How to fight a determination of unemployment benefits with a temporary employment agency?
I was recently let go from my company and when the temp service called to tell me that the assignment had ended they simply stated the reason was because "The employer felt you were no longer happy in your position" which may have been true but is certainly no reason to end my employement, So I filed for unemployment and I was contacted by a UI rep and they stated that the temp service said that I was not fired that the assignment had just ended and I was still employed with them. In the state of michigan is it required that I call the temp service every week looking for work?
The Michigan statute requires that when a temp assignment comes to an end the employee must notify the temp agency within 5 days or be deemed a quit and ineligible for unemployment compensation. I'm not aware of any requirement in the law that you must contact the temp agency every week. I suppose it may be possible that something in your agreement with the temp agency requires you to contact them every week. However, the agency has your contact information and the type of work you are qualified for and is perfectly capable of getting in touch with you if they have another assignment for you. I don't see any reason why you would not be eligible for benefits.
