Can a former lifeguard hold a class in a HOA pool as a guest of a member without approval?
I have a former employee that chose to quit after a new management company was hired to manage an HOA pool. She has been admitted as a guest through friends and family as well as randomly asking to members to allow her to be their guest. She is now being admitted into the pool as a guest wearing a red cross lifeguard shirt to give private lessons to members. Our current guards also wear uniforms, her shirt differentiates her from the other guards, but gives the appearance that she is some how affiliated or endorsed with the HOA, a Red Cross Sanctioned class, or the pool management company.
Absolutely you should tell the "new management" company to get rid of her. It is good to have swim lessons. Not good to have swim lessons that you have liability for which you do in this case.
