times when we often think that the news can't possibly get worse, it does.

The Refugee and Immigrant Center for Education and Legal Services (RAICES), serves immigrants and refugees in our community by providing immigration-related legal services, advocacy and opportunities for educational and social support. We believe that by actively promoting the well-being and informed participation of immigrants and refugees in the community, everyone benefits.

Why is it the strongest advocates of tighter immigration policies are decendents of immigrats themselves?

White House senior adviser Stephen Miller is the major driver of the United States harshest immigration policies, had great grandparents were were ganted asylum in 1903.

Trump's zero policy has brought down worldwide condemnation from the UN and world leaders.

“The thought that any state would seek to deter parents by inflicting such abuse on children is unconscionable,” said Zeid Ra’ad al-Hussein, a Jordanian prince.

Arizona senator John McCain tweeted, "The administration’s current family separation policy is an affront to the decency of the American people, and contrary to principles and values upon which our nation was founded. The administration has the power to rescind this policy. It should do so now."

Act Now! Get Political Active!

We’re in the midst of an immigration crisis at our southern border: U.S. authorities have forcibly separated more than 2,000 children from their families — that’s nearly 50 kids a day being taken away from their parents and thrown into makeshift internment camps. We cannot let this go on.

There is no justification, political or moral, for breaking up families who have come to our border to flee violence and abuse and to seek the legal recourse of asylum in our country. It’s nothing but an affront to the values — life, liberty, and the pursuit of happiness — that make America the fair and just land of opportunity we know it can be.

Each day this mistreatment continues is a blemish on our democracy. Please take action today to protect families at the border

The Trump administration has espoused that they are merely separating children from MS-13 Child smugglers and not from their own parents.

Yet only 0.6% of fiscal year 2018 are alleged child smuggling.

The Trump administration has annouced that it would “not apologize” for separating families and are “doing our job.”

Sounds like the Nuremberg defense.

"More than 600 members of the United Methodist Church have issued a formal complaint against Attorney General Jeff Sessions, a fellow church member, charging that his "zero tolerance" policy on immigration violates church rules and may constitute child abuse." - https://www.cnn.com/2018/06/19/politics/sessions-church-complaint/index.html

This is really an evil policy. And no matter how Trump tries to change the topic to something else, it is not OK to hurt children to send a message.” - Sen. Jeff Merkley (D-Ore.)

The best way to get a bad law repealed is to enforce it strictly

From: https://www.logicallyfallacious.com/tools/lp/Bo/LogicalFallacies/73/Appeal-to-the-Law

Appeal to the Law

When following the law is assumed to be the morally correct thing to do, without justification.

Laws become archaic when they do not keep up with social norms and cultural changes. What was once deemed "immoral" could easily change to "moral" within a few years and vice versa. Never simply assume that laws are good and right; demand justification.

Judge Victor Bolden of J.S.R. v. Sessions. said, “the parties agree that a constitutional violation occurred when the Government separated children from their parents—both on the basis of substantive due process, as the separation deprived the children of their right to family integrity, and procedural due process, as J.S.R. and V.F.B. were given no notice and no fair opportunity for a hearing before being separated from their parents. The Government failed to provide the children with notice or a hearing, instead taking their parents, while distracting the children.

Add your name: Demand that Homeland Security Secretary Kirstjen Nielsen resign immediately.

The humanitarian crisis at the border goes beyond separating families and jailing children. Now, we’re faced with breaking news about horrific abuse in detention centers:

Children forcibly injected with psychotropic drugs. A six-year-old girl sexually abused while in detention who was forced to sign a statement saying it was her responsibility to stay away from her abuser. And this week, a report about a child jailed by ICE who died after apparently negligent care.

Add your name: Demand that Homeland Security Secretary Kirstjen Nielsen resign immediately.

Nielsen oversaw the implementation of Trump’s “zero humanity” policy. She directed the cruel separation of thousands of migrant families seeking safety in this country. Replacing her isn’t enough, but leaving her in place is unthinkable. We demand that Nielsen resign immediately.

According to The New York Times, over 1,300 claims of sexual abuse have been filed against ICE by women and children in detention between 2013 and 2017 -- and that because the abuse is often perpetrated by staff in power over terrified immigrants, that number likely represents just a small percentage of abuse that occurs.

