A lot of state executives are upset about the rising cost of health care and the effect it's having on their shrinking budgets, and they're demanding more flexibility from the federal government. So President Obama is offering them something. NPR's Julie Rovner reports it's not really what the governors want.
JULIE ROVNER: Speaking to a group of governors at the White House, the president reminded them that last year's health law actually does give them a chance to take all that federal money the law provides and do just about whatever they want with it, just not right away.
President BARACK OBAMA: This portion of the law has not been remarked on much. It says by 2017, you have a better way of doing it, help yourself, go ahead. Take that route.
ROVNER: Now a bipartisan group of senators, led by Oregon Democrat Ron Wyden and Massachusetts Republican Scott Brown, have proposed to move that date up by three years, to 2014. And today, President Obama threw his considerable endorsement behind that effort.
Pres. OBAMA: It will give you flexibility more quickly while still guaranteeing the American people reform. If your state can create a plan that covers as many people as affordably and comprehensively as the Affordable Care Act does, without increasing the deficit, you can implement that plan.
ROVNER: A lot of people have called this the calling their bluff proposal. And Senator Wyden, who's been shopping the proposal around to both Democratic and Republican governors the past few months, doesn't disagree...

The PEOPLE overwhelmingly elected Obama president. In the most recent polls a majority still approve. You speak for a minority.
That really is one of my favorite things the President has said. If you think it is so darn easy than go ahead and do it and shut up already (that's in my own words of course).
Orrin hatch was on Newshour Monday night talking about this proposal. It's amazing to listen to him simultaneously describe the Affordable Care Act as "one of the worst pieces of legislation in the history of this country" and then state that "we could have come up with a bill that would have much more economic sense, would work better [and] would have both the -- Republicans and Democrats together". If it is so darn easy than what the heck is he waiting for. Put up or shut up. I really think that should be the standard response to just about everything the Republicans say these days.
The GOP did. It was ignored by the Democrats.

what a stupid thing to do. All they have to do is nullify it and then just write their own law.
Or, they could say "hey, Congress... we can't create money or put pressure on the Federal Reserve like you guys can. We want the ability to create money. Oh wait, that's unconstitutional! I guess it's back to gold!"
Problem solved.
The reality is Obama is offering the states nothing except the illusion that he believes in the 10th amendment which he clearly does not!

Modern Supreme Courts have rejected this interpretation of the tenth, which would nullify Social Security, Medicare and a long list of programs which serve the PEOPLE. There is no chance that this Interpretation of the tenth will be upheld, based on the comments Scalia made recently to the new teabagger congresscritters. So you and Evan can pass tenther theories back and forth, just so we understand it's fantasy.
We'll see... nulification has already worked before remember real id? The Idaho governor intends to try it and with the florida ruling in favor of 26 states it seems more likely than not that Obamacare will be eliminated.
