What Do You Do If A Teacher Endangered Your Child

    What would you do if your child was humiliated by one of her male teachers after falling (The Teacher yelled at her while she was on the floor telling her that if she was going to roll on the floor she needed to take herself out in the hall and roll all she wanted to never asking your daughter if she was okay or why she was on the
    floor).

    Then you take your daughter to the hospital and find out her arm is hurt severely when you start asking the school questions the teacher openly admits making the comment and apologizes then you as a parent ask the school administration what they plan to do to secure your daughters safety and you get issued a criminal trespass warning (within the C.T.W paperwork it states that you can not contact anyone in the district via phone, email, snail mail etc... and if we do it will be considered harassment and the school district police will arrest you) stopping both you and your spouse from having any involvement to your child's safety and well-being while in the care of the school.

    Now almost two months have gone by and your daughter comes homes telling you that the teachers are yelling at her, making her stand in the back of the classroom because the teachers thinks your child is talking out of turn for asking questions in regards to the assignment, the teacher is allowing other kids to write on the back of your child's shirt, and then today you find out your child was told by this same teacher to shut up and finally be the example of what kids are to be like (When your child was responding to a child that had pulled her hair and then marked all over the back of her shirt).

    Then you go to attorneys for possible representation and the minimum you can find one for is at a $8,000.00 to represent you and your child.

    This is what is happening to my child and my family and I really need some advice and some insight. Would you please leave your comments below in the intent of giving me some insight and guidance:

      First, no teacher should act in this fashion nor allow other children to bully your daughter!!!  It's as simple as that!!!   

      Have you gone to the school board or any PTA meetings and reported this? Keep the shirts that are written on.  Do you have the ability to get a pen recorder?  It's a recorder that looks like a pen and can record up to 30 minutes.  You can get them at Radio Shack or on line. 

      Talk with the principal, talk with the teacher, record their answers especially of the teacher who is bullying your daughter. Some states allow this without advising you are recording so check the law.  Most times you only have to say "I am recording this conversation".  This recording can be shown to your attorney no matter what the law says.  Get the school board involved.

      Oh, this has just ticked me off to no end.  I would then get an attorney who will take this on contingency and sue the crap out of the teacher, principal and school for allowing such horrible acts.  Our children are supposed to be safe when they go to school, not terrorized by teachers who are grown adults. 

      When your child is on the playground, is there anyway you can 'secretly' tape her to show the proximity of a teacher to your child when she is being bullied?  Get as much evidence you can!!!

      See my hub on Bullying and Suicide. Talk to your daughter and if she is withdrawing, not playing her favorite game or playing with the family dog take her to a doctor. Is she complaining of stomach aches stating she is too sick to go to school?  These are things you need to look for, emotional and physical changes.   Bullying can have long term effects and it's called emotional abuse.   Spend as much time with your daughter as you can, tell her that you love her and that she is doing nothing wrong. 

      I was an investigator for major insurance carriers for 20+ years and believe me, it's easy to record someone especially when they don't think they are being watched.  You can even plant a small camera on your daughter to record the activities at school.  (don't tell her she is wearing one)

      My thoughts may have been all over the place here, but hearing your story pisses me off to no end!  This should not be happening to our children.  That teacher does not deserve his job and should be fired!  The teacher thinks he is 'not touchable' at this time and will not stop bullying your child. 
      Hell, get into the classroom and plant a bug so you can see the recording on your computer.  I'd get as much evidence as I could to nail this person.

    I don't understand why you would be issued a criminal trespass warning, nor have I heard of them used in this way.  I don't know where you live, but this doesn't sound legal.  Most lawyers will give a free initial consultation.  I've never heard of anything like this happening where you're not able to communicate with those who are in care of your child. Do you have a civil action advocate or group in your community? Sometimes local news media have investigators that act on your behalf. 

    I would find a new school. It's terrible to see that a teacher didn't even ask if she was ok, regardless of how she was acting.

    Number one on the list is to keep your cool.  If you were issued a criminal trespass warning preventing you from speaking from anyone in the school district either the entire district is ganging up on you or a visit to the school turned ugly and confrontational.

    You won't solve a problem by yelling or threatening anyone at the school - the result of being extremely obnoxious, issuing threats or yelling is going to be just what happened - the school takes offense and takes action to stop the abuse.

    Sit back, calm down and find other actions you can take to stop this.  Sarra's suggestions are a great starting point, seems to me.  Get some solid evidence to back you and apologize all over yourself for whatever caused the CTW to be issued while very politely requesting an additional visit with the principal or higher authority. 

    Going public is a possibility, but make absolutely sure you can back up what you say - a return libel or slander suit is a distinct possibility if you cost some teacher their job or even a black mark on their record.
