Should I file a law suit to see if I can get my School Loan Penalties and fees eliminated?
I was charged $30,000 or more for fees and penalties on my student loans. I transferred my loan and the fees were included. The contract does state that the client is responsible for the penalties. However, I was counseled that I should rehabilitate my loan, get it out of default first (which would eliminate the thousands of dollars that was tacked on). Do I have a case?
I'm not an expert in legal matters in any way, but this sounds like a case of weighing options. If you feel like you have a good case then it might be a good idea, but unless you're representing yourself, which I doubt, you'll have to pay lawyer to make the case for you. For this reason I doubt it would be worth suing because even if you won, it sounds like the amount of money that you would save is not enough to cover all the legal fees that a lawyer is going to charge you (plus if you lost you would have to pay the loan fees and the lawyers fee).
