when is the fee for title check paid? Can it be taken out or the buyer earnest money deposit?
It depends on when ordered, how its ordered, WHO ordered it, through who, and your relationship with the title company.
The title search fee is paid to the title company. If it's a "preliminary" title search, and you're just checking title before buying sub-to or something, and if you ordered it, you'll usually either get billed by the title company, OR you pay 1st online, THEN get the info.
If it's the final search that's being done a day or two before closing to verify everything, then it's typically taken out of the proceeds of closing.
I've never heard of it coming out of the earnest $...