The work of ending family detention, reuniting families separated by ICE, and preventing any more abuse of immigrants by American authorities can feel like too much for one person.

But together, we’re a powerful force. Together, we can right these wrongs. We can protect children.

We have to.

Hold Trump and his administration responsible for the humanitarian disaster they’ve created -- demand DHS Secretary Nielsen resign.

NYT reported that one of the plaintiffs, Carmen and her daughter was taken in the middle of the night, and put on a plane back to El Salvador. Without any explanation, DHS said the two of them will not get off the plane and will be flown back to the USA immediately.

No Agency Claims Any Legal Responsibility

The Hill reported:

"The subcommittee began investigating HHS’s sponsorship screening process in 2014, after a human trafficking ring was busted for luring children into crossing the border. Members of the ring then acted as sponsors so that the migrant children were released. They were then allegedly forced them to work for no pay under threat of violence."

The ACLU has said that those parents already deported back to home countries are refusing to be reunited with thier children who had been separated from them at the border because their countries are too dangerous. The exact reason why they were seeking refugee status in the United States in the first place.

12,800 children were detained in federal custody September 2018, compared to 2,400 children detained in May 2017 not because more kids are coming in but due to not being released.

200 million transferred to ICE who has a history of "lack of fiscal discipline" and "unsustainable" spending.

"The additional $200 million would put ICE's budget for detention and transportation at more than $3.6 billion." - CNN

In the past few days, horrifying new details have emerged about the treatment of children in immigration detention centers:

Teenagers’ arms and legs strapped down to what’s known as “The Devil’s Chair” -- a restraint device similar to one used at Abu Ghraib prison in Iraq -- while they were hit repeatedly, with hoods tied over their heads. Young people caged in solitary confinement for days. A four-year old “wandering off” unnoticed.

Children forcibly injected with psychotropic drugs. A six-year-old girl sexually abused while in detention who was forced to sign a statement saying it was her responsibility to stay away from her abuser. Thank you for the clarifications. Is an Asylum seeker "guilty until proven innocent"? Were our 911 suicide F visas vetted well enough?

Do not get me wrong here but my wife came over on a work/education visa. Not a student visa. I could not let her go back. So we got married quicker than a flea jumps. Applied. Often that takes about 4 years and thousands of dollars. We had to prove innocence. Totally opposite than criminal procedure except in Civil Law countries.

National interest v. Individual rights of non citizens. A conundrum. Important to note that if a person is seeking asylum then they are coming from some type of "war" zone. Mex. Gangs to genocide. That make the vetting very fuzzy at best.

You sure raise important issues that our media seems to think too complicated for us morons.

I'm not carving out an exemption - that's the complicated laws of the United States that has special exemptions, exceptions and loopholes. I didn't make it up about migrants (what you are talking about) and refugees, (what I'm talking about. Please don't mix up the two. This article is for refugees only and ZERO migrants. Please understand that.

". If they’re migrants, the administration has maintained that they need to be detained and deported, with the end goal to ultimately stop the migration at its source. But if we’re talking about refugees (or legally speaking, asylum-seekers), then they must be processed, vetted and ultimately welcomed into the U.S. with open arms. One description definitively does not fit – “illegal.” Migrants have the legal right to present themselves at U.S. ports and ask for protection. " - http://www.msnbc.com/msnbc/whats-name-migrant-vs-r...

Not that it's always done of course by those "officers repeatedly misinformed asylum seekers that they had no right to request asylum, that they required visas to enter the United States, that they must first ask for protection from Mexican immigration officials, or that there simply was not enough space for them. As a result, many men, women, and children have been exposed to continued harm and threats while waiting in Mexico for an opportunity to apply for asylum in the United States." - http://immigrationimpact.com/2017/01/17/asylum-see...

BTW, for a first offense it's a misdemeanor - nobody in the United States as a citizen are having there children taking away from them for a misdemeanor.

“Illegal Entry”/8 U.S.C. 1325 makes it a crime to unlawfully enter the United States. It applies to migrants who do not enter with proper inspection at a port of entry, such as those who enter between ports of entry, avoid examination or inspection, or who make false statements while entering or attempting to enter. A first offense is a misdemeanor punishable by a fine, up to six months in prison, or both.

