Kind of tired of this notion of kowtowing to these guys in the first place and then I find this.

And, yes, it is public domain. So, what are our lords and masters doing then?

I think the techdirt article is an April Fool joke ... it's dated April the 1st.

I didn't read through the article where they were being sued, but the first link you posted takes me to a page that sells posters of the image. I guess it's only fair for them to sell posters using public domain images that are free for commercial use? This is provided that it was set up to be free, even for commercial use.

It looks to me like they are claiming to have some kind of rights to the image and they are selling a license. Those are some expensive posters either way. Something wreaks about it.

The image was originally a poster, I think that's what you are seeing there. The description of it says it's a poster because that was the origin of the image; an old World War 2 propaganda poster. But to the right it says they are selling a license for the image and gives various limitations, etc.

The Getty images site says the original source is Life Magazine. The Wikipedia link says it's work prepared by an officer or employee of the United States Government as part of that person’s official duties, therefore, public domain.

I'm bad at this stuff, is public domain free for commercial use?

Yes public domain is free to use, for any purpose and without attribution.
