Should Judges Scalia and Thomas should recuse themselves ruling on the President's healthcare act?
Scalia and Thomas were invited guests to the Federalist Society's 2011 Annual Dinner and attended. At different tables from Judges was the lawyer who will likely argue the case against the health care bill in front of the Supreme Court. The lawyer was a law clerking for Scalia. President & CEO of Liberty Central, Thomas' wife, Virginia is directly connected to an anti-health care lobbying group. Would this be considered a conflict of interest for the two Judges?
As I know only little of the scenario you mentioned, I assume all of what you said about their involvement is true. This be the case, there would definitely be a conflict of interest as they should not rule on a law or case in which they have personal bias towards. That's basic U.S. legal principle.