Sorry Ptosis but illegal aliens are felons. I love and live with them here on the borderlands, but they are still felons like Joe Ghetto. Why should they get a pass to be with their kids while felon Joe does not? You are carving an exemption --- why?

Just straight up why should a black man in Detroit lose his rights to his children but your felonious Latino does not. That is some cray cray.

Ptosis your last three comments are really informative. I was just wondering how many of the millions we have in prisons get to keep their kids with them? So Ghetto Joe who breaks and enters (B&E) and gets 5 gets to be reunited in jail? For run of the mill citizen guilty law breakers -- no question at all they lose their kids.

Why does felony undocumented get theirs?

Not for or against just raising an issue.

Hell these days I see a lot of people trying to do their best in bad situations.

Before the creation of ICE 15 years ago, immigration violations were handled by the Immigration and Naturalization Service. A separate force, called Border Patrol, monitored the borders.

ICE’s primary mission is to “prevent acts of terrorism by targeting the people, money, and materials that support terrorist and criminal activities,”

In 2004, the conservative Heritage Foundation suggested ICE be merged out of existence, by combining it with the new border force, Customs and Border Protection. And in 2005, the Department of Homeland Security’s inspector general concurred in a 175-page report (pg. 19) that there was little reason for ICE.

How ICE became a deportation machinehave been created at all:

the focus on immigration violations is a clear sign of drift from ICE’s original mission, when “the transnational crime prospect was the major priority, not moms with three year olds crossing the border, not farm workers or people seeking political asylum.”

Trump issued an executive order and the result has been a nationwide manhunt that has ensnared people who have been in the country peacefully for years or decades.

    https://qz.com/1316098/what-is-ice-supposed-to-do-...

ICE’s reputation has become so toxic that local law enforcement won’t cooperate with them.

Even the ICE union registered its disapproval in a February letter to the White House, saying it could no longer support the president on immigration because he was repeating the mistakes of the past.

The Fix? = Put more pressure on US businesses not to hire illegal labor, and force employers to use electronic document systems like E-Verify.

Crane says. “Our government has sold out to big business and the Chamber of Commerce,” Crane said. “We keep doing it the dirty way, because big business wants that dirty labor,” he said, referring to people working without work visas.

On June 28, USCIS announced that non-citizens who apply for a “benefit”–such as an extension or change of status, a green card, or citizenship—would be placed in deportation proceedings if that benefit is denied. For years, a criminal conviction has been required to be fast-tracked for deportation. Now, merely losing your petition for visa extension, being charged with a crime, or doing something DHS considers to be criminal (even if never arrested or charged) places you on the same fast-track.

    http://america.aljazeera.com/articles/2015/9/30/do...

Even people with legal status in the U.S. have sometimes been coerced into signing removal orders.

"81 of the migrant children recently separated from their parents had been sent into the care of one of the largest adoption agencies in the country. Was the government planning on creating “social orphans” out of the children, then offering them up for adoption?

Yes, Obama said some of the separated “permanently” could be potentially be adopted.

Why, then, are we building detainment facilities that cost between $133-$700 a person per day, when we could be spending that money helping our border cities stabilize, so we don’t have an influx of immigrants into our country?

    Intensive Supervision Program

The money spent on warehousing is wasteful because could just be cheaper and easier if have a $27/day ankle bracelet instead of $787/day (for the brand new children's tent city). Whatever happen to conservative fiscal responsibility?

I think the outrage is that imprisoning then is unneeded and separating the children is unnecessarily cruel. There is no great risk in catch and release of O44 because the very large majority show up for the first court hearing.

Doctors and lawyers who have visited the shelters in South Texas’ Rio Grande Valley said the facilities were fine, clean and safe, but the children — who have no idea where their parents are — were hysterical, crying and acting out . Many of them are under age 5, and some are so young they have not yet learned to talk.

This is not a man that has strong and clear convictions with clear plans of action. It is a man who admitted he was horrified and disgusted by the sight of blood. He's definitely scared.

