Fix the problem that got you penalized in the first place, then submit your site for reconsideration through google webmasters tools.
Yep, Google will penalize your site if they think you are deliberately trying to game their algo.
They seldom reinstate a penalized website but try your luck mate. Fix the one that you think is the reason why it is penalized then tell Google about it.
By the way, is your website removed from the index? Have you tried the site: command? because sometimes we ought to think we have been penalized but in fact, our site is just undergoing in the Google phenomenon called Google Dance...
Rand Fishkin at Seomoz did a great test of the google penalty. He was able to get penalized and then reinstated. I'm not recommending anyone try it, but it is a great learning experience to read.