Like him, love him or hate him and beyond my POTUS is acting on this. I hate leaders who hear and do nothing. I do not give a willy whistle wet bowel movement if it is just right. My mom instilled in me at 10 that real men take action. Sometimes wrong but action. This will be fixed by a president who is not frightened.

Eric, here's another location that I just found out.

Southwest Key on Buckeye Road in Tucson AZ are housing 400 children classified as unaccompanied minors, including 81 who were separated from their parents.

13 such locations statewide. One of those facilities is in Tucson; the rest are in Maricopa County.

Lordy have mercy. Knocked down by Reagan, brought back by Clinton and just existing until now. "internment" of children? I am old so I do not have my gun rack in my pick em up truck anymore. That is a good thing. Massive wrong here.

    Will the the "order" work?

I am on a list to "foster" if available but it will not be. Dems. in Congress want this issue against Trump in November.

But my source in DC tells me that it can be fixed by executive order.

I was doing that quite estranged research of human flow to work. We can absorb these children into our schools. The situation now has work.

Like those old teeter totters we played at school.

I stay on lists and I send money.

United States is the only country in the world not to ratify the Convention on the Rights of the Child 1990

The best interests of the child shall be a primary consideration.

Ensure the child such protection and care as is necessary for his or her well-being,

The right to know and be cared for by his or her parents.

Shall ensure that a child shall not be separated from his or her parents against their will, except when competent authorities subject to judicial review determine, in accordance with applicable law and procedures, that such separation is necessary for the best interests of the child.

I have been working hard on this. The dems do not want to fix it. They want it as a talking point against Trump. It is the dems that are blocking a fix. They are sacrificing the young for political points. This situation stinks. We need churches and Red Cross to step in. The dems want it for November.

Not good. Our people could fix it but then they could not use it against.

So sick it makes me ill.

What You Can Do To Help End Family Separation

    https://www.texastribune.org/2018/06/20/separated-...

“In general we do not identify the locations of permanent unaccompanied alien children program facilities,” said agency spokesman Kenneth Wolfe.

The three centers — in Combes, Raymondville and Brownsville — have been rapidly repurposed to serve needs of children, including some under 5. A fourth, planned for Houston, would house up to 240 children in a warehouse previously used for people displaced by Hurricane Harvey, Mayor Sylvester Turner said.

Southwest Key Programs in San Benito, Texas is the only name I came up with from that article that also states:

"Children have died at two other programs affiliated with Hill, Behavior Training Research Inc. and Daystar Residential Inc. Between 1993 and 2010, three children died after being restrained at those facilities. In 2002, Latasha Bush, 15, died from asphyxia. Eight years later, Michael Keith Owens, 16, died after being restrained inside a closet. Both were ruled homicides."

NBC reports it costs $775 per child per night to keep children detained in the newly created tent cities; it costs $256 per person per night to hold children in permanent HHS facilities. Moreover, keeping children with their parents in detention centers like the one run by U.S. Customs and Immigration Enforcement in Dilley, Texas, cost $298 per resident per night

Well Mr. You are going to call (619) 231-9712 and do some lash mouth.(be nice at first to get through) They surely need to get it together without politics. Harris is some ethereal whatever.

We clearly need to stop enticing the problem and we need to fix what is real.

Our government has failed us (failing any child is failing me). Private has more ability to care using gov funds to provide.

I got outside of nice a bit at 202-863-8500 And those dogs will hear more tomorrow. If the RNC don't get on this I am going to be white on rice.

"My eight year old in there? first gen immigrant?" Maybe we messed up paperwork?

We push hard for the 10K now. But the stats do not lie. There were almost three times as many under Obama. Damn hard. A call back revealed less than a parent per 5 children. That is an issue.

Are these parents just spawning to get here?

Regardless, once a gain that maniac potus is doing better than the last one. Brutal.

My soul prays for wisdom and guidance. Maybe my pantry and bedroom can take two but no mechanism yet.

Wow. Thank you very much for being SO supportive Eric. I really needed that because I'm being cyberstalked on my personal email, (I've reported it just now), due to my beliefs about this crisis.

    More news:

The bill from Meadows, (Freedom Caucus), one of President Trump’s top allies in Congress and a conservative ringleader, would allow children to be detained with their parents.

A number of lawmakers in both parties have introduced — or are planning — bills on the subject.

Dangdest thing they along with Catholic groups are all over it. Davis is on the border as I write.

Chit chat is dandy but result is candy. I will stay on these bureaucratic dogs 'til the children are free.

I just called our Homestart people because I think "Foster" families would be far cheaper and more gooder. 619.401.3738.

I get the point of both sides. But in my little mind this is mass abuse.

It's so heartbreaking but a little silver lining, at least the kids are not in 113 degree tents like Arapio's tent city in Arizona was. The brand new pop-up tent city in Tornillo, Texas is an "air conditioned tent facility, which offers meals and health care services and allows access for a pro bono immigrant legal group, is "being run by emergency management professionals that have been in probably every disaster you can name in the past decade."

"Ultimately, the reason you have to go to this extreme is because of a failed policy of separating kids,"

Thank you Ptosis for getting in front of this. The situation sucks raw crow eggs. I get the rhetoric needed to not encourage child traffic across borders. But 1400 plus boys in and old K-Mart building is making me sick to my stomach.

I love my gov. I just run a little rowboat in a big ocean but my gov. has my back with a big ship to rescue. No child at our local school or library will go hungry and I mean 3 meals a day and snacks and vitamins.

After doing some researched caused by you. Thank you again. I have no doubt that this situation needs help from Religion. So unpopular it seems these days.

I will give you big bucks mister preacher man if you help these kids!!! I will even hold back from St. Jude's and the Food Bank. These kids have their food and a cot, I need you to show them some love. I need you to set up communication with them and their parents. Big gov. cannot do love and must have policies but humanitarians need only the positive of love.

Bad things happen when good Americans do nothing.

Now please do not think I do not get the problems you lay out. You must speak out as you do as there are serious problems.

I am making inquiry in a bit (Biz Hours) to start on full research this area of "Civil Forfeiture" that is akin to this problem. And these "unknowing mules".

And then my favorite Susan Davis will have me in her face.

Eric Dierker - Thank you for your personal vignette. I simply do not agree that 'Our wonderful public service members' are doing their best under a broken system.

I found out that CPD has a horrible reputation. This is truly a broken system.

It's worse than simple separation. https://www.aclu.org/news/aclu-obtains-documents-s...

Examples of the documented abuses include allegations that CBP officials:

Denied a pregnant minor medical attention when she reported pain, which preceded a stillbirth.

Subjected a 16-year-old girl to a search in which they “forcefully spread her legs and touched her private parts so hard that she screamed”.

Left a 4-pound premature baby and her minor mother in an overcrowded and dirty cell full of sick people, against medical advice.

Threw out a child’s birth certificate and threatened him with sexual abuse by an adult male detainee.

    Meanwhile ..

The legal process may deem this practice to be unconstitutional — violating family integrity, which some courts have found is implicitly part of the Fifth Amendment’s guarantee of “liberty” without due process of law. The UN stated that it violates international law to prosecute asylum seekers criminally.

1500 lost in the system. HHS is not responsible for the children once they leave ORR. Border Patrol agents have told detainees that “their ‘families would not exist anymore’ and that they would ‘never see their children again.’”

Some parents are being deported without their children. And some small children, according to advocates in Central America, are getting deported without their parents.

Very interesting. I just live here next to the largest border crossing in the world. We go with either San Ysidro or Tijuana. Areas around it are so sifty like it just does not matter.

Our wonderful public service members are just plain doing the best they can. A losing battle.

Been around here for near on 40 years and never once heard a first/second or third hand account of such things. My son is happy in school with clearly illegal immigrant offspring.

So I was thinking here about divorce being a much larger problem like by 100%.

Everyday more news about it just keeps getting worse. The legal problems of getting the children back once prison sentence is over shows only a fraction of families are reunited. Coupled with the government stating it is not responsible for the missing children from foster homes brings this entire fiasco to a revolting end.

Good summary of a horrendous situation. Then have the Goebbels type tactic of repeating a big lie over and over till they think it's true. Dems have some blame for the immigration situation were are in, but these human rights' violations are all on Trump and his people.
